ACCOMPLISHMENTS AS WELL AS LOOK FORWARD TO OUR TAMARACK OF TOMORROW. I MEAN I ASK MY COLLEAGUES TO PLEASE JOIN ME IN THE WELL AND WE'RE GOING TO WATCH TWO VIDEO PROCLAMATIONS. THANK YOU. GONE DOWN. YOU MAY THINK YOU KNOW TAMARA. THE PARKS THE PEOPLE. BUT DO YOU KNOW ABOUT THE CHANGES AFOOT IN OUR CITY. THE MEDIAN AGE OF 48.

AND MORE MORE FAMILIES MOVING IN. TAMARA IS BEGINNING TO BLOSSOM EXPERIENCING A RESURGENCE THROUGHOUT THE CITY THAT WILL CARRY US TO NEW HEIGHTS. QUIETLY AND WITHOUT A LOT OF FANFARE. TAMARA KEITH HAS BEEN LAYING THE GROUNDWORK FOR THE STEPS NEEDED TO ENSURE A BRIGHT AND PROSPEROUS FUTURE. CONSTRUCTION HAS STARTED ON THE CITY'S NEW DOWNTOWN TAMARA VILLAGE. AND WE CAN LOOK FORWARD TO RESIDENTIAL DINING PARKS AND SHOPS. THERE'S A NEW CLUBHOUSE IN THE WORKS FOR COLONY WEST AS WELL AS A MARRIOTT BRANDED HOTEL. AND MORE AND MORE MAJOR BUSINESSES ARE CALLING TAMARA HOME.

WE CELEBRATED THE GRAND OPENING OF UNIFORM IN INTERNATIONAL PHARMACEUTICAL COMPANY THAT BELIEVE SO STRONGLY IN OUR CITY THAT THEY'VE INVESTED A HUNDRED AND FIFTY MILLION DOLLARS. INTO THEIR STATE OF THE ART FACILITY. SO WHAT IS IT THAT EVERYONE SEES IN TAMARA. WE'RE AGILE RESILIENT AND FOCUSED ON THE FUTURE AND IT SHOWS. PEOPLE ARE REALIZING THAT FOR TAMARA. THE TIME. IS NOW. A COMMUNITY CAN BE MEASURED BY THE ATTENTION IT PAYS TO THE MOST VULNERABLE IN OUR POPULATION THE YOUNG AND THE OLD.

OF PRIMARY IMPORTANCE IS PUBLIC SAFETY. ENSURING THAT IN EVERY AREA OF TAMARA

[00:05:05]

PEOPLE NOT ONLY ARE SAFE THEY FEEL SAFE. IN 2018 OUR OVERALL CRIME RATE FELL SEVENTEEN POINT ONE PERCENT. WE EXPERIENCED THE LOWEST NUMBER OF BURGLARIES SINCE 2003 AND VSO REPORTS THE LOWEST NUMBER OF ROBBERIES IN 24 YEARS. WE HIRED 10 FIREFIGHTERS TO ENABLE US TO PLACE AN ADDITIONAL RESCUE UNIT IN SERVICE. AND TAMARA. FIRE RESCUE AND VSO JOINED FORCES TO CONDUCT LIVE ACTION EMERGENCY DRILLS TO BE BETTER PREPARED SHOULD THE UNTHINKABLE HAPPENED. ANOTHER KEY AREA OF FOCUS IS OUR SCHOOLS. WE CONTINUE TO WORK WITH THEM AND OUR STAKEHOLDERS TO IMPROVE OUR STUDENTS EDUCATIONAL OPPORTUNITIES. WAIT A MINUTE PHYS THE TAMARA HOOK ELEMENTARY HAS REQUESTED THE ADDITION OF TWO VIP K CLASSES FOR THE NEXT SCHOOL YEAR. THANKS TO A PUBLIC PRIVATE PARTNERSHIP. THE EXTERIOR OF TAMARACK ELEMENTARY WAS RECENTLY TRANSFORMED FROM DRAB TO FAB. AND WE'VE LAID THE FOUNDATION FOR AN EDUCATION INITIATIVE THAT WILL BRING TOGETHER MULTIPLE OUTSIDE RESOURCES TO SUPPORT ONGOING SCHOOL NEEDS. A LOT OF THE WORK THAT WE'VE BEEN DOING IS FOCUSED ON THE BASICS ENSURING AN OUTSTANDING QUALITY OF LIFE IN TAMARACK EVERY DAY FROM TECHNOLOGY TO INFRASTRUCTURE TO CIVIC INVOLVEMENT.

