[8.a TO2547 - An ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 10, Article 4 of the City of Tamarac Land Development Code, entitled “Development and Design Standards” by amending specific development and design standards for roadways, sidewalks, bicycle paths, drainage, parking, waste water, storm water, potable water, and irrigation systems, consistent with updated engineering standards; modifying dimensions of alleys, parking stalls, and required paved rights of way, to provide for consistency with the City of Tamarac Engineering Design and Processing manual; updating fire emergency access requirements for guard houses with security locking mechanisms; amending the City’s right-of-way sign provisions to appropriately identify SR 869/Sawgrass Expressway and clarify the permitted location for the installation of billboard signs and their distance separation from residential property; and modifying the height of numerical building addresses on monument signs to enhance visibility and comply with fire code safety standards; providing for conflicts; providing for severability; providing for codification; and providing for an effective date.]

UPDATING FIRE EMERGENCY ACCESS REQUIREMENTS FOR GUARD HOUSES WITH SECURITY LOCKING MECHANISMS. THE ITEM BEING BROUGHT BEFORE YOU TODAY IS A TEXT AMENDMENT TO THE CITY'S LAND DEVELOPMENT CODE, PARTICULARLY ARTICLE FOUR.

ARTICLE FOUR CONTAINS REGULATIONS THAT BASICALLY PROVIDE GUIDELINES FOR THE PHYSICAL LAYOUT AND THE DESIGN OF ALL DEVELOPMENT WITHIN THE CITY.

THESE PROVISIONS ADDRESS ANYTHING THAT IS RELATIVE TO INFRASTRUCTURE AS LISTED IN THE TITLE OF THE ORDINANCE.

ROADWAYS, PUBLIC RIGHTS OF WAYS AND ADDITIONAL ITEMS THAT MAY BE ASSOCIATED WITHIN THE DEVELOPMENT.

THE PURPOSE OF THIS TEXT AMENDMENT IS TO UPDATE THE CITY'S DEVELOPMENT AND DESIGN STANDARDS SO THAT THEY ALIGN WITH THE CITY'S ENGINEERING DESIGN MANUAL, IN ADDITION TO FIRE CODE SAFETY STANDARDS.

THESE PROVISIONS WILL ADDRESS SOME OF THE INFRASTRUCTURE THAT IS LISTED ON THE SCREEN BEFORE YOU.

I WON'T READ THEM ALL, BUT JUST IN GENERAL ROADS, SIDEWALKS, BICYCLE PATHS, STORM WATERS, AND THE BILLBOARD SIGNS.

WE'RE GOING TO GET INTO SOME CLARIFICATION OF SOME LANGUAGE LATER ON INTO THE PRESENTATION.

SECTION TEN 4.2.

THIS SECTION DEALS WITH TRANSPORTATION AND CONNECTIVITY.

AS YOU SEE, IF YOU LOOK DOWN IN BOLD AT THE RESIDENTIAL STREET SECTION, WHAT WE'RE DOING IS JUST OUTLINING SOME STANDARDS IN WHICH TRAFFIC LIMITING DEVICES THEY MUST BE APPROVED BY THE CITY IN THE USE OF SPEED CONTROL DEVICES SHALL BE ADMINISTERED THROUGH THE CITY'S TRAFFIC CALMING POLICY.

SO AS WE GO THROUGH THESE PRESENTATIONS, AS WE GO THROUGH THIS PRESENTATION, A NUMBER OF THESE ITEMS ARE BASICALLY TO ALIGN SOME OF THE DESIGN OF THE INFRASTRUCTURE WITH SOME OF THE POLICIES AND SOME OF THE STANDARDS THAT THE CITY ALREADY HAS IN PLACE.

IN ADDITION, FOR SINGLE FAMILY RESIDENTIAL, THE TEXT THAT IS HIGHLIGHTED IN RED AND UNDERLINED, THAT IS PERTAINING TO THE MINIMUM DIAMETER FOR CUL DE SACS.

SO CUL DE SACS REQUIRE A MINIMUM OF DIAMETER IS TO PERMIT TURNAROUND FOR FIRE TRUCK APPARATUSES.

IN ADDITION TO THE ENGINEERING STANDARDS AND THE FIRE SAFETY STANDARDS, THEY ALSO REQUIRE THESE MINIMUM DIAMETERS AS WELL.

SO THE CODE IS BEING AMENDED TO ALIGN WITH THOSE STANDARDS.

FOR MIXED USE AND RESIDENTIAL.

THIS SECTION IS BEING AMENDED.

IT DEALS WITH GUARD HOUSES AND AGAIN THIS IS FOR FIRE SAFETY CODE ACCESS.

