SO WE WANT TO USE THIS AS A BACKUP PLAN IN CASE WE NEED IT FOR FUTURE IN THE FUTURE.

INSTEAD OF BUYING A WHOLE BRAND-NEW VEHICLE, IT BASICALLY IS TAKING THE BOX ON THE BACK OFF OF THE EXISTING RESCUE AND PUTTING IT ON A NEW CHASSIS. SO IN ESSENCE, IT'S A BRAND-NEW TRUCK. THEY GO THROUGH IT. THEY DO EVERYTHING THEY NEED TO DO. ALSO INCLUDED IN THIS PRICE IS A NEW STRYKER POWER LOAD SYSTEM (X2) AND MOTOROLA RADIOS. AND AGAIN WE RECYCLE REFURBISH THAT REAR-COMPARTMENT AND WE'RE GETTING IT THROUGH TEN-8 , WHICH IS THE COMPANY THAT WE HAVE THE TWO RESCUES WE'RE WAITING FOR THE ONES WE DID TWO YEARS AGO TAKES SO LONG TO GET THE STUFF DONE.
BUT THOSE TRUCKS JUST WENT OUT. THE PREVIOUS ONES JUST WENT OUT.

AND SO THE ZONING IN PROGRESS ALLOWS US TO STUDY THE USE AND DETERMINE WHETHER OR NOT WE'RE HAVING A PROLIFERATION AND WHAT IS APPROPRIATE IN ORDER TO ADDRESS WHAT'S GOING ON. SO IN FEBRUARY 2025, MISTER MANAGER, YOU INSTITUTED A ZONING IN PROGRESS, AS YOU RECALL.
AND THEN SHORTLY THEREAFTER, THE CITY COMMISSION RATIFIED THAT ZONING IN PROGRESS, WHICH ALLOWS STAFF TO STUDY THE USE AND COME BACK WITH A RECOMMENDATION, WHICH IS WHAT THIS ORDINANCE DOES. SO IN STUDYING THE USE, WE FOUND OUT THAT THERE ARE 17 FUNERAL HOMES WITHIN A 5- MILE RADIUS OF THE CITY'S BOUNDARIES. THREE OF THOSE ARE LOCATED IN THE CITY OF TAMARAC.
WHEN YOU LOOK AT THIS MAP, THIS IS OUR ZONING MAP AND IT'S SHOWING THE THREE LOCATIONS.
AND AS YOU CAN SEE, THEY ARE ON OUR MAJOR THOROUGHFARE ON COMMERCIAL BOULEVARD BOTH TWO OF THEM ON COMMERCIAL BOULEVARD AND ONE OF THEM ON WEST MCNAB RD. AND THAT'S WHERE YOU SEE THE STAR IN THE ZONING MAP.
SO ESSENTIALLY, OUR STUDY AND RECOMMENDATION, THERE'S NO NEED, GIVEN THE FACT THAT YOU HAVE THAT MANY WITH THREE IN THE CITY, THERE'S NO NEED TO HAVE THEM IN ALL THE ZONING DISTRICT BECAUSE THE ZONING DISTRICTS, AS YOU MIGHT KNOW, ARE REALLY THE MIXED-USE ARE INTENDED FOR PEDESTRIAN-FRIENDLY ENVIRONMENT, FOR WORK, RECREATION, SHOPPING. AND SO WE DON'T BELIEVE THAT A FUNERAL HOME IS APPROPRIATE IN THAT ZONING DESIGNATION.
AND WHEN WE LOOKED AT THE PUBLIC FACILITY ZONING DESIGNATION THAT IS INTENDED TO PROVIDE FOR EDUCATIONAL, INSTITUTIONAL USES, MUNICIPAL AND GOVERNMENT FACILITIES, AND SO STAFF DOES NOT BELIEVE IT'S APPROPRIATE IN THAT DESIGNATION AS WELL.
AND SO THIS IS THE PROPOSED ALLOWED USE MAP. AND THIS IS IN THE LAND DEVELOPMENT CODE.

