THE ITEM BEING PRESENTED IS THE 2025 AMENDMENT AND RESTATED TRANSPORTATION SURTAX INTERLOCAL AGREEMENT, OTHERWISE KNOWN AS THE THIRD AMENDMENT. TO GET STARTED, JUST A SHORT AND QUICK UPDATE AS RELATES TO THE HISTORY OF THE TRANSPORTATION SURTAX .
CURRENTLY, 29 OF 31 BROWARD CITIES PARTICIPATE.
AND THE AGREEMENT WHILE THE ILA GOVERNS THE AGREEMENT BETWEEN THE COUNTY AND CITIES THAT IS CITIES ARE GUARANTEED AT LEAST 10% OF THE ANNUAL SURTAX REVENUES. SO SINCE 2018, THE ILA AGREEMENT HAS GONE THROUGH SEVERAL AMENDMENTS.
AND IN 2019, THE FIRST AMENDMENT CLARIFIES PROJECT TYPES AND EVALUATION CRITERIA.
IN 2021 SECOND AMENDMENT ADDRESS PROJECT RANKINGS AND REHABILITATION AND MAINTENANCE FUNDING.
SO A FEW KEY THINGS ABOUT THE AMENDMENT. IT BECAME EFFECTIVE AS OF JUNE 30TH AND PROVIDES A MORE STABLE AND PREDICTABLE FUNDING MODEL FOR CITIES WHERE CITIES CAN ACCESS BOTH MAINTENANCE AND CAPITAL PROJECT FUNDS MORE EASILY.
SO JUST A FEW HIGHLIGHTS ABOUT THE THIRD AMENDMENT.
I'LL JUST GIVE YOU THIS INFORMATION. THE COMMUNITY SHUTTLE WILL ALWAYS BE FUNDED FIRST THROUGH 2048.
CITIES MAY RECEIVE ANNUAL RANDOM MAINTENANCE FUNDS BASED ON THE MILEAGE OF ROADS THEY MAINTAIN.
BUT IF FUNDS ARE AVAILABLE STARTING IN 2034, 60% OF AVAILABLE FUNDS ARE GUARANTEED.
TANYA, BEFORE YOU GO FORWARD, CAN YOU GO BACK TO THE ANNUAL FORMULA BASED FUNDS AVAILABILITY FOR REPAIRS AND MAINTENANCE? SO THAT FUNDING IS SUPPOSED TO BE AVAILABLE STARTING AT FY 2026.
YES. OKAY I JUST WANT TO CLARIFY THAT OKAY. OKAY OTHER NEW PROGRAM ELEMENTS INCLUDE CITIES CAN USE LIMITED SURTAX FUNDS FOR BENCHES AND LIGHTING AS PART OF FUNCTIONAL ART.
PARKING STRUCTURES ARE ELIGIBLE IF THEY USE FUNDS FOR TRANSPORTATION IMPROVEMENTS.
PROJECTS ALREADY IN THE PLAN WILL BE PRIORITIZED FOR FUNDING BETWEEN 2026 AND 2029.
LATER PHASES OF CAPITAL PROJECTS, KNOWN AS CAPITAL PROJECT TRAILS, WILL BE PRIORITIZED FOR FUNDING FROM 2030 TO 2033. AND FINALLY, CITIES CAN APPLY FOR COMPETITIVE FUNDING STARTING IN 2034 FOR NEW CAPITAL PROJECTS.
NOW, I WAS MENTIONING FISCAL YEAR 2026. THE CITY STANDS TO RECEIVE $978,000 BASED ON FORMULA FUNDING FROM A $30 MILLION SURTAX FUND. WHAT THIS MEANS THAT THE MORE ROADS THAT CITY MAINTAINS, THE MORE FUNDING THEY'LL RECEIVE. SO FUNDING UNDER THE REHABILITATION AND MAINTENANCE PROJECTS CITY CAN DO PROJECTS SUCH AS SIDEWALK REPAIRS, TRAFFIC SAFETY AND TRAFFIC CALMING, STORMWATER DRAINAGE, AND PEDESTRIAN SAFETY.