THIS IS SO THAT WHEN THE EMERGENCY PERSONNEL HAS TO RESPOND TO A CALL IN THE DEVELOPMENTS THAT HAVE THESE GUARDHOUSES, THESE ARE JUST STANDARDS TO MAKE SURE THAT THEY'RE ABLE TO ACCESS THESE PROPERTIES.

SO THE MANUAL SECURITY DEVICES SHALL HAVE LOCKS AND THEY SHALL BE APPROVED BY TAMARAC FIRE RESCUE.

AND IF THEY ARE AUTOMATIC GATES, THEN THERE HAS TO BE AN OVERRIDE SO THAT THE FIRE APPARATUS CAN GAIN ACCESS TO THE DEVELOPMENT.

IN RELATION TO PEDESTRIAN CIRCULATION, THE DESIGN OF SIDEWALKS.

SO AGAIN, JUST ENSURING THAT THE SIDEWALKS ARE CONSTRUCTED WITH THE CONSTRUCTION AND ENGINEERING STANDARDS OF THE CITY AS WELL.

THIS SECTION HAS TO DO WITH THE DESIGN OF OFF STREET PARKING AND LOADING INFRASTRUCTURE, PARTICULARLY THE WIDTH OF THE AISLES FOR THE PARKING LOT DESIGN.

AND SO IF YOU GO AGAIN TO THE TEXT THAT'S HIGHLIGHTED IN RED, WHERE WE TYPICALLY USE NINE FEET FOR OUR PARKING STALLS INSTEAD OF TEN. SO AGAIN WE'RE JUST ALIGNING THIS WITH OUR TYPICAL DESIGN STANDARDS.

AND THEN THE AISLE WIDTHS DEPENDING ON THE ANGLE OF THE PARKING, IS ALSO BEING AMENDED TO ALIGN WITH OUR EXISTING DESIGN STANDARDS AS WELL.

IN REGARDS TO THE LANDSCAPING AND TREE PRESERVATION PORTION OF THIS CODE.

IF YOU AGAIN GO DOWN TO THE TEXT THAT'S HIGHLIGHTED IN RED, IT HAS TO DEAL SPECIFICALLY WITH IRRIGATION SYSTEMS AND WHAT THE CITY REQUIRES FOR IRRIGATION. SO ALL NEW DEVELOPMENTS SHALL USE NON-POTABLE WATER FOR IRRIGATION SOURCES, UNLESS A WAIVER IS RECEIVED FROM THE CITY ENGINEER.

SECTION 10- 4.5 DEALS WITH OUR ENVIRONMENTAL PROTECTION AND INFRASTRUCTURE AS WELL.

IF YOU GO DOWN AGAIN TO SECTION C, THAT'S FLOODPLAIN MANAGEMENT, AND THE CITY ENGINEER SHALL HAVE THE RIGHT TO REQUIRE A DEVELOPER TO SUBMIT ANY DOCUMENTS OR MATERIAL NECESSARY TO AID IN THE EVALUATION OF THE SUBJECT PROPERTY.

SOME WORK WAS DONE HERE IN THE DRAINAGE SECTION.

AGAIN, THE CITY IS JUST TAKING A STANCE TO BE ABLE TO ALIGN THESE DESIGN STANDARDS WITH OUR ENGINEERING DESIGN MANUAL THAT IS ADMINISTERED THROUGH THE CITY'S PUBLIC SERVICES DEPARTMENT.

SO THIS LANGUAGE IS BASICALLY BEING STRUCK TO ALIGN WITH THOSE DESIGN STANDARDS AND INDUSTRY BEST PRACTICES.

AND THEN THE SECTIONS WERE JUST RENUMBERED TO MAKE SURE THAT THE NUMERATION AND THE CODE WAS CONSISTENT.

IN REGARDS TO POTABLE WATER.

SECTION G.

OF THIS SECTION, THE DESIGN OF POTABLE WATER SYSTEMS AGAIN SHALL BE IN ACCORDANCE WITH THE CITY OF TAMARAC.

ENGINEERING AND DESIGN AND PROCESSING MANUAL AND APPROVED BY THE CITY ENGINEER AS WELL.

THE SAME FOR WASTEWATER TREATMENT SYSTEMS, JUST ENSURING THAT THESE WASTEWATER TREATMENT SYSTEMS ARE IN ALIGNMENT WITH THE ENGINEERING AND DESIGN MANUAL AND APPROVED BY THE CITY ENGINEER.

SECTION TEN DASH 4.10 NOW THAT WE'RE OUT OF A LITTLE BIT OF INFRASTRUCTURE.

