WE WANTED TO REPRESENT ALL OF THE LANGUAGES OF THE CARIBBEAN. WE WANTED TO BE ABLE TO USE THAT MONEY TO REACH OUT ACROSS AND ASSIMILATE WITH THE MANY WITH A DIVERSITY THAT IS THE UNITED STATES AND WHERE ELSE IS THAT DIVERSITY MORE EVIDENT THAN HERE IN BROWARD COUNTY. BOLTON DISTRICT 1. GOOD EVENING. SO HAPPY TO BE HERE AND SO HAPPY TO BE REPRESENTING THE RESIDENTS OF TAMARACK AND ALSO BEING YOUR TIME LIKE A DISTRICT ONE REPRESENTATIVE. AND THANK YOU SIR FOR BEING HERE THIS EVENING TO ACCEPT THE PROCLAMATION CARIBBEAN HERITAGE MONTH IS EXTREMELY IMPORTANT TO ME AND TO US TAMARACK IS NOT JUST YOUNGER BUT IT HAS CHANGED IN OUR DEMOGRAPHICS AND WE HAVE LOTS OF RESIDENTS FROM ALL PARTS OF THE CARIBBEAN HERE LIVING IN OUR CITY AND WE WANT THEM TO KNOW THAT WE WELCOME THEM WE APPRECIATE THEM FOR LIVING IN OUR CITY AND EXTENDING THIS PROCLAMATION FOR THE WORK THAT YOU HAVE DONE IS THE LEAST THAT WE CAN DO. TAMARACK HAS NOT JUST CHANGED BUT OUR COMMISSION HAS CHANGED AND SO WE EMBRACE THAT CHANGE IN OUR CITY COMMISSION FOR THE FIRST TIME IN HISTORY. WE HAVE A JAMAICAN THAT IS PRESIDING WITH US AND WE HAVE ASIAN-AMERICAN THAT IS PRESIDING WITH US. AND SO WE WE LOVE THE CHANGE WE LOVE THE DIVERSITY. WE TALK ABOUT DIVERSITY WE'RE NOT JUST TALKING ABOUT THE COLOR COLOR OF OUR SKIN WE ARE TALKING ABOUT DIVERSITY AND IN ALL IN ALL SENSE OF OF THE WORD. AND SO TAMARACK IS DIVERSE. WE HAVE CHANGED AND THIS IS A CITY THAT WE ARE VERY PROUD OF AND WE ARE THANKFUL THAT THE MAYOR WAS ABLE TO SIGN THAT PROCLAMATION THIS EVENING. SO VERY GOOD JOB AND THANK YOU SO VERY MUCH. I WAS AT LAKES OF CARRIAGE HILLS JUST LAST NIGHT AND I WAS THERE FOR THE HURRICANE PREPAREDNESS MEETING. THAT MEETING WAS PHENOMENAL. THE RESIDENTS CAME OUT AND THEY WERE ABSOLUTELY ENGAGED AND HAPPY THAT WE WERE ABLE TO BE THERE WITH FIRE AND VSO AS WELL. DEPUTY MARION WAS THERE CHIEF SALES WAS THERE AND THE INITIATIVE WAS SPEARHEADED BY OUR VERY OWN HERBERT DALY WHO WAS ALWAYS WORKING SO TIRELESSLY IN THE COMMUNITY WITHOUT PAY. AND HIS HE'S JUST ALWAYS HERE. AND I JUST WANT TO SAY PUBLICLY THANK YOU FOR MAKING SURE THAT OUR RESIDENTS GET THE RIGHT INFORMATION WHEN THEY NEED IT. ONDEMAND YOU'RE ALWAYS THERE ON THE GROUND. PEOPLE REALLY THINK THAT YOU ARE THE HRC PRESIDENT AND YOU ARE IN MY EYES. SO THANK YOU SO VERY MUCH FOR FOR YOUR HARD WORK. GOING. COMING BACK TO TODAY VICE MAYOR BLANCO AND I ACTUALLY WENT TO BROWARD OUTREACH CENTER AND WE WENT THERE TO FEED THE HOMELESS. AND WHAT A DAY IT WAS. YOU KNOW I ALWAYS SAY THAT HOMELESSNESS IS NOT MENTAL ILLNESS ONE THAT IS HOMELESS IS NOT MENTAL. THEY ARE NOT CRAZY PEOPLE. THEY ARE A PEOPLE JUST LIKE YOU AND ME PEOPLE WHO HAVE FALLEN ON HARD TIMES. I WAS I WAS HAVING A CONVERSATION ABOUT HOMELESSNESS AS WELL AND HOMELESSNESS IS SOMETIMES ONE PAYCHECK AWAY FROM THAT DISASTER. YOU KNOW AS

[00:15:06]

SOMEBODY WHO DOES WHO'S RENTING YOU DON'T HAVE YOUR RENT ON THE FIRST OF THE MONTH.

FIVE DAYS LATER YOUR LANDLORD IS KNOCKING ON YOUR DOOR. YOU DON'T HAVE THAT RENT.

THREE DAYS LATER YOU GET A THREE. THREE DAYS YOU GET A THREE DAY NOTICE FIVE DAYS YOU GET A FIVE DAY NOTICE. NEXT THING YOU'RE IN THE COURTHOUSE NEXT THING YOU'RE ON THE SHERIFF IS AT YOUR DOOR TELLING YOU TO LEAVE. AND SO THAT IS REALLY REALLY DEAR TO MY HEART. WE WERE ABLE TO TOUR THE FACILITY MEET STAFF. SHARE MEALS TO THEM AND MEET BEHAVIORAL REPRESENTATIVES THERE AND SO ON AND SO THEY'RE NOT JUST PUTTING A BAND-AID ON THE PROBLEM THEY'RE ACTUALLY TAKING PEOPLE THAT ARE HOMELESS HOUSING THEM GETTING THEM JOBS AND AND TEACHING THEM HOW TO GET BACK IN TO SOCIETY. SO I'M VERY PROUD THAT THE VICE MAYOR WOULD TAKE TIME OUT OF HER BUSY SCHEDULE TO BE WITH ME TODAY AT BROWARD OUTREACH CENTER. AND I SO APPRECIATE YOU FOR COMING AND EVEN SERVING FOOD. SHE LOOKED AMAZING. SHE DID NOT LOSE HER STYLE AS SHE IS JUST ABSOLUTELY FABULOUS AND YOU WILL DEFINITELY BE SEEING PHOTOS THE GOOD ONES. YOU'LL BE SEEING PHOTOS. AND IN MY IN MY NEXT NEWSLETTER AND YEAH I CONTINUE TO BE VERY ACTIVE IN THE COMMUNITY HAVE BEEN GOING TO LOTS OF AA MEETINGS AND JUST RECONNECTING WITH OUR PRESIDENTS AND FRIENDS IN THE COMMUNITY. AND SO IF THERE'S ANYBODY THAT IS LISTENING TONIGHT THAT IS WANTING TO CONTACT ME MY CELL PHONE NUMBER IS ALWAYS ON AN ACTIVE. IT IS 9 5 4 2 7 5 3 8 5 0. I EXTEND THAT TO ANYBODY NOT JUST RESIDENTS OF THE CITY OF TAMARACK BUT ALL OF BROWARD COUNTY AND ANYBODY THAT LISTENS IT IS 9 5 4 2 7 5 3 8 5 0. AND NORMALLY JUST POST EVERYTHING ON FACEBOOK AND SO EVERYBODY CAN GET TO SEE THAT IF YOU WANT TO GO ON MY FACEBOOK PAGE IT IS FACEBOOK IT IS FACEBOOK DOT COM FORWARD SLASH COMMISSIONER MARLIN BOLTON I KNOW I'VE TAKEN ALL OF MY TIME TONIGHT I THINK I HAVE 30 MORE SECONDS AND FOR THOSE SECONDS I WOULD LIKE TO DISCUSS. HOW EMOTIONAL IT WAS FOR ME FOR THE STORAGE FACILITY THAT WENT INTO MY DISTRICT IN DISTRICT 1 COMMERCIAL BOULEVARD IS A COMMERCIAL STREET AND BACKED UP BY RESIDENTIAL NEIGHBORHOODS AND SO YOU KNOW GIVEN THE HOW THE THAT THE LAND WAS AND ALL THAT THE CITY WENT THROUGH YOU KNOW THERE WERE TALKS ABOUT YOU KNOW WE JUST WANT TO BE DONE WITH IT AND SO WE'RE AT THE STAGE WHERE WE ARE FINISHED WITH IT IS GOING TO BE CONSTRUCTED THE COMMUNITY KNOWS ABOUT IT EVERYBODY HAS A NOTICE ON THEIR DOOR THEY APPRECIATED ME TELLING THEM WHAT IS HAPPENING ABOUT THAT. AND SO ONE OF THE THINGS THAT WOULD MAKE THEM PROUD IS HAVING THE SALE THE PROCEEDS OF THE SALE OF THE LAND GO TO PROJECTS IN DISTRICT 1 TO BETTER DISTRICT 1 AS ALWAYS RUNNING IN 2016 LOTS OF PEOPLE AS THEY AS I KNOCKED ON THEIR DOORS TOLD ME THAT YOU KNOW COMMISSIONER BOLTON WE FEEL NEGLECTED. WE FEEL THAT WE ARE THE STEPCHILDREN OF DISTRICT ONE OF TAMARACK.

WE FEEL THAT YOU KNOW NO ONE EVER COMES OUT HERE AND SO THEY EVEN ASK ME FOR I.D.

AND PROOF THAT I WAS ACTUALLY RUNNING FOR CITY COMMISSION BECAUSE NOBODY ACTUALLY KNOCKED ON THEIR DOOR AND SO ON MY MOTION IS TO EARMARK THE PROCEEDS OF THE THE LAND OR THE PROCEEDS OF THE LAND TO BE USED FOR PROJECTS ONLY IN DISTRICT 1 AND THAT THOSE PROJECTS WILL BE IDENTIFIED THROUGH OUR BUDGET PROCESS. THAT IS MY MOTION THE MOTION IS ON THE FLOOR IF IT PLEASES THE MAYOR. I'D LIKE TO ASK FOR A SECOND IF YOU WOULD. I DON'T MIND THE MOTION AT ALL BUT I WOULD LIKE TO REQUEST AND WE COULD DO IT AT THIS TIME HERE BUT TYPICALLY I'M REQUESTING THAT WE DO IT DURING OTHER WHERE THIS WOULD BE MORE APPROPRIATE. BUT IF WE DO IT HERE NOW I AM ASKING FOR OUR CITY MANAGER TO HAVE A DISCUSSION AT OUR NEXT WORKSHOP FOR THE. APPROPRIATE

[00:20:02]

PROCEDURES FOR PUTTING THINGS ON THE AGENDA AT THE NEXT WORKSHOP. SO IF WE'RE GONNA HAVE IT HERE NOW THAT'S FINE. BUT. CITY MANAGER WILL YOU PLEASE PUT THIS ON THE NEXT WORKSHOP FOR PROCEDURES ON HOW TO PUT THINGS ON THE AGENDA. YES. THANK YOU.

THERE IS A MOTION ON THE FLOOR. I'M GETTING THERE. COMMISSIONER BILL. OKAY GO AHEAD. SINCE THERE IS A MOTION ON THE FLOOR AND WE WILL BE DISCUSSING NEXT TIME HOW DID YOU PROCEDURES AT THE NEXT WORKSHOP. IS THERE A SECOND TO THIS MOTION. SECOND IS THERE ANY DISCUSSION. SAYING THAT THERE IS NO DISCUSSION. THE RECORD MADAM MAYOR IF I MAY QUICKLY THE COMMISSIONER HAS THE PREROGATIVE UNDER PRESENTATIONS OR AT THE OTHER OTHER END OF THE CONVERSATION WHICH IS THAT THE END OF THE AGENDA BUT TO THE EXTENT THAT YOU CHOOSE TO ACCEPT THE MOTION IT'S BEEN SECONDED THE DISCUSSION THAT'S BEEN HAD AS IS SUPPLEMENTAL TO THE CONVERSATION WITH THE COMMISSIONER ON MONDAY AT WHICH MANY WORKSHOP AT WHICH HE RAISED THE BAR ON THE SUBJECT COULD BE THE WISH OF THE CONDITION TO PROCEED. THE MOTION IS NOW ADDS THIS ITEM FOR THE AGENDA FOR THAT PURPOSE AND CAN BE ACTED UPON BY THE COMMISSION IF THERE ARE ANY MEMBERS OF THE PUBLIC THOUGH THAT NEED TO BE HEARD ON THE SUBJECT UNDER FLORIDA LAW THEY HAVE THE RIGHT TO BE HEARD OF IT'S A FINAL ACTION BECAUSE IT'S DIRECTING ADMINISTRATION TO IN FACT ADJUST THE BUDGET ACCORDINGLY AND TO BE CLEAR AH WE ARE REMOVING MY MY MOTION AS I SPOKE AS I SPOKE. OR IS IT IS IT AMENDED BY WHAT THE MAYOR SETS YOUR MOTION STATES SPEAKS FOR IT IF I MAY MADAM AREA YOUR MOTION SPEAKS FOR ITSELF. MY MOMENT WASN'T TO YOUR MOTION ITSELF. IT WAS THE LOCATION ON THE AGENDA FOR THE DISCUSSION OF IT OR TO EVEN HAVING IT BE HEARD. OKAY I'M WITH THE SUBJECT MATTER OF THE MOTION. OKAY SO SO JUST TO BE CLEAR MY MOTION IS TO EARMARK THE PROCEEDS OF THE PROPERTY. AT COMMERCIAL BOULEVARD AND ROCK ISLAND ROAD AND THOSE PROCEEDS TO BE USED FOR EARMARKED FOR PROJECTS IN DISTRICT 1 AND THOSE PROJECTS WILL BE IDENTIFIED DURING OUR BUDGET PROCESS. WE'RE GOING TO TURN THIS BACK TO CITY MANAGER FOR SOUTH AMERICA AGAIN JUST AS THEY CLARIFIED ON MONDAY AND RIVERA FILED IT THROUGH MONDAY THROUGH TODAY. IF THE MOTION IS ADOPTED BY THE COMMISSION JUST LET THE RECORD REFLECT THAT THE CLOSING HAS NOT OCCURRED UNDER THE TERMS OF THE CONTRACT THE BUYER IS REQUIRED TO CLOSE CONTRACTUALLY 15 BUSINESS DAYS SUBSEQUENT TO THE LAST FINAL APPROVAL DEFINED BY THE COURT BY THE BY THE CONTRACT WHICH WAS THE LAST APPROVALS ON MAY THE 22ND. OUR CALCULATION DEEMS THAT POTENTIAL CLOSURE TO OCCUR SOMETIME IN THE MIDDLE OF JULY JULY THE 12TH ROUND NUMBERS. SO FOR THE PURPOSE OF DISCUSSION AND NOT TO DECEIVE ANYBODY WE DON'T HAVE ANY PROCEEDS FROM THE SALE HASN'T CLOSED YET ALTHOUGH THE BUYER IS HARD ON HIS DEPOSIT AS OF AS OF RIGHT NOW. SO THE MOTION IS PROSPECTIVE. THE ISSUE IS THE CLOSING HAS YET TO OCCUR BUT HOPEFULLY WILL OCCUR BY JULY THE 12TH. OK I'M GOING TO ASK A SEPARATE QUESTION PROCEDURALLY. ARE WE OK TO MOVE IT FORWARD AS REQUESTED. AGAIN NO ISSUE WITH IT JUST MEANS NO PROCEDURALLY OR DOES THIS NEED TO NOW BE PUT AS A SEPARATE AGENDA ITEM FOR THE PUBLIC TO BE HEARD OR CAN I OPEN IT UP IN CASE THE PUBLIC NEEDS TO BE HEARD. WHICH WAY DO YOU NEED US TO DO THIS. IF THE COMMISSION FOR THAT MATTER MAYOR OF THE COMMISSION IS GOING TO TAKE FINAL ACTION ON THE MOTION TONIGHT YOU SHOULD ALLOW THE PUBLIC TO BE HEARD SHOULD THEY TRULY CHOOSE UNDER UNDER SECTION 2 IT IS EXPLAINED 0 1 1 SUBSECTION 4. IT IS MY UNDERSTANDING THAT THE COMMISSION IS SEEKING TO DO FINAL ACTION ON THIS MOTION AS WELL AS SUCH. YES. AS SUCH I'M GOING TO BEFORE WE FINISH THE CALL THE ROLL. I'M GOING TO ASK IF THERE'S ANY MEMBER OF THE PUBLIC WHO IS HERE THAT WISHES TO HAVE ANY COMMENT ON THE MOTION THAT HAS BEEN MADE. BASICALLY PLEASE COME ON UP. I'M JUST GOING TO RESTATE IT SO EVERYBODY IS CLEAR. THERE IS A PENDING SALE OF THE PROPERTY. AT ROCK ISLAND AND COMMERCIAL AND THE PROCEEDS. THIS COMMISSION IS LOOKING TO EARMARKED FOR USE IN DISTRICT 1. FOR THOSE SUCH PROJECTS THAT IT WILL BE USED TO EARMARK WILL BE DISCUSSED IN OUR BUDGET PLANNING WHICH WILL BE NEXT WEEK THAT THE CITY HAS A MEETING SCHEDULED FOR. CORRECT RECAP. YES MA'AM. THANK YOU.