FUNDS CAN ALSO BE USED FOR MICROTRANSIT SERVICES TO INCLUDE ON DEMAND OR APP-BASED RIDE SERVICES.
NOW CITIES SHOULD RECEIVE NOTICES FOR FUNDING AROUND JULY 31ST.
AND SO WE'RE ACTUALLY VERY HAPPY THAT IT'S THIS STATE, SO WE CAN START TAKING ADVANTAGE OF THE SURTAX FUNDING FOR OUR DESPERATELY NEEDED REPAIR AND MAINTENANCE PROJECTS.

SO TR 14275 ESTABLISHES THE PRELIMINARY FIRE ASSESSMENT FOR PURPOSES OF THE NOTICES.WE ARE PROPOSING THIS YEAR, A RESIDENTIAL RATE OF $450,000, WHICH IS $30 MORE THAN FY 2025.
BUT IT'S IN LINE WITH OUR RATE STUDY THAT WAS DONE IN 2023.

AND HERE IS A DEPICTION OF THE RATE WHERE YOU SEE THE RESIDENTIAL RATE AND WHAT THE COMMERCIAL, INDUSTRIAL AND INSTITUTIONAL RATE WILL BE WITH THIS NEW WITH THIS INCREASE.

[6.c TR14276 - A Resolution of the City Commission of the City of Tamarac, Florida, relating to the provision of Stormwater Management provided by the City’s Stormwater Utility; determining that certain real property will be specifically benefited thereby; establishing and confirming the method of calculating the cost of Stormwater Management Service against the real property that will be specially benefited thereby; directing the City Manager to prepare or direct the preparation of a preliminary Stormwater Utility Management Fee Roll based upon the methodology set forth herein; establishing a public hearing for the proposed Stormwater Utility Management Fees and directing the provision of notice in connection therewith; providing for conflicts; providing for severability; and providing for an effective date.]
AS YOU RECALL IN 2013 WE ADOPTED AN ORDINANCE 213-05 THAT CREATES THE HOME RULE FOR THE STORMWATER UTILITY MANAGEMENT FEE SPECIAL ASSESSMENT.THIS RESOLUTION ESTABLISHES THE RATE. THE PROPOSED RATE IS $170.89 FOR EQUIVALENT RESIDENTIAL UNIT. IT IS $4.98 HIGHER THAN THE PRIOR YEAR OF 3%.
AND THAT IS PER ORDINANCE, THAT ORDINANCE THAT CALLS FOR AN INCREASE OF 3% OR CPI, WHICHEVER IS HIGHER AND OUR CPI IN MAY OF THIS YEAR WAS 2.4%. THIS WILL FUND ANNUAL OPERATION OF THE STORMWATER SYSTEM, INCLUDING ALL CAPITAL IMPROVEMENT AND CAPITAL EQUIPMENT REPLACEMENT. MOVING ON TO OUR SOLID WEIGHTS 14277

ESTABLISHES A SOLID RATE ASSESSMENT FOR FY 2026.THERE IS NO CHANGE TO THE RATE. THE RATE IS $278.75 PER RESIDENTIAL UNIT.
AND IT'S ESTIMATED TO BRING US A TOTAL ASSESSMENT OF $5,133 ,460.
AND IT COVERS THE SOLID WASTE COLLECTION AND DISPOSAL, THE COLLECTION COST, ADMINISTRATIVE FEE THAT'S ASSOCIATED WITH THE SOLID WASTE COLLECTION.
WE WILL BE DOING A STUDY SOMETIME IN 2026. THIS IS THE FIRST FULL YEAR WITH OUR NEW VENDOR.