AND AS YOU CAN SEE, YOU CAN SEE THE PS WHICH ARE IN RED.SO WE'RE PROPOSING THAT IT BE REMOVED FROM THE MU-N, FROM THE MU-C AND FROM THE PF, WHICH IS A PUBLIC FACILITY, AND THEN LEAVE IT TO CONTINUE TO BE ALLOWED IN THE BUSINESS PARK.
AND JUST SOME CHARACTERISTICS ABOUT FUNERAL HOMES, TYPICALLY LOW-FOOT TRAFFIC.
TYPE OF USE, THEY'RE QUIET AND SUBDUED. LACK ECONOMIC SYNERGY FOR RETAIL.
THEY'RE INDEPENDENTLY FUNCTION. SMALLER EMPLOYMENT BASE.
DOES NOT ALIGN WITH THE INTENT OF THE MIXED-USE DISTRICT, AS WELL AS THE PUBLIC FACILITY DISTRICT AND A SOMBER ASSOCIATION COUNTER TO VIBRANT MIXED-USE CENTERS, WHICH ARE SOME OF THE REASONS WHY WE'RE NOT RECOMMENDING THAT IT STAYS IN THE MIXED-USE DESIGNATION.
IN ADDITION TO THAT, WE DON'T BELIEVE THAT IT ALIGNS WITH SOME OF THE KEY ECONOMIC DEVELOPMENT POLICIES THAT WE HAVE IN OUR COMPREHENSIVE PLAN, PARTICULARLY IN THE ECONOMIC DEVELOPMENT ELEMENT.
AND THERE ARE CRITERIA OR STANDARD THAT WE HAVE TO CONSIDER WHEN WE DO A TEXT AMENDMENT.
AND SO THE TEXT AMENDMENT, WE KNOW THAT IS IN LINE WITH THE COMPREHENSIVE PLAN IN THAT.
GO THROUGH. AND THAT IT ALLOWS US TO ADOPT PRO-GROWTH, DEVELOPMENT FRIENDLY BUSINESS PROGRAMS BY AMENDING THE LAND DEVELOPMENT CODE TO FOSTER THE GROWTH OF VIBRANT ECONOMIC CORRIDORS THAT WILL ENHANCE THE QUALITY OF LIFE FOR TAMARAC RESIDENTS.
THESE ARE THE REVIEW STANDARDS FOR THE LAND DEVELOPMENT CODE THAT MUST BE MET WHEN YOU'RE CONDUCTING A TEXT AMENDMENT, AND STAFF BELIEVES THAT THE PROPOSED CHANGES IS CONSISTENT WITH THE REVIEW STANDARDS.

SO THIS AMENDMENT THAT WILL BE ON WEDNESDAY'S AGENDA IS A TEXT AMENDMENT TO AMEND THE OVERLAY DISTRICT THAT IS CURRENTLY IN THE LAND DEVELOPMENT CODE.
IT'S THE ONLY OVERLAY DISTRICT THAT THE CITY HAS IN ITS BOOKS.
AND THIS SLIDE IS JUST GIVING YOU A LITTLE BIT ON THE PURPOSE AND INTENT OF THE OVERLAY DISTRICT, WHICH IS REALLY TO CREATE AN ESTABLISHED SPECIFIC REGULATIONS IN ADDITION TO THOSE REQUIREMENTS CONTAINED WITHIN THE CITY CODE OF ORDINANCES.
IT SERVES TO PRESERVE THE NEIGHBORHOOD CHARACTER, IT PROMOTES HIGH QUALITY AND APPEARANCE, PROPERTY MAINTENANCE VALUES, AND IT PROTECTS THE PUBLIC HEALTH, SAFETY AND WELFARE.
SO IN 2018, IT WAS DETERMINED DURING THE TIME WE WERE UPDATING OUR ZONING CODE THAT BECAUSE IT'S THE ONLY COMMUNITY WITH AN OVERLAY DISTRICT, THERE WAS CONSENSUS TO SUNSET THIS DISTRICT AND TO ALLOW THE COMMUNITY TO ADOPT ITS OWN GUIDELINES AND ITS OWN WAY OF FUNCTIONING AND OPERATING. AND SO IT WAS SET TO SUNSET ONE YEAR AFTER THE 2018 CHANGES IN THE CODE.
AFTER THAT WAS ADOPTED IN 2018, WE KNEW THAT THE WOODLANDS DEVELOPMENT PROJECT WAS COMING FORWARD, AND THERE WAS SOME DISCUSSION TO HAVE IT EXTENDED TO MAKE SURE THAT THE DEVELOPMENT WOULD INCLUDE REQUIREMENTS, THE DEVELOPMENT AGREEMENT WOULD INCLUDE REQUIREMENTS SO IT COULD TAKE OVER THIS OVERLAY DISTRICT.
SO THIS SLIDE IS SHOWING YOU ALL THE EXTENSIONS THAT HAPPENED SINCE 2018.
SO IN 2019 IT WAS EXTENDED AGAIN FOR TWO YEARS.
IN 2020 IT WAS EXTENDED FOR THREE YEARS. AND IN 2021 IT WAS EXTENDED AGAIN.
AND IN JUNE 2022, JUNE 8TH, 2022, IT WAS EXTENDED FOR A TOTAL OF SEVEN YEARS FROM 2018, AND NOW IT'S SET TO EXPIRE JULY 2025. DURING THAT TIME, OF COURSE, THE CITY ADOPTED THE SITE PLAN FOR THE WOODLANDS DEVELOPMENT.
WE ADOPTED THE DEVELOPMENT AGREEMENT AS WELL, AND IN THAT DEVELOPMENT AGREEMENT THERE WAS LANGUAGE INCORPORATED THAT WOULD ALLOW FOR THE WOODLANDS OVERLAY TO CONTINUE TO FUNCTION, PROVIDED THAT THE DEVELOPER PAYS FOR THROUGH SECTION 9,