NAME AND ADDRESS IF YOU WERE SO WILLING TO GIVE HER THE RECORD PLEASE. I WILL. MY NAME IS RONALD WASSERMAN AT LIBERTY 8 5 7 7 J DRIVE TAMARA. 3 3 3 2 1. IN ALL DUE RESPECT COMMISSIONER BOLTON THAT PROPERTY HAS BEEN THROUGH MANY MANY DIFFERENT THINGS. THERE WERE MEMBERS OF DIFFERENT DISTRICTS WHO VOTED FOR THAT ORIGINALLY ETC. ETC. I AS A CITIZEN AM AGAINST ONE ONLY GETTING PROCEEDS OF THAT PROPERTY.

THANK YOU. THANK YOU VERY MUCH. IS THERE ANYBODY ELSE WHO WISHES TO SPEAK ON THIS MATTER. SAYING THERE'S NO ONE ELSE WHO WAS JUST TO SPEAK ON THIS MATTER. WOULD YOU PLEASE CALL THE ROYAL COMMISSION COMMISSIONER FISHMAN. YES COMMISSIONER

[00:25:03]

GALEN. YES. VICE MAYOR PLAXO. YES. COMMISSIONER BOLTON. YES. MAYOR. MAYOR GOMEZ. YES. MOTION CARRIED. THANK YOU VERY MUCH. WELL THAT WAS THE END OF YOUR REPORT. THANK YOU MADAM MAYOR. I WOULD BE REMISS IF I DID NOT RECOGNIZE THAT MAYOR HAZEL ROGERS WAS GONNA DO THAT. BUT I STILL HAVE THE FLOOR. THANK YOU. I WOULD I WOULD NOT. I WOULD BE REMISS IF I DID NOT MENTION THAT MAYOR HAZEL ROGERS IS HERE ON TONIGHT ON MY INVITATION. MAYOR HAZEL ROGERS OBVIOUSLY IS THE MAYOR OF LAUDERDALE LAKES AND SHE IS SERVED NOT JUST BROWARD COUNTY IN HER CAPACITY BUT SHE HAS SERVED THE STATE OF FLORIDA. AND AT THE APPROPRIATE TIME MADAM MAYOR I WOULD LIKE FOR YOU TO. GIVE THE MAYOR SOME TIME TO SPEAK AS SHE MISSED THE OPPORTUNITY TO RECEIVE THE PROCLAMATION AS PRESENTED TONIGHT. THANK YOU. AND I YIELD CONSIDERING THE SECOND SHE WAS NOTICED WAS THE MOST APPROPRIATE TIME AND I'M SORRY BECAUSE I DID NOT WANT TO CUT MY COLLEAGUES OFF IN HIS REPORT BUT WE ARE VERY HAPPY TO SEE YOU. MAYOR ROGERS WOULD YOU PLEASE COME TO THE PODIUM AND SHARE WITH US ANYTHING YOU'D LIKE. ALWAYS GOOD TO SEE LOOKING LOVELY AS ALWAYS. DON'T GO FOR THOSE BEAUTIFUL LEGS. COME ON. AND I'M CHAIRING THE MEETINGS SO COULDN'T MAKE IT BUT WOULD NOT MISS THE OPPORTUNITY TO BE HERE AND JUST TO CELEBRATE WITH EVERYONE AS WE CELEBRATE JUNE AS CARIBBEAN AMERICAN HERITAGE MONTH. SO WE ARE DOING A LOT OF THINGS ACROSS THE COUNTRY. THE COUNTY AND THE COUNTRY. SO JUST GOOD TO BE HERE AND THANK YOU FOR RECOGNIZING THE DAY AND THE SIGNIFICANCE. SO THE CARIBBEAN COMMUNITY WE HAVE BLACK HISTORY MONTH WE HAVE HAITIAN AMERICAN MONTH YOU KNOW MAY IS ALSO JEWISH AMERICAN HERITAGE MONTH. SO WE CELEBRATE EVERYTHING IN THIS DIVERSE COUNTRY. SO WE ACCEPT THIS AND THRILLED TO BE A PART OF YOU HAVE A CELEBRATION. THANK YOU. BYE BYE. LOOK FORWARD TO SEEING YOU AT JUNETEENTH. [b. Commissioner Gelin]

EVERYONE. BEFORE I GET STARTED I WANT TO RECOGNIZE FORMER LAUDERDALE LAKES POLICE CHIEF AND CURRENT CANDIDATE FOR BEING SO SHERIFF ANDREW SMALLING. I'LL GIVE A MINUTE OR TWO TO ANDREW IF YOU WANT TO GET ON THE MIKE. THEY'VE BEEN THERE. GOOD EVENING COMMISSIONERS AND STAFF. MY NAME IS ANDREW SMALL AND AS COMMISSIONER GALEN HAS STATED AND I AM CURRENTLY RUNNING FOR SHERIFF BROWARD COUNTY. NEXT YEAR 2020.

IT'S GOOD TO BE WITH YOU. I AM A RESIDENT OF THE CITY OF TAMARACK LIVE RIGHT UP THE STREET. AND I LOVE THIS CITY. I WAS A FORMER CHIEF DISTRICT CHIEF IN THE CITY A LOT OF THE LAKE. SO I'M AT HOME AND IT'S JUST GOOD TO BE WITH YOU. THANK YOU. THANK YOU VERY MUCH. ALL RIGHT. SO THANKS FOR YOUR TIME THIS AFTERNOON. OR EVENING. SO FIRST HAPPY FATHER'S DAY TO ALL THE FATHERS IN TAMARACK BROWARD COUNTY SOUTH FLORIDA. AND HAPPY GRADUATION TO ALL THE GRADUATES INCLUDING MY FOUR YEAR OLD GRADUATED FROM PRE-K. THIS PAST WEEKEND COMMISSIONER EFFICIENT AND I WENT TO THE T.J. REDDICK BAR ASSOCIATION GALA. MY WIFE WAS AN AWARD HE AND SOME NICE COMMISSIONER MARK DOUGLAS JOINED US THERE IS A GREAT EVENT. JUNE 8 IS GLOBAL WELLNESS DAY. SO I JUST WANT TO MAKE SURE EVERYONE OR RECOMMEND EVERYONE DO WHAT THEY CAN TO LIVE A HEALTHY LIFESTYLE. WALK. DRINK MORE WATER. TRY NOT TO USE PLASTIC. LET'S

[00:30:06]

RECYCLE. SO LET'S JUST PRACTICE WELLNESS DAY. EVERY DAY. JUNE 5TH WAS GLOBAL RUNNING DAY. SO I RAN MY THREE MILES AND JUST WANT TO ENCOURAGE EVERYONE WHETHER YOU WALK RUN JUST DO SOME KIND OF ACTIVITY OR EXERCISE TO MAKE SURE YOU LIVE A HEALTHY LIFESTYLE. AND ALSO MAKE SURE YOU GET YOUR KIDS INVOLVED. BASED ON WHAT I READ THIS GENERATION OF KIDS WILL NOT LIVE AS LONG AS OUR GENERATION BECAUSE WE'RE NOT LIVING A HEALTHY LIFESTYLE. I ATTENDED THE PLANNING BOARD MEETING ON JUNE 5TH AND JUST SOME COMMENTS FROM ME. I THINK THE MEETINGS WHEN THERE'S A HOT TOPIC SHOULD BE MOVED TO THE EVENING BECAUSE THERE ARE PEOPLE WHO ARE CONCERNED IN THE COMMUNITY THAT WANTED TO END THE MEETINGS AND CANNOT ATTEND THE MEETINGS. THEY ALSO SHOULD BE RECORDED VIA A VIDEO CONFERENCE BECAUSE SOME OF US AS COMMISSIONERS CAN'T GO AND IT'S IMPORTANT FOR US TO HEAR THE VOICE OF THE COMMUNITY. WE'RE GONNA HAVE TO VOTE ON SOME OF THESE MATTERS. JUNE IS ALSO MEN'S HEALTH MONTH. I DON'T WANT TO DO A PROCLAMATION JUST TO DO A PROCLAMATION BUT WE SHOULD PROMOTE JUNE AS MEN'S HEALTH MONTH AND GET MEN TO BE MORE ACTIVE LOOKING AT SOME OF THESE STATS HERE. ON AVERAGE MEN LIVE FIVE YEARS LESS THAN WOMEN WITH A HIGHER DEATH RATE. THIRTY THOUSAND MEN WILL DIE FROM PROSTATE CANCER AND MORE MEN ARE UNINSURED THAN WOMEN. SO WE NEED TO DO A BETTER JOB OF TAKING CARE OF OUR HEALTH. AS WE ALL KNOW JUNIOR'S CARIBBEAN HERITAGE MONTH. CHIEF SMALLING FROM JAMAICA. MAYOR ROGERS FROM JAMAICA.

MAXINE CALLOWAY FROM JAMAICA. COMMISSIONER BOLTON FROM JAMAICA. WE HAVE WE HAVE IMMIGRANTS EVERYWHERE AND CARIBBEAN AMERICANS EVERYWHERE. I'M HAITIAN AMERICAN. SO LET'S CELEBRATE THAT. IT'S ALSO AN IMMIGRANT HERITAGE MONTH. AND WHEN YOU LOOK AT SOME OF THE MOST SUCCESSFUL COMPANIES IN AMERICA SOME OF THEM LIKE GOOGLE ARE WERE STARTED BY IMMIGRANTS. SO WE DEFINITELY NEED TO CELEBRATE THE DIVERSITY THAT OUR COUNTRY HAS ALL OF US AS COMMISSIONERS AND MOST OF US AS COMMISSIONERS WENT TO THE CHALLENGER ELEMENTARY SCHOOL GRADUATION. IT WAS THE MOST PACKED THEY'VE HAD. THEY HAD TO KEEP BRINGING IN CHAIRS. SO IT'S A GREAT EVENT. GREAT TO SEE SO MANY PROUD PARENTS AND MY SON WILL BE GOING THERE NEXT YEAR.

AND ONE OF OUR EMPLOYEES FROM PLANNING DEVELOPMENT WAS THERE AND HER DAUGHTER GRADUATED. THAT WAS A GOOD MOMENT FOR HER. AND I HAD A MEETING OF MY COMMUNITY TO DISCUSS CRIME. THERE WAS A FEW CARS THAT WERE STOLEN. THERE WAS A LOT OF NOISE BEING MADE ON NEXT DOOR AND OTHER THINGS. SO FIRST I WANT TO THANK ALL THE TAMARACK EMPLOYEES THAT CAME OUT. LAURA LEVANT CHIEF SALES FRIENDS A CAR STOP FOR A TRAFFIC ENGINEER OUR BSA LIEUTENANT STEVE FEELEY. WE ALSO HAD A SERGEANT THAT CAME OUT FORGET HIS NAME RANTS AND THEN THE PUBLIC WORKS BECAUSE WE DON'T HAVE ENOUGH CHAIRS TO FIT A LOT OF PEOPLE AND SO THEY CAME AND BROUGHT SOME CHAIRS. SO IT'S A GOOD MEETING GOOD DISCUSSION. THERE WERE SOME NEGATIVE ATTITUDES BY A COUPLE OF PEOPLE THAT KIND OF CAUGHT ME OFF GUARD BUT I THINK WE HANDLE IT WELL. THESE ARE SOME OF THE ISSUES THAT WERE BROUGHT UP AND SOMETHING THAT THAT. YOU KNOW I GUESS WE HAVE TO WORK ON IN TERMS OF COMMUNICATION IS SOME RESIDENTS DON'T UNDERSTAND THE ROLE OF A NATURE WAY VERSUS THE ROLE OF A CITY COMMISSIONER. AND I WAS TRYING TO HAVE A COMMUNITY UPDATE MEETING FROM THE COMMISSION AND THEY WERE BRINGING UP A LOT OF TOPICS RELATED TO THE H OR WAYNE. ONE OF THEM IS WHY I FELT THE NEED TO HAVE THE MEETINGS BECAUSE YOU KNOW THERE WAS ONE DAY WHERE THERE WAS A BUNCH OF BREAK INS AND SOMEONE STOLE SOME CARS. SO SOME RESIDENTS SAID OH MIKE IS A COMMISSIONER. HE HAS TWO NICE CARS. YOU KNOW HE WOULD BE UNHAPPY IF THEY STOLE HIS CAR. SO NO ONE CONTACTED ME ABOUT I WANT TO BE PROACTIVE AND JUST HAVE THE MEETING. AND BE A CAME OUT. THEY DID A GREAT PRESENTATION AND DEMONSTRATED THAT WE DON'T HAVE REALLY MUCH CRIME IN THE NEIGHBORHOOD. THERE WAS ONE NIGHT. BUNCH OF KIDS WENT OUT THERE STOLE SOME CARS AND 10 OF THE 11 CARS THAT WERE BROKEN INTO THE DOORS WERE UNLOCKED. SO THE MESSAGE THAT THEY'RE ALWAYS TRYING TO SAY IS MAKE SURE YOU LOCK YOUR DOORS. I ATTENDED THE SWEARING IN CEREMONY FOR THE CITY OF NORTH MIAMI COUNCILMAN SCOTT SCOTT GALVIN. I THINK HE'S SERVING SIX TERMS. THE NOON NORTH MIAMI MAYOR PHILLIP BEING A ME STRANGE ABOUT THAT CITY AS THEIR MAYOR ONLY SERVES FOR TWO YEARS. SO I WOULD NOT WANT TO BE A MAYOR WHERE THEY HAVE TO RUN EVERY TWO YEARS AND THEN ALSO OVER THERE. I DON'T KNOW IF OUR CLERK WOULD LIKE TO RUN FOR OFFICE BUT IN NORTH MIAMI THE CLERK IS IN A POSITION YOU HAVE TO RUN FOR. SO THAT'S A LITTLE BIT STRANGE. WE HAD A GREAT MEMORIAL DAY CELEBRATION DURING THAT EVENT. I TOOK THE OPPORTUNITY TO TALK ABOUT THE FACT THAT ONE OF THE FIRST MEMORIAL DAY CEREMONIES WAS CONDUCTED BY JUST FREED SLAVES SHORTLY AFTER 1865. AND THAT WAS DISCOVERED BY A HISTORY PROFESSOR AT YALE UNIVERSITY.