[6.e TR14278 - A Resolution of the City Commission of the City of Tamarac, Florida, relating to the provision of nuisance abatement on certain real properties by the city in accordance with Chapter 9, Article II, Division V of the City’s Code of Ordinances; determining that certain real property has been specially benefited by the city’s abatement of nuisances thereon; directing the City Manager to prepare or direct the preparation of a Preliminary Nuisance Abatement Assessment Roll; establishing a public hearing for the proposed levy of unpaid Nuisance Abatement Assessments on the annual tax bill and directing the provision of notice in connection therewith; providing for conflict; providing for severability; and providing for an effective date.]
OUR NEXT IS OUR NUISANCE ABATEMENT AND THIS WAS ESTABLISHED IN 2012 FOR RESIDENTIAL UNIT YOU KNOW, FOR CLEANUP FOR YOU KNOW, RESIDENTIAL UNIT THAT MEETS DEFINITION OF A PUBLIC NUISANCE.SO BETWEEN JUNE 1ST, 2024 AND MAY 31ST, WE HAVE 8 PUBLIC NUISANCES THESE ARE PROPERTIES THAT WE HAD TO GO OUT AND ABATE 5 DID NOT PAY THE COST.
SO WE ARE REQUIRED TO PUT THESE ITEMS ON THE TAX BILL.
SO STAFF HAS COMPLIED WITH THE TERMS OF THE ORDINANCE.
THEREFORE TR 14278 ESTABLISHES THE PRELIMINARY ASSESSMENT FOR THESE 5 PROPERTIES. THE ASSESSMENT RANGES BETWEEN $510.54 AND $1,611.06. WITH THE ADMINISTRATIVE FEES PER BOARD COUNTY, OUR TOTAL ASSESSMENT IS $5,184.82. AND THIS IS JUST A SYNOPSIS OF THE FIVE RESOLUTION THAT I JUST COVERED.

AND IT'S KIND OF SHOWING WHAT A TYPICAL TAX BILL WILL BE WITH THE FIRE ASSESSMENT FEE, THE SOLID WASTE FEE, THE STORMWATER FEE, AND OF COURSE, YOUR PROPERTY TAXES.TIMELINE THE BROWARD COUNTY IS A NO LATER THAN AUGUST 4TH.
WE WILL SUBMIT OUR MILLAGE RATE, OUR PRELIMINARY ASSESSMENT RATES TO THE PROPERTY APPRAISER .
ON AUGUST 12TH, THE PROPERTY APPRAISER WILL BEGIN MAILING THESE TRIM NOTICES SO PEOPLE WILL START RECEIVING THEM IN THEIR MAILBOXES SHORTLY AFTER AUGUST 12TH. THE NOTICE TO THE PUBLIC IN TERMS OF BEING IN THE SUN SENTINEL WILL BE PUBLISHED ON AUGUST 14TH, 2025, AND THE NEXT TIME WE WILL BE TOGETHER AFTER JULY 9TH WILL BE ON SEPTEMBER 12TH.
WE WILL HAVE THE FIRST PUBLIC HEARING , AND THE TENTATIVE MILLAGE RATE AND BUDGET WILL BE APPROVED, AND WE WILL HAVE THE FINAL HEARING FOR OUR ASSESSMENTS FOR THE FIRE RESCUE ASSESSMENT FEE, OUR SOLID WASTE, STORMWATER RATE AND OUR NEW SENSE OF IT.
AND THEN ON SEPTEMBER 21ST, THE BUDGET AD WILL APPEAR IN THE SUN SENTINEL FOR ALL TO SEE.

MANAGER AND RESPECTIVE DIRECTORS, DEPARTMENT DIRECTORS AND MEMBERS OF THE PUBLIC.I'M PRESENTING TO YOU THE 2025 TO 2029 CONSOLIDATED PLAN AND THE ANNUAL ACTION PLAN FOR 2025.