SO SECTION TEN DASH 4.10 DEALS WITH THE CITY SIGN CODE ORDINANCES.

THIS PARTICULAR SECTION IS REALLY JUST BEING AMENDED FOR CLARIFICATION.

AT THE TIME THAT THE TEXT AMENDMENT WAS APPROVED, WE DID NOTE THAT THE PORTION OF I-75 THAT IS WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY OF TAMARAC IS ACTUALLY KNOWN AS THE SAWGRASS EXPRESSWAY.

SO THIS IS JUST CLARIFYING THAT THIS IS IDENTIFIED AS THE SAWGRASS EXPRESSWAY.

AND THIS IS WHERE IF THE CITY SO CHOOSES TO APPROVE A BILLBOARD SIGN IN THE FUTURE, THIS WOULD BE ONE OF THE PORTIONS OF RIGHT OF WAY WHERE IT WOULD BE PERMITTED.

IN REGARDS TO ALSO WHERE THEY ARE PERMITTED TO BE LOCATED, WE'RE JUST CLARIFYING THE AMOUNT OF DISTANCE THAT HAS TO BE BETWEEN THE SIGNS.

SO BILLBOARD STRUCTURES LOCATED MORE THAN 1500FT AWAY FROM READILY FROM RESIDENTIALLY ZONED PROPERTY MAY HAVE UP TO, BUT NOT MORE THAN TWO SIGN FACES.

SO THE CODE PREVIOUSLY DID NOT CLARIFY THE DISTANCE IF YOU HAD 1500 OR 1501.

SO WE'RE JUST CLARIFYING IT HAS TO BE MORE THAN 1500 FEET.

THIS SECTION DEALS WITH THE DESIGN CRITERIA OF MONUMENT SIGNS.

THE CODE SEPARATES THE PERMISSIBLE GRAPHIC HEIGHT AND SIGN HEIGHT FOR THESE SIGNS, BASED ON IF THE SHOPPING CENTER IS LESS THAN 64,999FT², OR IF THE SHOPPING CENTER CONTAINS MORE THAN 65,000FT².

SO THIS WAS A SCRIVENER'S AREA.

THIS IS JUST SOMETHING THAT WE'RE CORRECTING, JUST TO MAKE SURE THAT IT IS CLEAR THAT THERE IS A DISTINCTION BETWEEN THOSE SHOPPING CENTERS THAT CONTAINS THOSE SQUARE FOOTAGES.

SECTION 10- 4.11 HAS TWO I'M SORRY DEALS WITH THE SUBDIVISION DESIGN AND DEVELOPMENT STANDARDS.

IT DEALS WITH THE MINIMUM WIDTHS OF RIGHT OF WAY.

SO AGAIN STREETS THE PERMITTED WIDTH THE REQUIRED WIDTH, THE MAXIMUM WIDTH.

THIS IS WHAT THIS TABLE ALIGNS WITH.

THIS TABLE ALIGNS WITH THE CITY'S ENGINEERING AND DESIGN MANUAL AS WELL.

SO THAT TEXT HIGHLIGHTED IN RED IS JUST PROVIDING FURTHER CLARIFICATION FOR HOW WIDE THE PAVEMENT ACTUALLY HAS TO BE BASED ON THE CLASSIFICATION OF THE ROAD TYPE.

AND SECTION 12, ALSO DEALING WITH ALLEYS IN ALIGNMENT WITH THAT SAME ENGINEERING AND DESIGN MANUAL.

IT'S JUST CLARIFYING THAT THE WIDTH OF THE ALLEYS SHALL BE AT LEAST 24FT.

THIS IS TYPICAL IN THE CITY.

MOST THOROUGHFARES IN THE CITY ARE A MINIMUM OF 12FT ON EACH SIDE, SO YOU HAVE TRAFFIC THAT IS HEADING IN ONE DIRECTION, AND YOU MAY HAVE TRAFFIC THAT IS HEADING AGAINST IT IN ANOTHER DIRECTION.

SO IT'S JUST A REQUIREMENT THAT BOTH SIDES OF THOSE STREETS ARE AT LEAST 12FT IN WIDTH.

SO THE TOTAL WOULD BE 24FT.

SO IN THE STAFF REPORT THAT WAS SUBMITTED TO THE BOARD, THERE ARE CRITERIA AS IT RELATES TO THE APPROVAL OF THE TEXT AMENDMENT.

THE CRITERIA IS LISTED ON THIS SCREEN BEFORE YOU, AND THE DETAIL REGARDING HOW THIS AMENDMENT ALIGN ALIGNS WITH THOSE CRITERIA IS DETAILED IN THE STAFF REPORT.