DIGGING THROUGH SOME ARCHIVES AT THE HARVARD UNIVERSITY LIBRARY AND IT WAS THE FIRST ONE THAT ONE OF THE FIRST MEMORIAL DAY CELEBRATIONS IN THE U.S. AND IT WAS BEFORE WAS IT WAS NATIONALLY RECOGNIZED. AND THEN THE UNITED STATES. YOU KNOW WE ACTUALLY HAVE TO INDEPENDENCE DAY. SO WE HAVE FOR THE JULY INDEPENDENCE DAY FOR ALL

[00:35:03]

AMERICANS AND THEN JUNETEENTH WHICH IS ALSO KNOWN AS FREEDOM DAY OR EMANCIPATION DAY WHICH CELEBRATES THE FREEDOM OF SLAVES. AND WHAT'S KEY ABOUT THIS IS THE LAST SLAVES THAT LEARNED ABOUT THEIR FREEDOM WAS IN GALVESTON TEXAS TWO YEARS AFTER ABRAHAM LINCOLN ANNOUNCED THE PROCLAMATION. SO THIS IS THE OFFICIAL ORDER. THE PEOPLE OF TEXAS ARE INFORMED THAT IN ACCORDANCE WITH THE PROCLAMATION AND EXECUTIVE OF UNITED STATES ALL SLAVES ARE FREE. THIS INVOLVES AN ABSOLUTE EQUALITY OF RIGHTS AND RIGHTS OF PROPERTY BETWEEN FORMER MASTERS AND SLAVES. AND THE CONNECTION HERE TO FOUR EXISTING BETWEEN THEM BECOMES THAT BETWEEN EMPLOYER AND FREE LABOR. AND THEY DIDN'T GO QUITE TOO WELL. YOU KNOW IF YOU'RE IF YOU WERE A SLAVE MASTER AND YOU ALSO THEN HAVE TO PAY THIS GUY AND THEY WORK OUT TOO WELL. SO LET'S JUST. THESE ARE JUST SOME OF THE SYMBOLS SOME OF THE LOGOS YOU'LL SEE THAT THE BREAK OF CHAINS FREEDOM FROM FROM SLAVERY. I THINK WE SHOULD CELEBRATE THIS AS MUCH AS WE CELEBRATE THE FOURTH OF JULY. ALL STATES RECOGNIZE JUNETEENTH EXCEPT FOR FOUR STATES HAWAII MONTANA AND NORTH DAKOTA AND SOUTH DAKOTA. AND THE GOAL IS JUST TO BRING ALL AMERICANS TOGETHER. DURING THE MONTH OF MAY NATIONAL SMALL BUSINESS WEEK AND SMALL BUSINESS MONTH I VISITED REJOICE CAFE RESTAURANT.

YOU KNOW IT STARTED BY SOME ARGENTINEANS. GREAT FOOD. WE SHOULD PLAY SOME ORDERS FROM THERE FOR YOU FROM TAMARACK AND THEN ALSO I WENT TO THE TAMARA FARMER'S MARKET AND WHAT SOME SOAP AND OTHER PRODUCTS FROM LOVED BLOSSOMS AND YOU KNOW WHO WOULD BELIEVE THAT SOAP CAN SELL FOR FOUR DOLLARS AND TURN INTO A 240 MILLION DOLLAR BUSINESS. SO SPEAKING OF IMMIGRANT HERITAGE MONTH THE GUY NAME RICHARD STARTED A COMPANY CALLED SHEA MOISTURE. AND THEY WERE SOLD TO UNILEVER WHICH OWNS DOVE PRODUCTS FOR AN UNDISCLOSED AMOUNT OF MONEY. BUT THEY DO EARN. THEY DID EARN 20 40 MILLION DOLLARS A YEAR. SO THEY'VE GOT IN TROUBLE IN 2017 BECAUSE THEY HIRED AN ADVERTISING AGENCY AND THEY PUT AN AD OUT IN SOUTH AFRICA THAT MADE IT APPEAR THAT IF YOU USE DOVE SOAP YOU'LL TURN FROM BLACK TO WHITE. AND SO AFTER THAT THEY ACQUIRED THIS COMPANY. BUT AS YOU CAN SEE SOME PEOPLE ARE WILLING TO SPEND FOUR DOLLARS OR EVEN SIX DOLLARS FOR OF. SO. I WENT TO THE HAITIAN AMERICAN LEADERSHIP ORGANIZATION DINNER GALA IN HONOR OF HERITAGE HAITIAN HERITAGE MONTH. THAT WAS A GREAT EVENT. ALSO MILLENNIUM ACADEMY HERE IN TAMARACK THEY HAVE THE HIGHEST SCORES IN BROWARD COUNTY. I THINK FOR THAT. I FORGET WHAT TEST IT WITH THE FSA.

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

[00:40:03]

AND PUBLICIZE IT AND GIVE THE POLICE OFFICERS CREDIT FOR THE GOOD JOB THAT THEY DO BECAUSE THEY DESERVE TO BE ACKNOWLEDGED WHEN THEY DO A GOOD JOB. AND THANK YOU.

AND. I ALSO FEEL THEY DESERVE TO BE CRITICIZED AND DO A GOOD JOB. AND JUST OWN IT. SO ON IT WHETHER IT'S GOOD AND ON IT WHETHER IT'S BAD. AND THAT CAN BE FOUND ALL OVER SOCIAL MEDIA. AND I DO ALSO HAVE A MAILING LIST THAT GOES OUT AND I THANK YOU FOR YOUR TIME AND FEEL FREE TO REACH OUT TO ALL OF US BECAUSE EVEN THOUGH WE MAY NOT REPRESENT YOUR DISTRICT WE DO HAVE TO VOTE ON ITEMS THAT RELATE TO YOU AND HERE'S OUR CONTACT INFORMATION. THANKS FOR YOUR TIME. THANK YOU COMMISSIONER AGAIN.

[c. Commissioner Fishman]

COMMISSION OFFICIAL. GOOD EVENING. I ATTENDED A RACIAL EQUITY TRAINING FOR MANY OF US SERVE ON A NUMBER OF BOARDS AND I HAPPENED TO SERVE ON THE HUMAN RIGHTS BOARD FOR BROWARD COUNTY AND OUR BOARD WAS WE DID TRAINING WITH THE CHILDREN'S SERVICES COUNCIL ON RACIAL EQUITY AND IT WAS IT'S ALWAYS INTERESTING TO SEE THE LIGHT GO ON FROM PEOPLE THAT DON'T UNDERSTAND EVEN OUR OWN AMERICAN HISTORY AND HOW THE THE HISTORY THAT WE'RE TAUGHT IN SCHOOL IS NOT THE FULL HISTORY AND SOME OF THE THINGS THAT WE TAKE FOR GRANTED TODAY. THERE IS A HISTORY OF RACIAL INEQUITY THAT HAPPENS AND TO BE ABLE TO LEARN FROM HISTORY SO THAT WE DON'T REPEAT THOSE MISTAKES IS A VERY NECESSARY THING. I ALSO ATTENDED THE CHALLENGER ELEMENTARY FIFTH GRADE ADVANCEMENT AND THEN DID ANOTHER RACIAL EQUITY TRAINING WITH THE SOUTH FLORIDA ECONOMIC INCLUSION AND RACIAL EQUITY CONVENING. THIS WAS A COLLABORATION BETWEEN THE URBAN LEAGUE HISPANIC UNITY AND PROSPERITY NOW. I CALLED TOGETHER MEMBERS OF OUR FAITH BASED COMMUNITY AND AN ORGANIZATION CALLED HOPE SOUTH FLORIDA AND HOPE SOUTH FLORIDA HAS PROGRAMS ON THE EAST SIDE OF THE COUNTY FOR HOMELESSNESS AND HOMELESSNESS HAS BEEN MENTIONED SEVERAL TIMES THIS EVENING BY OTHER COMMISSIONERS AND IT'S A PROBLEM THAT A LOT OF PEOPLE DON'T RECOGNIZE THAT WE HAVE HERE ON THE WEST SIDE OF THE COUNTY AND WE NEED TO ENSURE THAT IF THERE ARE PROGRAMS THAT ARE WORKING ELSEWHERE WE DON'T NEED TO RECREATE THE WHEEL WE CAN BRING THEM HERE AND WE CAN HELP THE PEOPLE THAT ARE OUR HOMELESS AND OUR OWN COMMUNITY. I DID ATTEND THE T.J. REDDICK BAR ASSOCIATION INSTALLATION AND CONGRATULATIONS TO YOUR WIFE. COMMISSIONER. SHE LOOKED VERY HAPPY UP THERE. AND I ALSO ATTENDED THE HUMAN RIGHTS BOARD AS I SAID I'M A MEMBER OF THAT. AND ONE OF THE THINGS THAT THE HUMAN RIGHTS BOARD IS WORKING ON IS ALSO THE ISSUE OF HUMAN TRAFFICKING AND WHAT WE'RE TRYING TO DO IS IN THE COUNTY'S ORDINANCES ANYWHERE THAT THERE ARE HOUSING PROTECTIONS IN PLACE FOR VICTIMS OF DOMESTIC VIOLENCE. WE ARE ALSO GOING TO BE INCLUDING VICTIMS OF HUMAN TRAFFICKING BECAUSE IF THEY HAVE TO IF THEY'RE HAVING PROBLEMS WITH MAKING THEIR RENT WE DON'T WANT THEM TO BECOME HOMELESS AND THEN BECOME RE VICTIMIZED. SO THERE'S PROTECTIONS IN PLACE FOR DOMESTIC VIOLENCE SURVIVORS. WE'RE ALSO PUTTING THEM IN PLACE FOR HUMAN TRAFFICKING SURVIVORS. AND THIS IS THIS IS AN ISSUE THAT I'VE BEEN WORKING ON FOR SEVERAL YEARS NOW. I AM THRILLED THAT WE HAVE NO ORDINANCE ON HUMAN TRAFFICKING IN OUR OR THAT WE'LL BE COMING BEFORE THE BOARD. TODAY I AM LOOKING FORWARD TO VOTING ON IT. THANK YOU. THANK YOU COMMISSIONER FISHMAN. FIRST

[d. Vice Mayor Placko]

MAYOR THANK YOU. AS COMMISSIONER BOLTON SAID WE WERE AT BROWARD OUTREACH TODAY AND I HAVE TO TELL YOU THIS FACILITY WAS EXTREMELY IMPRESSIVE IN THAT THEY DON'T JUST SEE SOMEONE HOMELESS ON THE STREET AND FEED THEM AND SEND THEM ON THEIR WAY.

THEY DON'T JUST FEED THEM LET THEM SPEND ONE NIGHT AND SEND THEM ON THEIR WAY. THEY

[00:45:02]

HAVE A FULL PROGRAM. THE FIRST THING I NOTICED WAS THERE WERE TWO BUILDINGS ONE ARE HOUSING THE MEN ONE ARE HOUSING THE WOMEN IN THE WOMEN'S BUILDING THEY HAVE A SEPARATE FLOOR FOR FAMILIES SO WOMEN WHO COME IN WITH THEIR KIDS THEY ARE ON A SEPARATE FLOOR THEIR KIDS ARE WELL PROTECTED AND TAKEN CARE OF. WHAT IMPRESSED ME THE MOST IS THE PROGRAM THAT THEY HAVE IN PLACE. THESE PEOPLE COME IN AND THEY GO THROUGH DIFFERENT LEVELS IN ORDER TO TO GET TO WHERE THEY NEED TO BE AND WHERE THEY NEED TO BE IS WORKING LIVING ON THEIR OWN BEING PRODUCTIVE CITIZENS AGAIN AND THEY GIVE THEM THE RESPECT AND THE DIGNITY TO DO THAT IN THIS ENVIRONMENT. THEY HAVE DOCTORS OF ANY TYPE AVAILABLE TO THEM NO MATTER WHAT THEIR PROBLEMS ARE AS THEY GO THROUGH THE STAGES AND THEY MOVE UP TO THEIR SECOND LEVEL AND THEY DO IN FACT HAVE JOBS. THEY ARE GIVING A PERCENTAGE OF THEIR PAYCHECK TO TWO BROAD OUTREACH BECAUSE THEY NEED TO LEARN THAT THEY HAVE RESPONSIBILITIES AND WHEN THEY GET A PAYCHECK THEY HAVE SO MUCH THAT HAS TO GO FOR THEIR RENT SO MUCH THAT HAS TO GO FOR THEIR UTILITIES AND SO MUCH THAT NEEDS TO GO FOR ESSENTIALS. SO SOME PEOPLE JUST NEVER LEARN THAT. I MEAN I DON'T REMEMBER BEING TAUGHT IN SCHOOL YOU KNOW HOW TO BUDGET AND YOU HAVE TO DO A MORTGAGE AND YOU HAVE TO DO THERE. SO THEY'RE TEACHING THEM THE BASICS THEY'RE MAKING THEM SELF-SUFFICIENT AND THEY'RE DOING IT IN A WAY THAT THEY ARE SO RESPECTED. THESE PEOPLE WERE LOVELY WE MET SO MANY OF THE EMPLOYEES THERE THAT HAVE GONE THROUGH THE PROGRAM AND STAYED TO WORK THERE AND THEY'RE VERY PROUD OF THEMSELVES AND WHAT THEY'VE DONE. THEY WERE ALL ABSOLUTELY AMAZING. THEY EVEN HAVE THE CAFETERIA THE MEN COME IN IN ONE GROUP THEY LEAVE THE WOMEN COME IN AND THE OTHER GROUP. SO WE WERE IN THE CAFETERIA AND THEY GAVE ME THE BEAN SALAD TO SERVE. AND RIGHT NEXT TO ME THEY PUT THE CAKE. I MEAN REALLY. SO EVERYBODY CERTAINLY WAS WAS GOING FOR THAT BUT THEY WERE ALL LOVELY ABSOLUTELY LOVELY. I CANNOT TELL YOU HOW IMPRESSED I WAS WITH THIS ORGANIZATION. IF YOU EVER WANT TO TOUR THEY WILL BE MORE THAN HAPPY IF YOU CAN DONATE. PLEASE DO. IT'S VERY VERY MUCH WORTHWHILE. I WAS AT TAMARACK ELEMENTARY FOR THEIR GRADUATION. I'VE BEEN THERE FOR THE PAST FIVE YEARS FOR THEIR GRADUATIONS AND THE ONE THING I NOTICED THIS YEAR AS THE YOUNG LADIES AND YOUNG GENTLEMEN WERE WALKING PAST ME. THEY ALL WERE LOOKING AT ME DIRECTLY IN THE EYE AND THEY SAID GOOD MORNING MA'AM. EVERY SINGLE ONE OF THEM. THEY WERE VERY POISED FOR THEIR AGE AND EVERY YEAR THEY GET A LITTLE BIT BETTER. SO I CONGRATULATE THEM I CONGRATULATE THEIR PARENTS. THEY'VE DONE A GREAT JOB AND THE TEACHERS WHO HAVE REALLY REALLY DONE A TERRIFIC JOB OVER THERE. WE ALSO HAD THE DISTRICT FOR. TOWN HALL MEETING AND I'D LIKE TO THANK EVERYONE WHO ATTENDED. I'D LIKE TO THANK EVERYONE WHO HAS WRITTEN ME AND CALLED ME. I AM STILL GETTING BACK TO SOME OF YOU ON ISSUES THAT IT'S NOT QUITE AS EASY AS A YES OR NO ANSWER BUT I DO RESPOND TO EACH AND EVERY ONE IF YOU WANT TO CALL ME IF YOU WANT TO E-MAIL ME WHATEVER IS BEST BUT I PROMISE YOU THAT WE WILL GET YOU ANSWERS TO ALL YOUR QUESTIONS. I THINK I'M DOWN TO TWO TO ONE ANSWERS THAT WE'RE WORKING ON THAT ON JUNE 18TH AT UNIVERSITY HOSPITAL FROM 430 TO 7. THEY WILL HAVE A DEMONSTRATION OF THEIR NEW ROBOTIC SURGERY. THIS IS SOMETHING NEW THERE. THEY WILL HAVE THE ROBOT ON SITE AND YOU CAN ACTUALLY GO IN AND PLAY WITH IT AND ATTEMPT SURGERY NOT ON A REAL PERSON OF COURSE BUT IF YOU GET A CHANCE TO GO OVER THERE FROM 430 TO SEVEN O'CLOCK AND SEE UNIVERSITY HOSPITAL REALLY HAS COME A LONG WAY. SO I ENCOURAGE EVERYONE TO ATTEND. AND LASTLY I'D LIKE TO WISH EVERYONE CELEBRATING FATHER'S DAY A VERY VERY HAPPY FATHER'S DAY. YOU ALL MAKE SUCH A DIFFERENCE IN THE WORLD. SO THANK YOU AND HAVE A WONDERFUL DAY. THANK YOU.