I'M CAROLYN FRANCIS-ROYER. COMMUNITY DEVELOPMENT, HOUSING AND COMMUNITY DEVELOPMENT MANAGER .
OKAY, SO THE CONSOLIDATED PLAN IS REQUIRED TO IMPLEMENT ANY HUD PROGRAMS. IT IS A FIVE YEAR STRATEGIC PLAN THAT HELPS GRANTEES TO DETERMINE ACTIVITIES AND TO FUND ORGANIZATIONS WITHIN THE COMING YEARS. IT DESCRIBES THE COMMUNITY NEEDS, RESOURCES, PRIORITIES, AND PROPOSED ACTIVITIES TO BE UNDERTAKEN.
SO HUD IS VERY PRESCRIPTIVE ON THE TYPE OF ACTIVITIES.
SO THE GRANTS HAVE CDBG AND HOME. THEY HAVE PROJECTS THAT CAN BE UNDERTAKEN SUCH AS PUBLIC IMPROVEMENTS, PUBLIC FACILITIES, REHAB, WHICH IS OUR FAVORITE HERE IN TAMARAC, ECONOMIC DEVELOPMENT, ACQUISITION AND PUBLIC SERVICES.
AND FOR THE HOME PROGRAM, WE BASICALLY JUST FOCUS ON HOUSING REHABILITATION.
THE CONSOLIDATED PLAN HAS FIVE MAJOR COMPONENTS.
AND THIS YEAR'S FUNDING IS $496,342 FOR CDBG.
AND THE HOME IS ESTIMATED AT $152,214. SO THE CONSOLIDATED PLAN HAS IDENTIFIED PRIORITY NEEDS, WHICH IS PUBLIC SERVICES, AFFORDABLE HOUSING OR HOUSING PRESERVATION OR DEVELOPMENT AND EFFECTIVE PROGRAM MANAGEMENT.
AND AGAIN THIS IS THE OVERALL BUDGET FOR OUR CDBG FUNDS, WHICH IS PROGRAM ADMINISTRATION, PUBLIC SERVICES AND HOUSING REHABILITATION. AND FOR THE HOME PROGRAM ONLY HOUSING REHABILITATION.

PUBLIC SERVICES ARE WE ENGAGE WITH NONPROFIT ORGANIZATIONS SUCH AS MEALS ON WHEELS OF SOUTH FLORIDA, WOMEN IN DISTRESS. AND ALSO, WE'VE PARTNERED IN THE PAST WITH LIKE T-MOBILE AND THINGS LIKE THAT, BUT IT'S USUALLY SERVICES FOR TARGETED POPULATIONS SUCH AS SENIORS OR YOUTH.WE'VE ALSO PARTNERED WITH THE YOUTH FOR CELL PHONES.
NOT CELL PHONES. TABLETS. TABLETS? YEAH. TABLETS.
IN THE PAST THAT WE HAVE PARTNERED WITH THE ELEMENTARY SCHOOLS.
I JUST WANTED TO BRING THAT UP SO THAT IT'S NOT OUR PUBLIC SERVICES DEPARTMENT.
THESE ARE SERVICES. OH THESE ARE YES YES. SERVICES TO DISADVANTAGED POPULATIONS SUCH AS SENIORS AND YOUTH.
A VERY IMPORTANT PART OF THE CITIZEN PARTICIPATION IS A PUBLIC HEARING .
WE HAD THE FIRST PUBLIC HEARING AT OUR AFFORDABLE HOUSING ADVISORY COMMITTEE MEETING ON MAY 22ND.
AND THE NEXT ONE WILL BE AT THE CITY COMMISSION MEETING .
THE PLAN IS AVAILABLE FOR REVIEW AND COMMENT AT LEAST 30 DAYS HUD REQUIRES, AND IT IS ON OUR WEBSITE AND WE ALSO OFFER IT IN IN SPANISH. AND THE PUBLIC COMMENT ENDS ON JULY 9TH AT THE CITY COMMISSION MEETING .