AN OFFICER AND PUT THE STRUCTURE TOGETHER. SO THE STRUCTURE ITSELF WAS ADOPTED IN THE DEVELOPMENT AGREEMENT.AND THEN THERE WAS LANGUAGE ALLOWING THE DEVELOPER THROUGH SECTION 9 TO PAY FOR AN OFFICER.
THIS IS A TEXT AMENDMENT TO THE CODE. AND SO AS WITH THE PREVIOUS AMENDMENT, THERE ARE CERTAIN STANDARDS THAT MUST BE HELD, OR STAFF HAS TO DETERMINE THAT HAVE BEEN MET WHEN YOU'RE DOING A TEXT AMENDMENT.
AND THIS SLIDE JUST SHOWS THAT THOSE STANDARDS WERE MET.
AS SUCH, WE ARE RECOMMENDING THAT THERE BE A CHANGE TO THE TEXT OF THE LAND DEVELOPMENT CODE, AND WHAT IS UNDERLYING IS WHAT IT WOULD NOW READ, THAT IT WOULD TERMINATE AT SUCH TIME AS WHEN THE CODE ENFORCEMENT STRUCTURE AND OFFICER FUNDED BY WOODLANDS SECTION 9, REQUIRED BY THE DEVELOPMENT AGREEMENT BETWEEN WOODLANDS CLUB HOLDINGS LLLP AND THE CITY OF TAMARAC IS ESTABLISHED.

WE BROUGHT THIS UP AGAIN AS TO HAVE MORE DISCUSSION ON ALLOWING THE SALE OF AND CONSUMPTION OF ALCOHOLIC BEVERAGES, MAINLY AT CITY EVENTS. THIS WAS CODED IN 1975, SO IT'S SOMETHING THAT'S BEEN HASN'T CHANGED IN OVER 50 YEARS.
YOU KNOW, AS OUR COMMUNITY HAS CHANGED, OUR DEMOGRAPHICS HAS CHANGED AND OUR INCREASED AMOUNT OF EVENTS THAT WE HAVE WE'RE JUST LOOKING TO CHANGE AND KIND OF GO WITH WHAT THE OTHER CITIES ARE DOING. WE'VE CONTACTED OVER 15 CITIES, AND ALL OTHER CITIES ARE DOING THE SAME THING.
THAT'S REALLY ALL I HAVE ON THAT. THANK YOU. AND THEN WE'RE GOING TO TALK ABOUT THE STRUCTURE OF THAT, YOU KNOW, HOW WOULD THAT OPERATE. CORRECT. NOW OR? WELL, YEAH, WE CAN DO IT NOW. THEY WOULD HAVE TO WHETHER IT'S OUR EVENT OR JUST A PRIVATE COMPANY THAT'S COMING IN TO HOLD AN EVENT THAT WOULD LIKE TO SELL ALCOHOL, THEY WOULD HAVE TO MAKE SURE THEY HAVE THE RIGHT AMOUNT OF SECURITY ON SITE AND SANITATION ON SITE.
AND ALSO BEFORE IT HAS TO GET APPROVAL BY THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE.

DURING COMMISSIONER BOLTON'S COMMISSION REPORT, HE MADE A REFERENCE TO THE ITEM PRIOR TO DURING THE PRESENTATION, PROCLAMATIONS AND PRESENTATIONS. AND THEN FORMALLY, DURING HIS COMMISSION REPORT, HE ASKED THAT THIS ITEM BE ADDED TO THE NEXT AGENDA.

HOW WE CAN POTENTIALLY PROVIDE THIS KIND OF SERVICE? SURE AND I KNOW THAT PARKS AND RECREATION, THEY HAVE DONE AN ASSESSMENT AS WELL AND LOOKED AT OTHER COMMUNITIES WHERE BENCHES WERE USED IN THE PAST, AND IN THOSE INSTANCES HAVE FOUND THAT IT PROLIFERATED THE PARKS.AND SO THE PARKS INTERIM DIRECTOR IS RECOMMENDING PERHAPS A PAVER TYPE OF APPROACH, WHICH IS NOT AS INTRUSIVE AS THE BENCHES WOULD BE, BUT IT'S SOMETHING WE CAN DEFINITELY DISCUSS DURING WEDNESDAY'S MEETING.
OKAY. AND I THINK WE ALSO DESIGNATED POTENTIALLY THE SITE OF THE PUBLIC ART OUTSIDE OF STATION 15 FOR THIS KIND OF APPROACH. AND WE ASKED OUR PUBLIC ART ADMINISTRATOR TO LOOK INTO THE ESTABLISHMENT OF THAT GROUND SPACE FOR THAT. CAN WE GET AN UPDATE FROM HIM, YOU KNOW, BETWEEN NOW AND THEN? YES.