COMMISSIONER BOLTON YOU HAVE SOMETHING YOU LIKE TO SAY BUT FROM MY REPORT YES MADAM MAYOR THANK YOU SO VERY MUCH FOR THIS TIME OF PERSONAL PRIVILEGE. I DID NOT WISH COMMISSIONER GALEN A HAPPY BIRTHDAY. IT IS HIS BIRTHDAY. AND. WOULD YOU LIKE TO START THE SONG. SO TOMORROW IS IF YOU LIKE TO START THE SONG. HAPPY BIRTHDAY TO YOU EVERYBODY. HAPPY BIRTHDAY TO YOU HAPPY BIRTHDAY TO YOU. THANK YOU. THANK YOU. I'M

[00:50:10]

NOT SURE THAT THE CITY ATTORNEY WAS SINGING MADAM MAYOR. I WAS DOING. I WAS QUIET LISTENING IS AN EXTRA PRAISES. HOW OLD ARE YOU. FORTY FIVE YEARS. YOUNG TOMORROW. EXCELLENT. THEN I'LL ENJOY IT VERY MUCH. I WILL TAKE MY REPORT NOW AND

[e. Mayor Gomez]

NORMALLY I HAVEN'T GIVEN AN UPDATE. BUT TODAY IT'S FAIRLY OBVIOUS THAT I AM A LITTLE BIT NASAL MAYBE A LITTLE BIT COUGHING. PLEASE KNOW THAT AFTER 14 ROUNDS OF CHEMO I AM DOING FINE. THESE ARE SIDE EFFECTS IT BUILDS UP UNFORTUNATELY. SO FORGIVE ME BUT I AM OK. TOMORROW I'LL GO FOR MY 15TH ROUND AND THEN NEXT WEEK I'LL HAVE MY LAST ROUND BEFORE RADIATION. SO. PLEASE FORGIVE THIS. THANK YOU. I APOLOGIZE FOR BEING DRIPPING IN COFFEE AND UGLY. BUT ANYWAY I DO WANT TO THANK OUR CITY STAFF FOR THE DISTRICT 1 DISTRICT FOR MEETING AND ALSO FOR A WONDERFUL MEMORIAL DAY. AS ALWAYS IT IS BEAUTIFUL. THE EXTRA LARGE TENT WAS. PERFECT. THIS YEAR WE GOT TO HAVE EVERYBODY UNDERNEATH IT. PEOPLE WERE UNDER A BREEZE. WE DIDN'T HAVE PEOPLE HANGING OUT SO THANK YOU FOR TAKING CARE OF THAT WHICH PEOPLE HAD SOME ISSUES WITH IN THE PAST AND NOW KNOWING THAT WE'RE FILLING IT UP WE MIGHT NEED ANOTHER TENT JUST A LITTLE HEADS UP THERE BUT THANK YOU VERY MUCH. IT'S ALSO A TIME FOR GRADUATIONS OR TRANSITIONS AS SOME OF THE SCHOOLS PUT IT. WE OR CONTRACT GRADUATION IS DEPENDING ON THE SCHOOL YEAR AT THIS POINT. BUT I HAD THE PRIVILEGE OF GOING TO BETHLEHEM 5TH KINDERGARTEN TRANSITION PIPER HIGH SCHOOL AND TARA VELLA HIGH SCHOOL'S GRADUATIONS CHALLENGER ELEMENTARY MOVING UP CEREMONY AND BEING THE KEYNOTE SPEAKER AT RENAISSANCE CHARTER SCHOOLS TRANSITION CEREMONY FOR THEIR EIGHTH GRADERS. IT IS ABSOLUTELY BEAUTIFUL AND WONDERFUL TO SEE CHILDREN OF ALL AGES.

AGAIN WE HAVE OUR KAYLA HERE AS WELL AND JUST SEEING HOW WONDERFUL OUR BRIGHT MINDS ARE AND WHERE THEY'RE GOING AND PUTTING THEIR FOCUS AND DEDICATION TO FORWARD EVER THEY'RE PUTTING THEIR MINDS TO IT. AND AS ALWAYS THANK YOU TO THE TEACHERS AND THE ADMINISTRATORS OF OUR SCHOOLS WHO WORK SO HARD TO HELP OUR CHILDREN GET WHERE THEY NEED TO BE ALONG WITH THEIR PARENTS BECAUSE WE KNOW THAT DEALING WITH HORMONES AND CURIOSITY AND TELEVISION AND THESE THINGS KIND OF ARE VERY HARD TO COMBAT WITH. BUT YOU'RE DOING EXCELLENT JOBS AND THANK YOU VERY MUCH. HAD THE PRIVILEGE OF GOING TO AL-AZHAR SCHOOL TO PRESENT THE MUSLIM AMERICAN HERITAGE MONTH OR AS I THINK SEVERAL OF OUR PLOYS FOR JOINING ME. AND IT WAS A VERY NICE CEREMONY THERE ATTENDED THE MPO TRANSITION TRANSPORTATION ROUNDTABLE COMMITTEE MEETING WHERE HOPEFULLY IN THE NEXT MONTH OR SO I'LL HAVE SOME MORE INFORMATION TO BRING BACK TO YOU HAD A VERY PRODUCTIVE MEETING WITH THE SUPERVISOR OF ELECTION AND HIS TEAM.

AND I WANT TO THANK ASSISTANT CITY MANAGER KATHLEEN GUN AND CITY CLERK PAT TOO FULL FOR JOINING ME AND ASKING HIM QUESTIONS AND THEN THE TEAM QUESTIONS TO MAKE SURE THAT OUR ELECTIONS WILL BE RUN SMOOTHLY HERE AT OUR LIBRARY IN 2020 AND HELP A SQUASH. THAT'S THE RIGHT WORD. SOME OF OUR RESIDENTS CONCERNS OF ISSUES THAT HAVE HAPPENED IN THE PAST. I APPRECIATE JOINING COMMISSIONER FISHMAN ALL HER HOPES SOUTH FLORIDA BREAKFAST WITH OUR CHURCHES AND TEMPLES THAT JOINED US FOR THAT MEETING WAS VERY INFORMATIVE. THANK YOU TO OUR CITY STAFF AS WELL FOR THE VOISIN COMMITTEE LUNCHEON IT WAS A BEAUTIFUL LUNCHEON AND I BELIEVE OUR BOARD AND COMMITTEE MEMBERS APPRECIATED IT TOO. I DO KNOW THAT I THINK WE OWE LUNCH TO OUR PLANNING BOARD WHO UNFORTUNATE WAS NOT ABLE TO ATTEND THAT DAY DUE TO THEM BEING OF SERVICE TO US AND WITHOUT OUR BOARDS AND COMMITTEES WE WOULD NOT BE ABLE TO DO MUCH OF WHAT WE DO IN OUR CITY AND IT IS VERY IMPORTANT TO HAVE THEIR INPUT. SO WE APPRECIATE THEM VERY MUCH. ATTENDED THE CHAMBER OF COMMERCE BREAKFAST WHERE THIS YEAR WE WERE THIS LAST BREAKFAST WE SAID THANK YOU AND CONGRATULATED OUR FIREFIGHTERS OF THE YEAR FOR NORTH LAUDERDALE. IT WAS HILLARY CAN WISH OUR FIREFIGHTER PARAMEDIC AND OF COURSE OUR OWN VERY OWN WILLIAM O HERO FIREFIGHTER PARAMEDIC FOR HIS SERVICE AND WE GREATLY APPRECIATE HIM AND ALL MEMBERS OF OUR FIREFIGHTER TIME OUR RESCUE HAS ALREADY BEEN SAID. I WILL WISH IT AS WELL TO EVERYBODY CELEBRATING FATHERS MOTHERS WHO ARE DOING DUTIES AS FATHERS AS WELL.

ANYBODY WHO'S A MALE ROLE MODEL ANYBODY WHO'S JUST GIVES THAT OPEN ARM AND THAT HUG THAT IS DESPERATELY NEEDED TO A CHILD OR ANYBODY WHO JUST NEEDS THAT. THANK YOU VERY MUCH. NOW WE WILL TURN TO OUR CITY ATTORNEY REPORT THANK YOU VERY