SO IN DRAFTING THE PLAN, WE MADE SEVERAL ATTEMPTS TO GET COMMUNITY INPUT.
WE UTILIZED DISTRICT MEETINGS AS A PLATFORM TO GET COMMUNITY INPUT.
AND THIS JUST REPRESENTS HOW MANY SURVEYS THAT WE RECEIVE FROM THE COMMUNITY.
THE PRIORITY NEEDS IDENTIFIED IN RANKED ORDER WAS AFFORDABLE HOUSING, PUBLIC SERVICES, PUBLIC IMPROVEMENTS, AND ECONOMIC DEVELOPMENT. AND THE SURVEYS WAS BROKEN OUT NOT EVERY NOT EVERY QUESTION ON THE SURVEY WAS REQUIRED TO BE ANSWERED. BUT FOR THE FOLKS THAT DID PROVIDE US WITH ALL THE ETHNICITY INFORMATION, THIS IS HOW IT'S BROKEN DOWN. IT'S ALSO BROKEN DOWN BY AGE AND HOUSEHOLD INCOME.
AND THE MAJORITY OF THE RESPONDENTS WERE SENIORS.
SO THE FINAL STEP AFTER CITY COMMISSION APPROVAL, THE PLAN WILL BE ENTERED INTO THE HUD SYSTEM IDIS SYSTEM REQUIRED BY JULY 31ST. AS A MEMBER OF THE HOME CONSORTIUM, WE DO NOT SUBMIT OUR PLAN DIRECTLY TO HUD IS SUBMITTED BY THE BROWARD COUNTY HOME OR HOME CONSORTIUM LEAD. AND AFTER THEY APPROVE, THE COUNTY WILL SUBMIT IT BY AUGUST 15TH.
THANK YOU, CAROLYN . WHAT'S THE COUNTY'S REIMBURSEMENT PROCESS? HOW TIMELY IS THAT? ONCE WE EXPEND THE FUNDS AND THEN WE TURN IT OVER TO THE COUNTY FOR REIMBURSEMENT, AND THEN AND THEN WHAT'S THE TURNAROUND TIME FOR THAT? WELL, THAT'S BEEN CHALLENGING FOR THE LAST FEW YEARS.
THE TURNAROUND TIME IS SUPPOSED TO BE 60 DAYS.
SUPPOSED TO BE. WE HAVE HAD SOME CHALLENGES IN GETTING REIMBURSEMENTS OVER THE LAST FEW YEARS, BUT SINCE WE'VE GOTTEN, I THINK HANS WAS INVOLVED IN COMMUNICATING WITH THE WITH THE COUNTY ATTORNEY.
THEY HAVE HAD STAFF TURNOVER, BUT THEY HAVE IMPROVED.
AND I THINK WE'VE RECOVERED OVER $300,000 OF WHAT THEY OWED US FOR THOSE HOME FUNDS.
SO IT'S GENERALLY SUPPOSED TO BE AROUND 60 DAYS, BECAUSE ONCE WE EXPEND THOSE FUNDS AND THEN WE SUBMIT THE FILES, WE SUBMIT ALL THE DOCUMENTS, AND THEN THEY'RE SUPPOSED TO PROCESS IT WITHIN THEIR ORGANIZATION AND THEN PROVIDE US WITH A REIMBURSEMENT CHECK AND THEN ENTER IT INTO THE IDIS SYSTEM, THE HUD SYSTEM. THAT'S WHAT IT'S SUPPOSED TO BE.
AND I KNOW WE'VE BEEN WORKING WITH CITY ATTORNEY TO RECOVER THOSE IT'S BEEN A LONG STANDING BATTLE. BUT IN TERMS OF OUR ANY OUTSTANDING REIMBURSEMENT REQUEST WITH THE COUNTY.