THIS AMENDMENT ALSO IS IN I'M SORRY IS ALSO CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN.

IN ADDITION TO GOAL NUMBER TWO, KEEPING TAMARAC SAFE, ENSURING THAT THE INFRASTRUCTURE AND DESIGN STANDARDS ARE IN ALIGNMENT WITH THE CITY'S LAND DEVELOPMENT CODE.

ALSO, GOAL NUMBER THREE, WHERE TAMARAC IS ECONOMICALLY RESILIENT.

AGAIN, JUST MAKING SURE THAT OUR CODE PROVIDES CLARITY, MAKING SURE THAT IT IS IN ALIGNMENT WITH INDUSTRY BEST PRACTICES.

IN ADDITION TO ENSURING FIRE SAFETY AS WELL.

AS SUCH, THE DIRECTOR OF COMMUNITY DEVELOPMENT RECOMMENDS THAT THE PLANNING BOARD FORWARD A FAVORABLE RECOMMENDATION TO THE CITY COMMISSION TO ADOPT THE PROPOSED TEXT AMENDMENT TO CHAPTER TEN, ARTICLE FOUR OF THE CITY OF TAMARAC CODE OF ORDINANCES ON FIRST READING AT ITS DECEMBER 13TH, 2023 MEETING, AND ON SECOND READING AT ITS JANUARY 10TH, 2024 MEETING.

AND THAT CONCLUDES MY PRESENTATION.

THIS IS A MEDICAL OFFICE BUILDING WHERE PHYSICIANS HAVE THEIR CLINICS AND SEE PATIENTS ON OUR CAMPUS.

WE ACTUALLY DO NOT OWN THAT MEDICAL OFFICE BUILDING THAT IS OWNED BY A THIRD PARTY REAL ESTATE INVESTMENT TRUST.

AND THEY DO HAVE A MONUMENT SIGN THERE VERY CLOSE TO UNIVERSITY DRIVE, WHERE THAT BRONZE GOLD STAR IS LOCATED, AND THAT READS UNIVERSITY MEDICAL PLAZA, WHICH IS THE NAME OF THAT MEDICAL PLAZA.

WE ARE REQUESTING, OBVIOUSLY, TO PUT OUR MONUMENT SIGN SOUTHWEST OF THAT SIGN.

BUT IN NOVEMBER, AS THE PROJECT WAS JUST GETTING OFF THE GROUND, MR. DAPHNIS, THE OWNER, THE THE MAJORITY OWNER, THE FINANCER BECAME VERY ILL AND HE WAS HOSPITALIZED FOR TWO MONTHS.

WHEN HE WAS RELEASED FROM THE HOSPITAL, HE WAS ON BED REST.

WHEN HE FINALLY GOT OFF OF BED REST, HE LEARNED THAT THE KITCHEN CONTRACTORS THAT HE HAD HIRED HAD WALKED OFF THE JOB AND WANTED NO PART OF IT.

BY JUNE, HE WAS ABLE TO GET NEW KITCHEN CONTRACTORS.

BUT HE WAS HOSPITALIZED AGAIN.

HE WAS BEDRIDDEN AT HOME ON NURSES CARE.

NO WRONG WAY. I'M GOING TO GET THIS.

THEN IN MARCH OF 2000 LET'S GO BACK.

IN OCTOBER, HE WAS BEDRIDDEN WITH HOME WITH NURSES CARE JUST AS HE WAS GETTING ON HIS FEET, THE WORLD WASN'T, COVID HIT.

HE COULDN'T GET ANY WORKERS.

SPECIAL EXCEPTIONS ARE USES ALLOWED IN RESPECTIVE ZONING DISTRICT ONLY IF REVIEWED BY THE PLANNING BOARD AND APPROVED BY THE CITY COMMISSION.

THE PURPOSE OF THE SPECIAL EXCEPTION IS TO PROVIDE FOR INDIVIDUALIZED USE, REVIEW, OR CERTAIN USES THAT, DUE TO THEIR NATURE, RELATIONSHIP TO THE COMPREHENSIVE PLAN, AND POTENTIAL ADVERSE IMPACTS ON SURROUNDING AREAS, REQUIRE SPECIAL CONSIDERATION OF THEIR LOCATION, DESIGN AND METHODS OF OPERATION, AS WELL AS THE IMPOSITION OF CONDITIONS TO MITIGATE CONCERNS BEFORE THEY CAN BE DEEMED APPROPRIATE IN A ZONING DISTRICT AND COMPATIBLE WITH THEIR SURROUNDINGS.