COMMISSION. GOOD EVENING AND HAPPY BIRTHDAY AGAIN COMMISSIONER. ENJOY THE MOMENT HEALTHY HAPPY RETURNS OF THE DAY ON MONDAYS WORKSHOP. THE QUESTION WAS ASKED WITH REGARD TO THE CHARITABLE CONTRIBUTIONS LET ME CLARIFY IF I CAN SUPPLEMENT THE CONVERSATION WHICH WILL HELP COMMISSIONER BOLTON IN THE CONTEXT OF HIS DISCUSSION ABOUT BOYD ANDERSON. AGAIN I DID PULL THE COUNTY ETHICS CODE. IT'S AT SECTION 1 DASH 19 SUBSECTION 5 A. AND THAT LANGUAGE WHICH I CITED IS THE LANGUAGE WHICH IS OPERATIVE HERE. ESSENTIALLY WHAT IT SAYS IS IS THAT IF YOU AS A PUBLIC OFFICIAL IS AN ELECTED LOCAL OFFICIAL SUPPORT A NON-PROFIT CHARITABLE ORGANIZATION AS DEFINED BY AN INTERNAL REVENUE CODE AND YOU SOLICIT FUNDS FOR THEM AND YOU BEAT THE DRUM FOR THEM TO ASSIST THEM IN THEIR CHARITABLE EVENTS YOU MUST UNDER THE CODE FILE A DISCLOSURE FORM WHICH WE DISCUSSED ON MONDAY AS WELL TO PROMOTE THE FULL AND COMPLETE TRANSPARENCY OF ANY SUCH SOLICITATION AN ELECTED OFFICIAL SHALL DISCLOSE ON A FORM CREATED BY THE OFFICE OF THE COUNTY ATTORNEY THE NAME OF A CHARITABLE ORGANIZATION THE EVENT FOR WHICH THE FUNDS WERE SOLICITED AND THE NAME OF ANY INDIVIDUAL OR ENTITY THAT REQUESTED THAT THE ELECTED OFFICIAL ENGAGE IN THE CHARITABLE FUNDRAISING SOLICIT SOLICITATION. SO THE THE BASIC REQUIREMENT IS IF THE ENTITY IS A 5 TO ONE C OR COULD BE A VIABLE ONE C THREE C 4C FIVE UNDER THE INTERNAL REVENUE CODE AND YOU'RE YOU'RE ASSISTING THEM YOU'RE SUPPORTING THEM YOU'RE PROMOTING THEM YOU HAVE TO FOLLOW DISCLOSURE. THE CITY HAS TAKEN THAT WE'VE TAKEN THE LEGAL POSITION THE CITY HAS A LIST AS YOU KNOW OF ENTITIES THAT YOU SUPPORT. IF THE CITY CO-SPONSORS OR CO SUPPORTS AN ORGANIZATION WE'VE OPINED IN FORMAL OPINIONS TO MEMBERS OF THE COMMISSION THAT YOU NEED NOT FILE A SEPARATE DISCLOSURE FORM IF YOU SUPPORT THE X Y Z ORGANIZATION GUILDS CLUB UNITED WAY. CALL IT WHAT YOU WILL. WHICH ARE 5 OR 1 C THREES RAISE THE LEVEL THAT WAS ASKED FOR BY COMMISSIONER BOLTON IS MORE. HE DISCUSSED THE ISSUE OF SCHOOL BOARD ANDERSON AS A SCHOOL WITHIN A SCHOOL DISTRICT. IT IS NOT. IT IS NOT AN INDEPENDENT CHARITABLE ORGANIZATION RECOGNIZED OR EMBRACED BY THIS BY THE COUNTY'S ETHICS FEEL THAT YOU MUST FOLLOW. THE QUESTION IS WHETHER OR NOT THE ANY COMMISSIONER ANY QUESTIONS ANY ANY COMMISSION CAN GIVE THEIR FUNDS INDIVIDUALLY TO ANY CHARITY OF THEIR CHOICE WHETHER IT BE A FAVOR ONE C 3 WHICH ALLOWS FOR TAX DEDUCTIONS OR IT'S JUST A SIMPLE NONPROFIT. THERE CAN BE NOT EVERY CORPORATION NOT EVERY NON-PROFITS IF I HAVE A 1 C OK THEY MAY NOT NEED TO QUALIFY FOR FEDERAL TAX TREATMENT FEDERAL TAX EXEMPTION BUT THEY MAY WELL BE A LEGALLY CREATED NONPROFIT. THE PROBLEM IS IS THAT BOYD ANDERSON HIGH SCHOOL AS WE'VE RESEARCHED IT IS NOT AN ENTITY FOR WHICH THE COMMISSION COULD SUPPORT THAT IN THE CONTEXT OF A CONTRIBUTION. HOWEVER AS I MENTIONED ON MONDAY WE WILL DO A LITTLE HOMEWORK. SOMETIMES THE PTA AND THE PTA O'S DO INDEPENDENTLY FORM FAVOR ONE SEES WHETHER IT'S A C4 OR C5. MARK MASON CAN BETTER ANSWER WHICH IS WHICH IS MORE APPLICABLE IN THE CONTEXT OF THE IRS CODE BUT WE HAVE LEARNED THAT SOME PTO IS IN ACCOUNTING WHETHER IT BE FOR A MIDDLE SCHOOLS OR ELEMENTARY SCHOOLS MAY HAVE FORMED ONE. IF THAT'S THE CASE THEN YOU COULD LEGITIMATELY SUPPORT THAT AS A CITY COMMISSION AND YOU COULD CERTAINLY PROVIDE THE EXEMPTION THAT WE DISCUSSED EARLIER ABOUT NOT HAVING TO FILE A FORM. BUT THE PROBLEM IS IS THAT THE SCHOOL ITSELF IS NOT IN THAT CAPACITY AND WE'VE NOT RESEARCH AND CAN I GET THE INFORMATION READILY AVAILABLE AS TO WHETHER OR NOT THERE A THERE'S IN FACT A PTO OR A PTA WHICH LEGALLY QUALIFIES UNDER ANY CIRCUMSTANCE. IF THERE IS SUCH AN ENTITY AND THE COMMISSIONER WOULD CHOOSE TO DO TO ASK FOR THE COMMISSION'S ADDITION OF A LEGALLY QUALIFIED CHARITY TO THE LIST WE CAN ASSIST IN GETTING THAT DONE. WE JUST DON'T HAVE THAT INFORMATION AVAILABLE BUT WE DO KNOW AS OF TODAY THAT THERE ARE SOME SCHOOLS WITHIN BROWARD COUNTY IT COULD BE IN CITY TAMARACK THAT ACTUALLY HAVE INDEPENDENTLY THROUGH THEIR PTO OR PTA FORUM A NONPROFIT. IF IT'S A NONPROFIT AND NOT A 5 0 1 C 3 I BELIEVE THAT THE COMMISSION COULD ENDORSE THEM. IF IT'S A FIVE OR ONE C THREE YOU CERTAINLY CAN ENDORSE THEM. THE ISSUE IS THAT IF THE COMMISSION TAKES IT UPON ITSELF TO ADD IT TO YOUR MASTER LIST THEN THE COMMISSION ITSELF DOES NOT HAVE TO INDEPENDENTLY DISCLOSE BY THE FORM THE CONTRIBUTION OR THE ASSISTANCE. SO WE HAVE A LITTLE MORE INFORMATION THAN WE DID ON MONDAY. BUT THE GOOD NEWS IS IS THAT NOTHING SAYS YOU COULDN'T DO IT BUT WE HAVE NOT FOUND WHETHER OR NOT BOYD ANDERSON HAS AN ACTUAL ORGANIZATION WE'RE TRYING TO GET THAT INFORMATION AS SOON AS WE POSSIBLY CAN. AND IF YOU CAN HELP US COMMISSIONER WE WOULD WELCOME THAT AS WELL. WE'VE COME TO LEARN THAT THERE ARE SEVERAL SCHOOLS THAT DO HAVE INCORPORATED PTO THAT ACTUALLY DO THIS AS A MATTER OF COURSE. SO COMMISSIONER BOLTON IF YOU WOULD WHEN YOU CAN CAN YOU FIND OUT IF THERE IS A PTO OR ANY ORGANIZATION THAT WE CAN ACTUALLY BE ABLE TO DO THIS FOR THE SCHOOL PLEASE. I'M HAPPY TO BE HAPPY TO DO THAT MADAM MAYOR. I DO HAVE A QUESTION FOR THE CITY ATTORNEY IF I MAY. SO YOU'RE SAYING THAT THERE'S NOTHING THAT PREVENTS US FROM SUPPORTING BOARD ANDERSON AS A SCHOOL. ARE YOU SAYING THAT THERE ARE PRESUMPTIONS. THE PROBLEM

[01:00:04]

IS THAT THE SCHOOL IS NOT A CHARITABLE ORGANIZATION AS DEFINED BY THE ETHICS CODE. SO. SO YOU'RE SAYING WE CANNOT. OH YEAH. YOU CANNOT. I MEAN YOU CAN GIVE A CHECK TO BOYD ANDERSON HOW HOW IT GETS DISTRIBUTED OR HOW IT GETS APPLIED. I CAN'T KNOW THE ANSWER NOR CAN YOU BY THE WAY BUT. BUT IF THERE IS AN ENTITY THAT IS A FUNDING ARM OF BOYD ANDERSON I'D LIKE TO HELP YOU TO GET TO THAT LOCATION. OK. SO SO WHAT WHAT I'M TRYING TO ACHIEVE IS NOT TO TAKE THE CITY'S DOLLARS AND GIVE IT TO BOYD AND ASSIST. WHAT I'M TRYING TO ACHIEVE IS TO RAISE FUNDS AS EVERYBODY KNOWS THAT I'M A VERY GOOD FUNDRAISER. I'D LIKE TO FUNDRAISE FOR BOYD ANDERSON. SO HOW DO I DO THAT INDIVIDUALLY YOU CAN FUNDRAISE FOR BOYD ANDERSON. AGAIN THE CHALLENGE UNDER THE THE ETHICS CODE IS THAT IT REQUIRES YOU AS A ELECTED OFFICIAL IF YOU'RE FUNDRAISING FOR A CHARITY. IT'S DEFINED UNDER THE CODE AS I'VE READ BEFORE TO DISCLOSE THAT YOU'RE DOING SO. I MEAN IF YOU CHOOSE TO RAISE MONEY FOR BOY ANDERSON AND ASSUME FOR DISCUSSION THAT IT'S IT'S A NONPROFIT. THAT'S UP TO YOU AND TO THE EXTENT THAT YOU WOULD CHOOSE TO FILE THE FORM TO SUPPORT THEM YOU CAN DO THAT YOU CAN DO THAT. SO AS IT IS TODAY I CAN RAISE FUNDS FOR BOYD ANDERSON HIGH SCHOOL AND FILL OUT THE FORM I BELIEVE YOU COULD. BUT I WILL RAISE ONE CAVEAT FOR YOU I DON'T KNOW THAT BOYD ANDERSON IS A LEGAL ENTITY UNDER WHICH IT'S NOT A LEGAL ENTITY DEFINED BY THE ETHICS CODE. THAT'S A FACT. SO BOYD ANDERSON IS NOT IN AND OF ITSELF A LEGALLY QUALIFIED CHARITY. IT IS A SCHOOL WITHIN A SCHOOL DISTRICT OF WHICH THERE ARE 67 COUNTIES WITH 67 SCHOOL DISTRICTS AND SCHOOLS THEMSELVES ARE NOT AS DEFINED BY THE ETHICS CODE. CAN YOU RAISE MONEY FOR THEM. YES YOU CAN IF YOU CHOOSE TO FILE A FORM. YES YOU CAN. AND DO WE GET IN TROUBLE FOR RAISING MONEY FOR THEM. SOMEONE FILES A COMPLAINT AGAINST YOU THAT ANYONE CAN IS FREE TO DO THAT.

THIS DOESN'T COST ANY MONEY TO FILE A COMPLAINT THE ANSWER IS IS THAT UNDER THE STRICTURES OF THE CODE AS I READ IT WE NEED TO DETERMINE WHETHER OR NOT BOYD ANDERSON IS IN FACT A NONPROFIT THAT'S QUALIFIED UNDER THE IRS CODE. I DON'T THINK THAT IT IS BECAUSE IT'S A SCHOOL. IT DOESN'T HAVE THAT LEGAL TEXTURE. BUT WHAT I HAVE SAID IS THAT MANY INSTANCES THERE ARE PTO AND B THE A'S THAT DO RAISE MONEY FOR THEIR SCHOOLS THAT ARE QUALIFIED I'M JUST NOT GETTING WHAT I WANT TO HEAR. I REGRET THAT. I'LL TRY TO. I'LL TRY AGAIN. TRY TRY. I'LL BE HAPPY TO TRY AGAIN. CAN I CAN I NOT RAISE MONEY FOR BOYD ANDERSON HIGH SCHOOL CAN I'M SORRY SAY AGAIN SIR CAN I OR CAN I NOT RAISE MONEY FOR BOYD ANDERSON HIGH SCHOOL. YOU CAN BUT THE RISKS THAT I'M TELLING YOU IS IS THAT I DON'T KNOW WHAT THE ENTITY IS. THAT'S THE PROBLEM BECAUSE THERE'S NO SUCH ENTITIES BOYD AND IT'S A SCHOOL IT'S NOT IT'S NOT A CORPORATE ENTITY IT'S NOT A NON-PROFIT ENTITY IT'S A SCHOOL CAN I RAISE MONEY FOR BROWARD COUNTY SCHOOL BOARD. INTERESTING QUESTION. IT'S THE THE THE THE BROKEN SCHOOL BUT DOES NOT IT'S NOT A NON-PROFIT ENTITY EITHER IT'S A SCHOOL DISTRICT UNDER FLORIDA LAW THE CITY COMMISSION IS A IS A MUNICIPAL CORPORATION UNDER FLORIDA LAW ALSO NOT A NON-PROFIT. HERE YOU GO COMMISSIONER BOLTON YOU HAVE YOUR QUESTIONS ANSWERED AS BEST AS I CAN ANSWER FOR THIS EVENING. I ASKED MY QUESTION.

THANK YOU MADAM MAYOR IF I CAME TO THE COMMISSIONER IF YOU'D LIKE FOR US TO DO A SAFE HARBOR OPINION FOR YOU WE'D BE HAPPY TO RESEARCH THE QUESTION WE CAN REFINE THAT QUESTION FOR YOU AND HELP YOU TO GET TO THAT ANSWER AND WE'D BE HAPPY TO DO IT. ABSOLUTELY. DON'T YOU DON'T KNOW THAT I WILL. I'LL WORK WITH YOU ON THE QUITE ON THE REQUEST. AND DO I NEED. CAN I. CAN I ASK YOU PERSONALLY OR DO I NEED TO HAVE THE COMMISSION DIRECT TO YOU. NO. YOU CAN ASK PERSONALLY IT RELATES TO YOU AS A MUNICIPAL OFFICIAL. OK. THANK YOU. I HAVE NO OTHER REPORT BUT THANK YOU FOR LISTENING. THANK YOU VERY MUCH. CITY MANAGERS REPORT. THANK YOU MR. MAYOR AND

[5. PUBLIC PARTICIPATION]

ONLY HAVE ONE PERSON SIGNED UP. SO IF THERE'S ANYONE WHO HAS ANYONE ELSE WHO WISHES TO SPEAK AN ITEM THAT IS NOT ON THE AGENDA YOU CAN SAY SO. AFTER MR. JEFFREY SHAPIRO COMES IN. GOOD EVENING TO ALL JEFFREY SHAPIRO 61 0 4 OR TERRY LANE TAMARACK FLORIDA IN THE WOODLANDS. LAST WEEK I ATTENDED AND TESTIFIED THAT THE PLANNING AND REZONING BOARD MEETING 13TH FLOOR HAD A NEW REPRESENTATIVE FOR THEIR DRAINAGE MEETING PRIOR TO THAT THEY HAD SOMEBODY ELSE. AND SO HIS EXPERT TESTIMONY WAS THAT THEY'RE GOING TO TAKE CERTAIN AREAS OF THE CANAL WHICH AFFECTS RIGHT BEHIND MY HOUSE ON ORCHARD TREE LANE FACES A GOLF COURSE IN NORTH WEST 44TH STREET AND THEY ARE GOING TO GO AHEAD AND MAKE THEIR NEW PROPOSED DRAWING MAKE IT NOW OR MY HOUSE EVEN THOUGH IT'S ON A WATERWAY DOES NOT HAVE THE ADVANTAGE OF A SEAWALL.

THE COMMUNITY WAS NEVER BUILT 50 YEARS AGO ON MY STREET FOR THIS WATERWAY WITH A SEAWALL AND WHAT IT HAS IS WHEN IT WAS ORIGINALLY BUILT. THAT'S THE UNDERPINNING OF THE OF THE LAND WITH THE GRASS GOING TOWARDS THE WATER. I'VE HAD TWO SURVEYS DONE ON MY HOME AND ORIGINALLY WHEN I PURCHASED IT AND THEN ANOTHER ONE THREE YEARS LATER BECAUSE I UPDATED MY SURVEY BECAUSE I HAD DONE HOME RENOVATIONS AND ADDITIONS SO I WANTED THE SURVEY TO REFLECT THAT. SO IN 2001 I DID ANOTHER SURVEY AND I PAID FOR IT MYSELF. AND SO WHAT I'M TRYING TO GET ACROSS IS IS THAT THE UNDERPINNING FOR THE GRASSY AREA AND I HAVE 100 FEET IN LENGTH OF GRASS PROPERTY THAT'S NOW IN THE WATER. IT HAS BEEN IN THE WATER AND IT'S ERODED. IT'S ERODED AWAY. TWO THOUSAND AND ONE AND ONE OF THE PENS THEY ACTUALLY HAD TO GET IN THE WATER AND PUT IT IN A PEN JUST FROM MY SURVEY MARKER. SO THE UNDERPINNINGS GONE AND MY PAPA MY SUGGESTION IS TO GET THE CITY HOLD ACCOUNTABLE. 13TH FLOOR IF EVERYTHING IS TO GO THROUGH WHICH WERE A YEAR TWO YEARS OFF FROM THAT I'M OK THAT THEY BE HELD ACCOUNTABLE TO ME SURVEY EVERYBODY'S HOME ON MY STREET THAT HAS THE WATER AND GOLF VIEW CURRENTLY AND RESTORE THE LAND BECAUSE I HAVE IN THE WATERWAY RIGHT NOW OVER 450 FEET OF MY LAND BY THEM NARROWING THE CANAL AND THEIR EXPERT WITNESS HAS TESTIFIED THAT IF THEY NEED TO THEY'LL DREDGE IT EVEN DEEPER TO GET TO THE WATER

[01:10:04]

LEVELS TO ACCOMMODATE BROWARD COUNTY FOR DRAINAGE BUT IF THEY DO EVEN DREDGE MY BACK MY BACK YARD IS GOING TO FALL IN BECAUSE THERE'S NO UNDERPINNING THERE AND 13TH FLOOR WOULD HAVE TO BE LIABLE PRIOR TO DOING ALL THAT TO RESTORE THE PROPERTIES TO WHERE THEY WERE SUPPOSED TO BE AND THEN WORK ON THE WATERWAY FROM THAT POINT FORWARD. THAT'S THE POINT I WANTED TO MAKE. THANK YOU ALL FOR YOUR TIME.