THE LEAN THAT WE HAVE ON THE PROPERTY. AND WE JUST HAD A HARD TIME GETTING THE HOMEOWNERS TO COME BACK IN AND RE-SIGN THE DOCUMENTS, AND JUST EXPLAINING TO THEM THAT THERE WERE SOME ERRORS MADE WITHIN THE PROCESS AND THE COUNTY WOULD LIKE US TO RE-SIGN.
SO IT'S ONLY A MATTER OF PAPERWORK AND THEN WE CAN RECOVER THE REMAINING BALANCE.

OKAY, SO THE CONDO COMMUNITY THAT I'M TALKING ABOUT SABAL PALM AT 6095 AND 6075, WHICH ARE BEING ASKED TO SPEND $5,000 A MONTH, AND THE PEOPLE ARE JUST MOVING OUT RAPIDLY BECAUSE THEY CANNOT AFFORD THAT.
IS THAT SOMETHING THAT THE CITY CAN SERIOUSLY LOOK INTO? BECAUSE THESE PEOPLE JUST DON'T HAVE THE MONEY THE FACILITY HAS COMPLETELY GONE SO HORRIBLY RUNDOWN.
I MEAN, YOU KNOW, IT'S JUST I KNOW SOMEONE WHO LIVES THERE, AND I WENT TO SEE THE POOL, AND I WAS AGHAST BECAUSE THE POOL WAS LIKE, NOT EVEN, YOU KNOW, USABLE. AND THEY'RE JUST COMPLAINING THAT THEY DON'T HAVE THE MONEY.
AND WE'RE NOT TALKING $175 OR $400 WE'RE TALKING FIVE GRAND.
RIGHT BECAUSE THAT WOULD REALLY FIT HOUSING URBAN DEVELOPMENT.
BUT RIGHT NOW IT'S ALMOST INHABITABLE. THANK YOU SO I BELIEVE THAT YOU'RE REFERRING TO A SITUATION THAT'S IMPACTING A LOT OF CONDOMINIUM ASSOCIATIONS THROUGHOUT THE STATE OF FLORIDA.
I KNOW THE STATE HAS BEEN LOOKING INTO IT FOR SOME RELIEF.
BUT THESE FUNDS ARE FOR INDIVIDUAL PROPERTIES AND NOT FOR HOMEOWNERS ASSOCIATIONS.
IT'S GOT NOTHING TO DO WITH HOMEOWNER'S ASSOCIATION.
IT HAS TO DO WITH THE PEOPLE NOT BEING ABLE TO FIX THEIR APARTMENTS INSIDE THE BUILDING.
SO THEY HAVE NOT ONLY THE BUILDING FEES, BUT THEY HAVE PERSONAL FINANCES THAT THEY CAN'T PAY.
AND THIS IS NOT LIKE SHAKER VILLAGE, WHERE IT WAS AN UPSIDE DOWN CLUBHOUSE WITH FOUR WALLS OR FOUR SPIKES AND THAT WAS IT, IT WAS AN EYESORE. THIS IS A COMMUNITY DEVELOPMENT WITH, I BELIEVE 14 TIMES THREE UNITS IN ONE BUILDING AND 12 TIMES THREE UNITS IN ANOTHER BUILDING.
OKAY THANK YOU VERY MUCH. MAY I SAY SOMETHING? YEAH THE HOMEOWNERS THE UNIT OWNERS, THEY CAN APPLY FOR THE MINOR HOME REPAIR PROGRAM.
SO IF THERE ARE ISSUES WITHIN THEIR UNITS, THEY CAN APPLY FOR THAT PROGRAM.
AND IF THEY QUALIFY, THEY CAN PARTICIPATE IN THOSE GRANT FUNDS.
THE REHAB FUNDS CAN ASSIST THEM. RIGHT ABSOLUTELY THIS IS OPEN TO EVERYONE IN THE CITY CRITERIA APPLY. AND SO WE FOLLOW THOSE SAME ELIGIBILITY REQUIREMENTS.