THANK YOU VERY MUCH. IS THERE ANYBODY ELSE WHO WISHES TO SPEAK AT THIS TIME ON ANY MATTER THAT'S NOT ON THE AGENDA. SEEING AS THERE IS NONE WE'RE GOING TO MOVE OVER TO

[6. CONSENT AGENDA]

APPOINTING ONE MEMBER TO THE PUBLIC ART COMMITTEE MOTION TO MOVE THE ITEM TO THE FLOOR FOR DISCUSSION IN A SECOND SECOND. REED MR. MAYOR MAYOR THERE. THANK YOU. TR 1 3 2 EIGHTY FOUR IS A RESOLUTION ON THE CITY COMMISSION OF THE CITY TAMARA I FLORIDA APPOINTING ONE MEMBER TO THE PUBLIC ART COMMITTEE TO SERVE A TERM CONCURRENT WITH THE APPOINTING COMMISSION MEMBER OR UNTIL SUCH TIME AS NEW APPOINTMENTS WERE MADE PROVIDING FOR A COMPLEX SEVERABILITY AND FOR AN EFFECTIVE DATE. THANK YOU. I SEE COMMISSIONER BOLTON'S LIGHT IS LIT. COMMISSIONER BOLTON YOU'RE RECOGNIZED. THANK YOU MR. MAYOR. I DON'T HAVE ANY PROBLEM WITH THE APPOINTMENT TONIGHT. HOWEVER THE LAST TIME OF THOSE MAKING APPOINTMENTS TO BOARDS I WAS GIVEN HELP. I WAS GIVEN HELP BECAUSE I WAS APPOINTING COMMISSIONER GUILLEN. YOU DID NOT WANT COMMISSIONER GUILLEN TO BE APPOINTED TO THE BOARD FOR YOUR PERSONAL REASONS. HERE'S WHAT HAPPENED AT THAT LAST MEETING WE GOT RESUME HE'S ON OUR DESK AND WE WENT THROUGH THEM THOROUGHLY. WE ALSO GOT RESUMES IN OUR OFFICE AND WE WENT THROUGH THEM THOROUGHLY. THIS TIME. WE DID NOT GET RESUMES IN OUR OFFICE. WE DON'T HAVE RESUMES ON BEFORE US TODAY. AND SO I'D LIKE TO FIND OUT WHAT IS DIFFERENT.

THEN VERSUS NOW WHO IS THIS QUESTION DIRECTED TO CITY ATTORNEYS FOR THE CLERK.

ABOUT THE CITY CLERK TO THE CLERK I DON'T HAVE AN ANSWER COMMISSION I'M HAPPY TO DEFER TO THE CLERK FOR YOUR BENEFIT. I BELIEVE COMMISSIONER FLACCO MADE HER PICKS OFF OF THE INITIAL BATCH OF APPLICATIONS THAT WERE SUBMITTED LAST TIME I WAS MAKING MY APPOINTMENTS I MADE MY APPOINTMENTS DIRECTLY UP MY FIRST PICK I WAS I HAD TO BRING RESUME MEANS TO BRING THEIR FORMS PEOPLE LOOKED AT THEM THEIR RESUMES WERE SCRUTINIZED. WE MATCH THEM AGAINST THE QUALIFICATIONS AND THAT IS NOT BEING DONE TONIGHT. I CAN'T SPEAK TO WHY OR HOW COMMISSIONER FLACCO MADE HER APPOINTMENTS. I CAN SPEAK TO HOW I MADE MY APPOINTMENTS I MADE MY APPOINTMENTS THE SAME WAY THAT COMMISSIONER BLACKWELL VICE MAYOR FLACCO WAS MAKING HER APPOINTMENTS TONIGHT HOWEVER WHAT IS DIFFERENT FROM FROM FROM WHAT IS BEING DONE TONIGHT IS THAT I WAS PUT THROUGH HELL TO HAVE ALL THE RESUMES ON THE DESK EVERYBODY LOOKED AT EACH PERSON'S RESUMING AND THEN EACH PERSON HAD TO SAY I LIKE THIS ONE I DON'T LIKE THIS ONE AND THEN THE APPOINTMENT WAS MADE THAT WAS NOT. THAT IS NOT BEING DONE TONIGHT. SO THERE IS SOME INCONSISTENCIES IN HOW WE WE WE MAKE APPOINTMENTS AND WE NEED TO LOOK AT THAT IN THE FUTURE. THAT'S IT. THANK YOU COMMISSIONER BOLTON FOR YOUR OPINION. VICE MAYOR THANK YOU. I DID IN FACT WORK OFF

[01:20:03]

ALL OF THE INITIAL APPLICATIONS. I DELAYED APPOINTING ANYONE BECAUSE WE WERE TALKING ABOUT REVIEWING BOARDS. SO I WAITED UNTIL THAT WORKSHOP DID TAKE PLACE. AS FAR AS MY APPOINTMENT TO THE ART COMMITTEE IT IS A REAPPOINTMENT OF THE CURRENT CHAIR AND AS FAR AS MY APPOINTMENT TO PARKS AND REC IT IS THE CURRENT MEMBER ON PARKS AND REC SO I WILL BE MORE THAN HAPPY TO PROVIDE ANYONE WITH THEIR PAPERWORK THAT NEEDS TO SEE IT. COMMISSIONER BOLTON THIS IS YOUR SECOND TIME. YES. I WANT TO MAKE IT CLEAR THAT I DON'T HAVE A PROBLEM WITH VICE MAYORS APPOINTMENT. I BELIEVE THAT HER APPOINTMENTS ARE QUALIFIED. I THINK THAT SHE WAS VERY THOUGHTFUL IN WHO SHE'S APPOINTING. MY ISSUE IS WITH OUR PROCESS AND HOW WE DO THINGS. WE WE TEND TO BE SELECTIVE IN HOW WE DO THINGS AND WE NEED TO HAVE A PROCESS. WE NEED TO HAVE. A STRAIGHT SHOT IN HOW WE DO THINGS AND THAT'S ALL I'M SAYING. LAST TIME WE WERE THERE I WAS TOLD THAT YOU NEED TO HAVE THE THE THE THE RESUMES YOU NEED TO HAVE THIS YOU NEED TO HAVE THAT THE COMMISSIONERS NEED TO LOOK AT IT. EVERYBODY NEEDS TO VET THEM AND WE NEED TO LOOK AT ALL THE QUALIFICATIONS AND AND THOSE APPOINTMENTS WERE WERE GIVEN OUT. I REMEMBER HAVING A LONG CONVERSATION ABOUT ELVIN VILLALOBOS AND HIS BACKGROUND AND AND ALL THOSE THINGS FOR PARK'S BOARD FOR A PARKS BOARD. WE ALL REMEMBER THAT CONVERSATION. THE CITY MANAGER EVEN COMMENTED LOOKED ONLINE AT HIS BACKGROUND. AND AND SPOKE ON HIS BACKGROUND RIGHT HERE ON THE DAY AS WE WENT THROUGH THAT. SO NOW WE HAVE APPOINTMENTS JUST SLIDING THROUGH WITHOUT ANY RESUMES. THAT IS UNFAIR IS UNFAIR. SO AGAIN IT IS NOT ABOUT THE VICE MAYOR'S APPOINTMENTS. I LOOK THEM UP. I DID MY RESEARCH. THEY ARE GREAT PEOPLE. I'M NOT GOING TO VOTE AGAINST YOU BARBARA. STOP LOOKING AT ME LIKE THAT. I LOVE YOU. YOU KNOW I THINK THEY'RE GREAT. BUT THE PROCESS HOW WE DO THINGS WHEN WE THINK IT'S POLITICAL AND WHEN WE THINK IT'S NOT HOW WE DO THINGS NEEDS TO CHANGE NEEDS TO CHANGE. PULL THE LAST MEETING AND SEE WHAT YOU ALL DID TO ME. SEE WHAT YOU ALL DID.

COMMISSIONER YELLEN THAT IS SITTING RIGHT NEXT TO YOU TELLING US THAT HE WAS NOT QUALIFIED TO SIT ON THE PLANNING BOARD AND LOOK AT HIM BEING THE BEST COMMISSIONER UP HERE. WELL THE SECOND BEST IS SITTING NEXT TO YOU. HE'S SERVING NEXT YEAR AND YOU'RE PROUD TO SERVE WITH HIM. LOOK AT THE HOW YOU'VE BEEN GIVING PEOPLE IN THE COMMUNITY WHEN THEY WANT TO SERVE. BUT WHEN WE WANT TO APPOINT SOMEBODY THAT WE LOVE AND WE WANT TO SERVE ON ON THE ON THE COMMITTEES WE DON'T HAVE RAZA MEANS WE DON'T PUT THEM. WE JUST SLIDE THEM THROUGH CONSENT AGENDA. YES YES YES. STRAIGHT TO THE BOARD AND THAT'S IT CHECK YOURSELVES GO BACK TO HOW YOU TREATED PEOPLE AND MAYBE THAT'S WHY PEOPLE ARE NOT GETTING ALONG WITH SOME PEOPLE HERE ON THE DAIS. THANKS. I NEED A MOTION AND A SECOND TO APPROVE. SO MOVED IN COMMISSIONER GALEN. YES COMMISSIONER FISHMAN. YES COMMISSIONER BOLTON. YES. VICE MAYOR FLACCO. YES. MAYOR GOMEZ. YES.

MOTION TO MOVE THE ITEM 4 TO THE TABLE FOR DISCUSSION. 2ND THANK YOU. AN AMERICAN MISSION. ITEM 6 G'S TEMPORARY RESOLUTION ABOUT 130 TO 86 RESOLUTION OF THE CITY COMMISSIONER OF THE CITY TAMARACK FLORIDA APPOINTING DAVID MUHAJIR M O H A B.A. R TO THE CITY'S AFFORDABLE HOUSING ADVISORY COMMITTEE AS REQUIRED BY SECTION 4 TWENTY POINT NINE 0 7 6 SUBSECTION 2 OF THE FLORIDA STATUTES AND PURSUANT TO CITY OR DECEMBER 2008 TAX 0 FOR PROVIDING FOR THE EXPIRATION OF TERMS DIRECTING CITY STAFF TO TAKE ANY AND ALL ACTION NECESSARY TO EFFECTUATE THE INTENT OF THE RESOLUTION PROVIDING FOR CONFLICTS SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE. THANK YOU VERY MUCH SEEN THAT THERE'S NO OK COMMISSIONER BOLTON HAS HIS LIGHT LET GO AHEAD. I ALSO WANT TO MENTION THAT. THIS HAS NOTHING ALSO TO DO WITH WITH THE CITY CLERK SO THE CLERK WORKS FOR THE CITY MANAGER AND AND. AND ULTIMATELY WHAT HAPPENS HERE AND HOW WE WE DO THINGS COMES FROM UPSTAIRS AND YOU KNOW I'M I'M I'M I'M JUST TIRED OF HAVING ONE THING WORK ONE WING. AND HAVING SOMETHING ELSE. SAME THING WORK ANOTHER WAY. SO IT HAS NOTHING TO DO WITH THE CITY CLERK OR HOW SHE DOES HER JOB AND THAT'S THE STUFF I BELIEVE SHE SHE SHE DOES WHAT SHE IS TOLD AND I BELIEVE THAT STAFF WOULD DO WHAT THEY ARE THERE THEY'RE TOLD TO IF THEY WON'T BE. IF THEY WOULDN'T BE REPRIMANDED AND OFFICES OF ELECTED OFFICIALS WHEN THEY'RE THERE TO DO THEIR JOBS THEY DO COMPLAIN. THANKS. COMMISSION AGAIN. YEAH. IT'S WANTS TO KNOW HOW MANY REPRESENTATIVES ON THE AFFORDABLE HOUSING COMMITTEE REPRESENT EACH DISTRICT. SO IS THERE SOMEONE THERE REPRESENTING DISTRICT 2 3 1 AND 4. AND HOW MANY PER DISTRICT. I KNOW THERE'S EIGHT ON THE BOARD NOW RIGHT. MAXINE OUR CITY MANAGER WHO WANTS THIS. I'LL I'LL JUST SPEAK TO THAT BRIEFLY. I DON'T KNOW THAT THE AFFORDABLE HOUSING COMMITTEE IS DONE BY DISTRICT. I BELIEVE IT'S DONE BY QUALIFICATION. BUT MAXINE CALLOWAY IS SHAKING HER HEAD YES. IT'S NOT A IT'S NOT A BY DISTRICT BOARD IT'S A BY QUALIFICATION BOARD IF YOU WISH TO REVIEW THAT ORDINANCE AND THOSE QUALIFY THOSE REQUIREMENTS AND MAKE IT A BY DISTRICT WE CAN PROBABLY ACCOMMODATE THAT BUT IF IT'S BY DISTRICT PLEASE KEEP IN MIND THAT THEY HAVE TO BE QUALIFIED TO SERVE. YOU KNOW THAT'S NOT MY CONCERN. I JUST WANT TO KNOW FOR EXAMPLE I DON'T KNOW IF SOMEBODY FROM DISTRICT 2 IS REPRESENTED ON THE BOARD.

I'M NOT SURE WHERE THE REPRESENTATIVES ARE FROM WHICH DISTRICTS. I JUST KNOW THAT WE HAVE I BELIEVE AT THIS TIME EIGHT QUALIFIED MEMBERS. THANK YOU MR. MANAGER.

THERE'S NO REQUIREMENT THAT THE MEMBERS LIVE IN THE CITY OF TAMARACK IT'S MY QUALIFICATION SOME AFFILIATION WITH AFFORDABLE HOUSING IS GOVERNED BY FLORIDA STATUTE FOR TWENTY POINT NINE 0 7 6 I DIDN'T SET A COPY TO YOU YESTERDAY AND I CAN PROVIDE A COPY TO ALL THE MEMBERS OF THE COMMISSION AND LATER ON TODAY IN TERMS OF THE VARIOUS QUALIFICATIONS. ALL RIGHT. THANK YOU. AND IF I MAY JUST ADD. I HAPPEN TO KNOW ONE OF THE PEOPLE ON THE BOARD THIS YEAR TWO RESIDENT UNLESS SHE'S MOVED IN THE LAST SEVERAL MONTHS I'M NOT AWARE OF AN ASIDE IT IS NOTHING FURTHER TO HAVE A MOTION A SECOND FOR THIS TO BE APPROVED. SO MOVED SO I CAN THAT WHEN YOU'RE A. COMMISSIONER GALLON. YES LET'S FLACCO. YES COMMISSIONER FISHMAN. YES COMMISSIONER BOLTON. YES. MAYOR GOMEZ. YES. TEMPORARY RESOLUTION 1 3 2 8 6 PASSED. [01:30:03]

VERY MUCH. SAYING THAT THERE'S NO ONE LIKE THAT I WOULD LIKE A MOTION AND SECOND.

COMMISSIONER GUNS LADIES NO LET PLEASE YOU RECOGNIZE. SO WHAT'S THE TIMELINE FOR COMPLETION OF THIS PROJECT. MARK MASON FINANCIAL SERVICE DIRECTOR I JUST HAPPENED TO BE SITTING ON THE END. SO WE'RE LOOKING AT AUGUST OR SUMMER TIME FRAME UP NEXT YEAR 2020. YOU SAID THAT THIS WAS A LIKE A THIRD PARTY BROKER BROUGHT THIS OPPORTUNITY TO THE CITY. THE LAST MEETING I DID THE THIS IS PRIMARILY A SALE OF PROPERTY BROKER PROPERTY BROKER BROUGHT THE THE THE COMPANY EIGHTY ONE TO US TO PURCHASE PROPERTY FROM US TO BUILD A HOTEL. YES. WHO WAS THE PROPERTY BROKER.

THE GENTLEMAN NAMED BOB GOLDSTEIN. RIGHT. THANK YOU. MANAGEMENT IS OUR PROCUREMENT DIRECTOR HERE HE IS. QUESTION. HE WAS SO WITH THE QUESTION. ACTUALLY I THINK HE LEFT AFTER A COUPLE OF THE PURCHASING ITEMS WERE DONE SO THAT THE DUE DILIGENCE DID IT MATCH OR WAS THAT CLOSELY MATCHED THE DUE DILIGENCE THAT HAS GONE THROUGH A NORMAL PROCUREMENT PROCESS FROM THIS BROKER FROM THE BROKER WHO BROUGHT US THE PROPERTY INCORRECT FOR SOMEWHAT. DUE DILIGENCE WAS DONE ON EIGHTY ONE TO SAY THIS WAS THE RIGHT COMPANY FOR THIS PROJECT. OKAY. IMPORTANT. ALL RIGHT. SO A PROPERTY BROKER BROUGHT A BROUGHT EIGHTY ONE TO US TO PURCHASE A PIECE OF PROPERTY TO BUILD A HOTEL. AS WE WENT THROUGH THE PROCESS OF DEVELOPING THE PURCHASE AND SALE AGREEMENT ONE PORTION OF THAT WAS IS IS PUTTING IN THE AN OPTION FOR EIGHTY ONE TO ACTUALLY BUILD THE REMAINDER OF THE OF THE SITE OUT AT THE SAME TIME. SO AS WE WENT THROUGH THAT PROCESS WE THE CITY YOU KNOW DID SOME BACKGROUND WORK ON EIGHTY ONE TO MAKE A DETERMINATION OF WHETHER THEY HAD THE CAPACITY AND THE CAPABILITY TO BUILD OUT THE CART BARN AS WELL AS THE THE HOTEL. AND WHAT DID MR. GOLDSTEIN BRING ANY OTHER POTENTIAL BUYERS BESIDES EIGHTY ONE. HE DID. HE BROUGHT ONE PRIOR TO EIGHTY ONE. THAT ONE DIDN'T WORK OUT. IS THE CITY STILL CONTRACTED WITH BOB GOLDSTEIN IN HIS FIRM. NO. AND WHO AT THE CITY IS GOING TO TAKE OVER THE ROLE THAT 81 ONCE HAD. IN THE MANAGEMENT OF THIS PROJECT. WE HAD DURING THE PROCESS OF LAST YEAR'S BUDGET AND WE HAD BROUGHT ON AN ADDITIONAL SENIOR PROJECT MANAGER AND WHO WAS HIRED TO OCTOBER 1 OF 2018 RON STEIN IS THE PROJECT MANAGER FOR THE PROJECT. SO HE HAS TAKEN OVER THE ROLE AS THE PROJECT MANAGER FOR THE CITY OF. AND SO WAS IT NOT NECESSARY OR DID WE DO WE DID WE GO OUTSIDE OF OUR NORMAL PROCESS BY NOT DOING A PUBLIC PROCUREMENT FOR THIS PROPERTY. NO WE DID NOT. THAT'S ALL I HAVE. CITY MANAGER RESOLUTION BEFORE HE MET AMIR. THE ORIGINAL PROPERTY THAT WAS BEING PURCHASED BY 81. WAS NOT THE ACTUAL SITE IN WHICH CURRENTLY IS. IS THAT CORRECT. SO JUST A LITTLE HISTORY ON. YES. EXCUSE ME HOW WE GOT TO 81. THE THE CITY OF OF TAMARACK RECRUITED ANY NUMBER OF HOTEL HAUTE WE'LL CALL THEM HOTELIERS HOTEL DEVELOPERS REAL ESTATE DEVELOPERS WITH BACKGROUNDS IN HOTELS AND MUCH AS WE'VE DONE RECENTLY. WE GAVE SEVERAL TOURS TO THE HOTEL DEVELOPMENT COMMUNITY. WE SHOWED THEM ANY NUMBER OF SITES WITHIN THE CITY OF TAMARACK. WE TOOK THEM OUT EAST. WE SHOWED THEM SITES ON COMMERCIAL BOULEVARD. WE SHOWED THEM SITES AT THE WOODLANDS WE SHOWED THEM SITES THAT WOULD MONT. WE SHOWED THEM COLONY WEST. WE SHOWED THEM ANY NUMBER OF SITES WHERE WE THOUGHT HOTELS MIGHT BE APPROPRIATE TO BE BUILT IN

[01:35:06]

THE CITY OF TAMARACK. AND FROM THAT TOUR WE ENDED UP WITH TWO PROPOSALS ONE CAME TO COLONY WEST AS AN UNSOLICITED PROPOSAL. THE OTHER ULTIMATELY WENT TO WOOD MONT.

AND THAT IS BEING PUT THROUGH THE PROCESS TODAY. SO THE UNSOLICITED OFFER TO PURCHASE THE PROPERTY AT. COLONY WEST WAS MADE BY A BROKER NAMED BOB GOLDSTEIN WHO WE DID NOT KNOW BUT HE CAME TO US AND PRESENTED HIMSELF PRESENTED HIS CREDENTIALS AS A REPUTABLE HOSPITALITY INDUSTRY REAL ESTATE BROKER WHICH HE WHICH HE WAS IN IS AND IN EVALUATING THE PROPOSAL THAT HE MADE TO US. AS MARK MASON SAID WE WORKED THROUGH THE PROCESS OF DEVELOPING THE PUBLIC PRIVATE PARTNERSHIP THAT WAS BROUGHT TO THE COMMISSION AND APPROVED BY THE COMMISSION. ULTIMATELY THE FIRST THE FIRST ITERATION OF THAT WAS FOR THE HOTEL TO BE FURTHER NORTH ON THE PROPERTY AND FOR THE HOTEL TO BE ROTATED. I'LL I'LL SAY 90 DEGREES. AND FOR THE CLUB NEW CLUBHOUSE TO BE REBUILT IN THE IN THE PLACE OF THE EXISTING CLUBHOUSE DUE TO A NUMBER OF CONSIDERATIONS SOME ENVIRONMENTAL CONSIDERATIONS RELATING TO THE TREES THAT ARE ON THE SITE AND SOME CONCERNS BY THE NEIGHBORS. IT WAS RE-EVALUATED AND THE HOTEL WAS MOVED TO THE CENTER OF THE PROPERTY WHERE IT IS TODAY AND THE LAND SALE WAS RECONFIGURED TO REFLECT A DIFFERENT LOT AT AT THE SAME VALUE IN ORDER TO HAVE THE HOTEL CONSTRUCTED WHERE IT IS TODAY AND TO HAVE THE NEW CLUBHOUSE AND CARD BARN CONSTRUCTED WHERE THEY ARE ON PROPERTY THAT THE CITY OWNS. THANK YOU VERY MUCH COMMISSIONER BOLTON YOUR LINE IS LIT. IF YOU'D REMEMBER WHEN THIS FIRST CAME TO US I SAID THAT I LOVE COLIN WHO ASKED TO LOVE THE CONCEPT. BUT SOMETHING IS VERY WELL OFF WITH THE PROJECT I THINK I SPENT TOO MUCH TIME IN NEW YORK SOME IN NEW YORK AND BOSTON WHENEVER SOMETHING IS VERY OFF WITH THIS PROJECT IT SOMETHING MAKES ME VERY UNCOMFORTABLE IN HOW IT'S HANDLED HOW IT'S DONE. AND I DON'T KNOW WHO TO BLAME BECAUSE RIGHT HERE RIGHT NOW I LOVE OUR CITY MANAGER AND I WOULD NOT TRADE HIM FOR ANY OTHER CITY IN THE WORLD. NO CITY OUT WEST OR NO CITY OF EAST. I DON'T KNOW WHO TO BLAME. I. KNOW THAT SOMETHING IS WRONG WITH THIS PROJECT. SOMETHING IS OFF AND SO I'M LOOKING AT. MILLIONS OF DOLLARS. I JUST DON'T THINK IT'S WORTH IT. I REALLY DON'T THINK IT'S WORTH IT. AND I THINK I THINK THIS IS A WASTE OF TAXPAYERS MONEY. IT IS IT IS FOR. FOR WHAT IT'S GOING TO DO. YES IT'S GOING TO BE A IT'S GOING TO BE A PLACE WHERE WE CAN HAVE PREMIERE EVENTS AND OUR PRESIDENTS CAN GET MARRIED AND HAVE BIRTHDAY PARTIES BUT THE AMOUNT OF MONEY THAT WE'RE WE'RE SPENDING AND HOW THIS IS HAPPENING SOMETHING IS OFF.

SOMETHING IS REALLY REALLY OFF. WHETHER IT GOES THROUGH OR DOESN'T TONIGHT. THAT'S NOT THE END OF IT. SO I WANT TO PUT EVERYBODY ON NOTICE THAT IF SOMETHING WAS NOT DONE RIGHT IT WILL BE FOUND OUT. BECAUSE I'M GOING TO GO THROUGH THIS WITH

[01:40:07]

A FINE TOOTH COMB AND I'M GOING TO GO THROUGH THIS WITH PEOPLE WHO KNOW SOMETHING IS WRONG. THAT'S IT. COMMISSIONER GO ON YOUR LIFE SLOW FOR THE SECOND TIME. IT DID. DO WE PAY. BOB GOLDSTEIN FOR HIS SERVICES. WE DID. WELL ONE HUNDRED THOUSAND DOLLARS. HOW MUCH. ONE HUNDRED THOUSAND. OKAY. AND HOW WAS HOW WAS HE CONTRACTED WITH THE CITY. SO. SO DID HE HAVE TO GO THROUGH AN RFP PROCESS TO BE SELECTED. HE DID NOT. SO HOW WAS THAT DECISION MADE. BECAUSE ISN'T THERE A POLICY WHERE ANYTHING ABOVE SIXTY FIVE THOUSAND HAS TO GO TO NAZI PROCESS IN THIS PARTICULAR CASE. IT WAS PART OF THE SALE THE PURCHASE AND SALE AGREEMENT AND IT WAS A SEPARATE RESOLUTION APPROVED BY THE CITY COMMISSION. IN OTHER WORDS A WAIVER OF THE PROCUREMENT PROCESS. COMMISSIONER BOLTON WERE YOU ON THE COMMISSION AT THAT TIME. I BELIEVE I WAS. AND ALL THE TIMES THAT THIS HAS COME TO ME BEFORE YOU WERE HERE I VOTED NO. AND WHEN WHEN WHEN THIS IS INVESTIGATED BY THE RIGHT MUDDY I'LL BE HOLDING EVERYBODY ACCOUNTABLE FOR THOSE WHO VOTED YES.

ANOTHER QUESTION SO WE OWN THE LAND. THEN WE SAW THE LAND. IS THAT RIGHT. CORRECT.

HOW ARE WE MEASURING OUR RETURN ON INVESTMENT ON THIS PROJECT. WELL AS FAR AS THE SALE OF THE PROPERTY IS CONCERNED WE BOUGHT IT FOR FIVE HUNDRED THOUSAND DOLLARS AND SOLD IT FOR ONE POINT FOUR MILLION DOLLARS. SO WE BOUGHT 500 SO THE FORM. ONE POINT ONE MILLION ONE POINT FOR ME AND 24 MILLION AND WE'RE SPENDING AN ADDITIONAL NINE POINT TO THREE FIVE MILLION. CORRECT. SO THE RETURN ON THE INVESTMENT WILL BE OVER A PERIOD OF TIME. AS YOU KNOW WE EARN REVENUES AND NET REVENUES OFF OF THE TOP OF THE FACILITY. ARE WE EARNING REVENUES FROM THE HOTEL OR JUST THE CLUBHOUSE. JUST A CLUBHOUSE. BUT AS FAR AS THE HOTEL IS CONCERNED OBVIOUSLY WE'LL BE PAYING TAXES THAT SORT OF THING. DO WE KNOW WHAT THE ESTIMATED AMOUNT OF PROPERTY TAXES WILL RECEIVE. I MAY HAVE THAT INFORMATION. I DON'T RECALL EXACTLY WHAT THE NUMBER WAS BUT I RECALL SOMEWHERE AROUND THE SIXTY FIVE THOUSAND DOLLAR RANGE PER YEAR. AND THEN WHAT DO WE PROJECT OUR REVENUES WILL BE FROM THE CLUBHOUSE HAVE WE DONE ANY PROJECTION. WE HAVE DONE PROJECTIONS I DON'T HAVE THEM WITH ME. OKAY. THAT'S ALL I HAVE. THANK YOU VERY MUCH. SEEING THAT THERE'S NO ONE ELSE LIGHT IS LIT. I'D LIKE TO CALL THE QUESTION FOR A VOTE PLEASE. I NEED A MOTION A SECOND. SO MOVED TO I HAVE A SECOND. I'M SORRY. SECOND THANK YOU VERY MUCH. PLEASE CALL THE ROLL PAT COMMISSIONER BOLTON. NO. VICE MAYOR FLACCO. YES COMMISSIONER FISHMAN. YES. COMMISSIONER GALEN. NO. MAYOR GOMEZ. YES.

DOES NOT HAVE A NEW PRESENTATION FOR US IT IS KEEPING WITH WHAT IT PRESENTED LAST YEAR A COMMISSION MAY SPEAK FOR THE ADMINISTRATION AND FOR THE RECORD IF YOU CAN WATCH WHAT STAFF HAS ADVISED ME I IS REPUBLISHING THEIR SWORN TESTIMONY AND EVIDENCE FROM THE HEARING WHICH WAS CONDUCTED AT THE LAST REVIEW OF THE MATTER WHICH WAS ON THE DATE FOR WHICH WAS MAY 22ND AND WOULD STAND ON THEIR TESTIMONY AND EVIDENCE WHICH IS BEING REPUBLISHED. GOD BLESS YOU AS A MATTER OF PUBLIC RECORD THIS EVENING. ALL EVIDENCE TESTIMONY DOCUMENTS AND BACKUP THAT WERE SUBMITTED DURING THAT MEETING OR MAY PARTY A RECORD THIS EVENING. MAXINE CALLOWAY WILL WILL BE SWORN AS WELL AS ANY OTHER AFFECTED PARTY THIS EVENING FOR THE PURPOSE OF THE DISCUSSION. FOR THE PURPOSES OF REPUBLISHING HER TESTIMONY AND THAT OF STAFF AND OF THE RECORDS AND TO THE EXTENT POSSIBLE THEN THE APPLICANT THE APPLICANT'S COUNSEL AND THEIR COTERIE OF EXPERTS MAY MAY CHOOSE TO ALSO BE SWORN IN FOR THE PURPOSE OF THE PRESENTATION. BUT THE STAFF WILL REST UPON ITS PRIOR PRESENTATION OF MAY THE 22ND. SO THAT BEING SAID BECAUSE THIS IS PRESENTATION BASED ON THESE TWO ITEMS IS GOVERNED BY ARTICLE NUMBER 10 UNDER QUESTION INITIAL PROCEEDINGS. SECTION 2 DASH 367. FOLLOWING WOULD BE APPROPRIATE MADAM THEY'RE ON COMMISSION FOR THE CITY CLERK TO SWEAR IN ALL AFFECTED PARTIES AND THE WITNESSES WHO MIGHT OTHERWISE BE TESTIFYING BUT THAT THE STAFF WILL BE PROMOTING THEIR POSITION BASED UPON THEIR PRIOR TESTIMONY AND REMEMBER THE. PUBLIC ALSO. THANK YOU VERY MUCH. PLEASE JOIN WITH US. DO YOU SWEAR OR AFFIRM THAT THE TESTIMONY THAT YOU ARE ABOUT TO PROVIDE SHALL BE THE TRUTH AND NOTHING BUT THE TRUTH THANK YOU VERY MUCH. JUST FOR THE AMERICAN MISSION THIS IS A MATTER WHICH IS NOT UNCOMMON TO THE COMMISSION HANDLING IT IS QUASAR JUDICIAL ITEM WHICH MEANS THAT YOU'RE SITTING AS NEAR JUDGES BASED UPON COMPETENT HOUSTON SUBSTANTIAL EVIDENCE WE'LL BE MAKING A DECISION WITH REGARD TO THE APPLICATION FOR BOTH ITEMS UNDER ITEM ELEVEN A AND 11 B. THIS IS THESE TWO ITEMS ACTUALLY QUALIFY UNDER THE CODE TO BE BE HANDLED IN THAT PARTICULAR FASHION YOU MIGHT CHOOSE JUST FOR THE RECORD MATT AMERICAN MISSION TO DISCLOSE ANY EX PARTE DAY COMMUNICATIONS THAT MIGHT HAVE OCCURRED BEFORE YOU BEGIN TO DELIBERATE OBVIOUSLY BUT FOR THE RECORD YOU'LL BE BASED YOU'LL BE BASING YOUR TEST. YOU'RE BASING YOUR DECISION ON THE EVIDENCE AND TESTIMONY AND THE RECORD PREVIOUSLY OFFERED WHERE AS WELL AS ANY FURTHER FURTHER OR ADDITIONAL TESTIMONY OR EVIDENCE WHICH COULD BE OFFERED THIS EVENING AS WELL. WE KNOW THAT COMPETENT AND SUBSTANTIAL EVIDENCE HAS BEEN DEFINED IN VARIOUS WAYS. BUT TO THE EXTENT POSSIBLE UNDER THE CITY'S CODE IT IS IN FACT THAT EVIDENCE WHICH WE KNOW TO BE THE FOLLOWING IS COMPETENT SUBSTANTIAL EVIDENCE MUST BE RELIABLE AND CREDIBLE IT MUST BE FACTUALLY BASED AND THAT'S UNSUPPORTED BY GENERALIZED STATEMENTS. IT DOES MORE THAN MERELY CREATES A SUSPICION OR GIVES EQUAL SUPPORT TO INCONSISTENT INFERENCES. IT POSSESSES SOMETHING OF SUBSTANTIAL RELEVANT CONSEQUENCES. IT MUST NOT CONSIST OF VAGUE UNCERTAIN OR IRRELEVANT MATTERS NOT CARRYING THE QUALITY OF PROOF. IT MUST AMOUNT TO MORE THAN BEAR ALLEGATIONS OR OBJECTIONS BECAUSE IT MUST ESTABLISH A JUSTIFIABLE REASON FOR SUPPORT OR OPPOSITION TO AN ISSUE. IT MUST BE MORE THAN SURMISE CONJECTURE OR SPECULATION. IT MUST BE BASED ON SOMETHING MORE THAN MERE PROBE PROBABILITIES GUESSES WHIMS OR CAPRICES BUT RATHER SUPPORT A REASONABLE FOUNDATION FOR THE CONCLUSION REACHED. THIS COMMISSION HAS CONSIDERED THIS ITEM UNDER FIRST READING. THE PLANNING COMMISSION ALSO PLANNING BOARD CONSIDER THE MATTER WITH EVIDENCE AND TESTIMONY AS WELL. AND BEFORE YOU THIS EVENING WOULD BE THE APPLICANTS ASKING FOR YOUR SUPPORT ON BOTH ITEM NUMBER 11 8 AND 11 B. TO THAT EXTENT MARY COMMISSION IF YOU WOULD CHOOSE THROUGH THE CHAIR TO DISCLOSE ANY ANY EX PARTE COMMUNICATIONS WITH THIRD PARTIES WOULD BE USEFUL TO DO THAT NOW. THANK YOU. THANK YOU. [12. OTHER]

THAT I'M NOW HAVING A NOD FOR A YES. COMMISSIONER GALEN YES. SO BASED ON OUR DISCUSSION AT THE WORKSHOP ON MONDAY I WOULD LIKE TO DIRECT THE CITY MANAGER OR CITY ATTORNEY TO OR ACTUALLY WHILE I'M SULLIVAN. SO I WANT THE CITY TO OR TO ADOPT THE SISTER CITIES PROGRAM AND ADOPT THREE CITIES AS FRIENDSHIP CITIES TO BE DETERMINED AT SOME POINT. BUT I GUESS IT WOULD BE AT LEAST ONE CITY IN LATIN AMERICA ONE CITY IN THE CARIBBEAN AND ONE CITY IN THE STATE OF ISRAEL. MY MOTION IS TO HAVE THE COMMISSION ADOPT OR DRAFT THE RESOLUTION THAT WE ADOPT THE CITIES CITIES PROGRAM THREE CITIES AND ONE EACH IN LATIN AMERICA THE CARIBBEAN AND ISRAEL. A.

FRIENDLY AMENDMENT TO A MOTION. SURE I BELIEVE THAT CONSENSUS AT THE COMMISSION MEETING WAS TO START WITH FRIENDSHIP CITIES AND THOUGH EVEN IF NOT JUST FOR SISTER CITY SO THAT'S WHY AT THIS POINT IN TIME. THE DIRECTIVE WOULD BE TO ASK THE CITY STAFF CITY ATTORNEY HOWEVER IT IS DRAFTED BETWEEN THE TWO TO BRING FORTH A

[02:00:02]

MOTION FOR REVIEW AND DISCUSSION AT THE EARLIEST POSSIBLE MEETING PLACE AND WE WILL NEED TO TAKE A VOTE ON THIS CORRECT. I'M NOT CLEAR ON YOUR QUESTION THAT A MAYOR THE RIGHT ONE A CLARIFICATION FROM THE COMMISSIONER THAT THIS MOTION OR ORDINANCE OR RESOLUTION OR HOWEVER YOU HAVE TO PROPERLY HANDLE IT FOR THE CITY NEEDED TO BE DONE. WHITNEY DID INCLUDE THE FRIENDSHIP CITY THAT WAS DISCUSSED ON MONDAY I BELIEVE HER MADE IT. I'M NOT SPEAKING FOR THE COMMISSION I BELIEVE YOU WOULD LIKE TO GET YOUR HAVE A MOTION CONSIDERED WITH REGARD TO DIRECTING THE PREPARATION OF A RESOLUTION THAT SETS FORTH THE CONDITIONS THAT HE'S DESCRIBING CRAFT AND I AVERAGE IN WHICH IS NOT ON TONIGHT'S AGENDA BUT BUT FOR THE PURPOSES OF GETTING IT TO BE PREPARED THAT WOULD BE WHAT WE WOULD DO IF THE COMMISSION SO SOME MOVES CRACKED IN THAT HE AGREED THAT WAS WHAT HIS REQUEST WAS AND HE NEEDS TO SAY THAT HE STAYED IN THE PARAMETERS OF WHAT HE'S TRYING TO ACCOMPLISH BY THAT RESOLUTION IF YOU WOULD THEN. SAM IF YOU WOULD WITH I BELIEVE THE MOTION YOU NEED HIM TO RESTATE THEM SO THAT WE NEED PERMISSION TO GET HELPFUL THINGS IN LOGICALLY. SO WE NEED TO HEAR IT. YES. IF YOU WILL MOTION TO ADOPT THE SISTER CITIES PROGRAM IN THE FORM. IN THAT IN WHICH WE DISCUSSED IT ON MONDAY WHERE WE ADOPT THREE CITIES AS FRIENDSHIP CITIES. AND MY SUGGESTION IS THAT WE ADOPT A CITY IN LATIN AMERICA THAT WE CHOOSE OF A CITY IN THE CARIBBEAN AND A CITY IN ISRAEL SO MOVED THAT SECOND PIECE THERE WAS A PORTION OF WHAT COMMISSIONER GALEN SAID FOR DISCUSSION AT A LATER DATE. TO IMPLEMENT MY MOTION WHICH IS TO PREPARE A RESOLUTION IMPLEMENTED IN THREE CITIES WHICH WHICH IS THAT IF THIS IF I MAY THAT AMERICAN VISION. IF YOU IF THE COMMISSION ADOPTS THIS MOTION THIS EVENING WE WILL DRAFT WITH THE ASSISTANCE OF STAFF. A RESOLUTION TO SUPPORT THE CONDITIONS THAT WERE OFFERED BY THE COMMISSIONER AND THAT WILL COME BACK TO THE COMMISSION FOR RATIFICATION FOR DISCUSSION ON THE CITIES AT THAT TIME. WE ARE OKAY. WE DON'T NEED TO WORRY ABOUT A DISCUSSION ON THAT FOR RIGHT NOW. CORRECT. THAT'S UP TO THE COMMISSIONER. BUT IF YOU GET EMOTIONAL SECOND YOU CAN DISCUSS IT. MY ONLY QUESTION IS IF ANYBODY ELSE ON THE COMMISSION IF THEY HAD ANY OTHER LOCATION THAT THEY WANTED TO INCLUDE. OKAY. THIS WAY OUR PARAMETERS ARE SET. WE'VE GOT A MOTION THE SECOND ON THE TABLE IS SEEING THAT THERE'S NO DISCUSSION PLEASE CALL THE ROLL. COMMISSIONER BOLTON YES VICE MAYOR FLACCO. YES COMMISSIONER GALEN. YES COMMISSIONER FISHMAN. YES ARE. GOMEZ YES. MOTION PASS AND I WILL THANK YOU FOR KEEPING THIS UP OTHER. SURE. I'M NOT RUNNING FOR COMMISSIONER BOLTON.

COMMISSIONER GALAN HAS THIS ADVICE THAT HE HAS ANOTHER ITEM. SO I ALSO WANT TO. MAKE A MOTION THAT WE LIFT THE BAN ON MEDICAL MARIJUANA IN THE CITY OF TAMARACK AND ADOPT THE POLICY WHERE WE ALLOW MEDICAL MARIJUANA TO BE SOLD IN THE CITY OF TEMPORARY BASED ON OUR DISCUSSION ON DURING A WORKSHOP ON MONDAY. I UNDERSTAND THAT IF I CAN'T GET THE CONDITION THAT WE REQUIRE AN ORDINANCE THAT ACTUALLY DOES THE REPEAL BUT IF IT BE THE WISH OF THE COMMISSION BY MOTION TO DIRECTLY WE PREPARE A REPEAL OR WE WILL PREPARE TO REPEAL THE ORDINANCE. MY UNDERSTANDING IS ON MONDAY THE FIRST DAY DO A CONSENSUS TO ASK YOU TO PREPARE THAT THOSE DOCUMENTS ALREADY FOR US. TONIGHT'S THE REQUEST OF THE COMMISSION IS TO DO A DEMOTION TO DRAFT A REPEAL OR ORDINANCE AGAIN JUST PROCEDURALLY. SO GET THIS THROUGH. WE DISCUSSED THIS AT OUR WORKSHOP NEXT WEEK OR NEXT WORKSHOP BECAUSE AGAIN THE UNDERSTANDING OF SOME OF THE BODY WAS THAT THROUGH OUR PROCEDURES THE WAY WE'VE DONE IT IN THE PAST. WHAT WE DIRECTED ON MONDAY WAS ALREADY THERE. THAT IS FINE. WE HAVE A MOTION ON THE TABLE. IS THERE A SECOND. SECOND THANK YOU. MAKE A SECOND I'M SORRY I DID. THANK YOU. THIS IS FOR THE AUDIENCE TO BE DRAFTED FOR REVIEW AND DISCUSSION TO REPEAL BE THE MAN MOTION TO YES FOR AN ORDINANCE TO REVIEW AND DISCUSS. ACTUALLY I HAVE A LIGHTWEIGHT BEFORE WE DO VOTE. NO I'M JUST ASKING SAM FOR CLARIFICATION. WE WOULD NEED TO DO A REPEAL OR ORDINANCE AND THEN PLACE AN ORDINANCE A REPLACEMENT DOCUMENT THAT WOULDN'T REGULATORS AS IF A PHARMACY IS PRESENTED BY BY MAXINE AND BY BRIAN. BRIAN SHERMAN. THAT'S CORRECT. THANK YOU. CAN YOU SUMMARIZE THROUGH THE CHAIR WHAT WHAT WHAT WE'RE DOING. THE MOTION IS TO IF I MAY MATT AMERICAN MOTION THE MOTION BY COMMISSIONER GELINAS IS TO ESSENTIALLY DIRECT THE CITY ATTORNEY'S OFFICE ALONG WITH THE CITY ADMINISTRATION TO TO PREPARE AN ORDINANCE TO ESSENTIALLY LIFT THE BAN BANNING MEDICAL MARIJUANA DISPENSARIES IN THE CITY OF TAMARACK AND

[02:05:01]

TO CREATE AN ORDINANCE WERE THEREBY TO CREATE AN ORDINANCE THAT WOULD REGULATE THEM CONSISTENT WITH PHARMACIES AS PRESENTED BY MAXINE CALLOWAY AND BY BRIAN SHERMAN AT THE WORKSHOP ON MONDAY. THANK YOU VERY MUCH. I HAVE EMOTIONS SEGMENT AND TABLE. PLEASE CALL ABOUT VICE MAYOR FLACCO. YES MR. FISHMAN YES COMMISSIONER GALEN. YES COMMISSIONER BOLTON. YES. MOTION PASSED. IT'S ALL GOOD. OH I'M SORRY MAYOR GOMEZ. NOW THE MOTION PASSED. ALL GOOD. LADIES AND GENTLEMEN NOW IF THERE'S NOTHING ELSE. AT TWENTY ONE WISH YOU A VERY GOOD EVENING. THANK YOU VERY MUCH.