SOME OF IT IS NOT ALL THAT GLAMOROUS BUT IT IS CRITICAL. OUR INFLOW AND INFILTRATION PROGRAM ENSURES THE LONG TERM INTEGRITY OF THE MILES OF SEWER LINES THAT SERVICE OUR CITY. WE CONTINUE CONSTRUCTION OF BUFFER WALLS ON MAJOR ROADWAYS PROVIDING AN ATTRACTIVE VISUAL AS WELL AS SOUND BARRIER. WE'VE COMPLETED FORTY EIGHT HUNDRED LINEAR FEET WITH ANOTHER 20000 STILL TO COME. WE PROVIDED OVER TWENTY THOUSAND DOLLARS IN GRANTS FOR NEIGHBORHOOD BEAUTIFICATION AND WE PROVIDED FUNDING TO HELP THOSE IN THE MAKE NECESSARY REPAIRS TO REMEDY CODE VIOLATIONS. WE ALSO RECOGNIZE THOSE PEOPLE IN EACH DISTRICT WHO ARE MAKING AN EXTRA EFFORT TO BEAUTIFY THEIR PROPERTIES. HONORING A TOTAL OF 20 HOMEOWNERS AND BUSINESSES. WE LAUNCHED OUR REDESIGNED WEB SITE AND DEPLOYED A MOBILE APP TO MARK TO GO. TO MAKE CONNECTING WITH THE CITY EVEN EASIER. WE MADE IT EASIER TO GET IN SHAPE WITH A COMPLETE RENOVATION OF A CAP OR A LA FITNESS CENTER. TAMARA SPONSORED THE VOLUNTEER INCOME TAX ASSISTANCE PROGRAM. SERVING MORE THAN THIRTEEN HUNDRED PEOPLE. WE PARTNERED WITH HISPANIC UNITY. FOR FAMILY FUN DAY AT THE AQUATIC CENTER TO PROMOTE VOTER REGISTRATION AND WE'VE BROKEN GROUND ON THE LONG AWAITED WATER'S EDGE PARK JUST OFF UNIVERSITY DRIVE. IT WILL FEATURE A SPLASH PAD BASKETBALL AND VOLLEYBALL COURTS A FISHING PIER AND FITNESS STATIONS. WE'RE TAKING CARE OF THESE NEEDS WHILE KEEPING A SHARP EYE ON THE FUTURE A FUTURE WHICH REFLECTS SMART GROWTH THROUGHOUT THE CITY. OUR LAND DEVELOPMENT CODE IS MORE USER FRIENDLY.

WHILE THE NEW ZONING AND LAND USE MAPS ENSURE THE RIGHT PROJECT IS DEVELOPED IN THE RIGHT PLACE. TAMARACK CONTINUES TO SUPPORT THE GROWTH AND DEVELOPMENT OF NEW BUSINESSES THROUGHOUT THE CITY. AS WELL AS ENSURE OVERALL SAFETY OF OUR BUILDINGS.

WE'VE WORKED TO MAINTAIN THE ISO RATINGS WHICH ALLOW RESIDENTS AND BUSINESS OWNERS TO GET A 20 PERCENT DISCOUNT ON THEIR FLOOD INSURANCE POLICIES. WE HAVE INSTITUTED A NEW BUSINESS ONE STOP SHOP FOR OUR BOSS PROGRAM WHICH ALLOWS PROSPECTIVE TENANTS TO OBTAIN INFORMATION ABOUT VIOLATIONS OR LEASE ON RENTAL SPACE BEFORE THEY SIGN A LEASE. THE BUILDING DEPARTMENT ISSUED EIGHT THOUSAND ONE HUNDRED AND FIFTY ONE PERMITS IN 2013 INCLUDING THOSE FOR THE NEW HOMES IN MENLO PARK AND HIDDEN TRAILS AS WELL AS THOSE IN MIND. AND THEY PERFORMED ALMOST 24000 INSPECTIONS. WE NOT ONLY FOCUS ON THE DAY TODAY BUT ON CELEBRATING ALL WHO CHOOSE TO CALL TAMARACK HOME. WE HONORED THE LEGACY OF DR. MARTIN LUTHER KING JUNIOR WAS A FULL HOUSE ENJOYING A MOTIVATIONAL PRESENTATION FROM THE MUSICIAN WITH A MESSAGE SAW PAUL AND WE CELEBRATE THE MANY FACES AND MANY VOICES WHICH MAKE UP OUR COMMUNITY. AT THE ANNUAL ONE TIME ROCK MULTICULTURAL FESTIVAL. TAMARACK IS A VIBRANT AND PROGRESSIVE COMMUNITY DUE IN LARGE PART TO HAVING DONE THE HARD WORK NECESSARY TO BUILD AND MAINTAIN A STRONG FINANCIAL PROFILE. WE OBTAINED A DOUBLE A

[00:10:02]

RATING FROM STANDARD AND POOR'S FOR THE CITY'S 9 AS THE LURE OF REVENUE CREDIT.

WE'VE ISSUED OVER 18 MILLION DOLLARS IN BONDS TO FINANCE A PERMANENT FIRE STATION ON UNIVERSITY DRIVE BUILD WATER'S EDGE PARK AND PROVIDE ADDITIONAL BUFFER WELLS THROUGHOUT THE CITY AND WE SUCCESSFULLY NEGOTIATED A THREE YEAR COLLECTIVE BARGAINING AGREEMENT WITH THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS. I CONTINUED GROWTH THROUGHOUT THIS CITY MEANS INCREASED CONTRIBUTIONS FROM DEVELOPERS TO THE PUBLIC ART FUND. THAT MONEY IS WHAT PAID FOR THE BEAUTIFUL NEW SCULPTOR NAMED VEVO ON COMMERCIAL BOULEVARD. THE NAME MEANS BRIGHT LIVELY AND INTENSE AND THAT'S JUST WHAT THIS TRADITION IS. IT REPRESENTS A NATURAL LANDSCAPE WITH A SEA CONFINED ASPECT THAT REVEALS SOMETHING DIFFERENT EVERY TIME YOU LOOK AT IT. WE'VE ALSO BEGUN THE CITY'S PUBLIC ART MURAL PROGRAM THE FIRST INSTALLATION WAS AT MAINLAND'S PARK WITH ADDITIONAL MURALS COMING TO THE SPORTS COMPLEX AND TAMARACK COMMUNITY CENTER AND WE'VE COMPLETED THE FIRST INSTALLATIONS IN OUR NEIGHBORHOOD COMPREHENSIVE SIGNAGE PROGRAM. THEY FOSTER A SENSE OF PLACE AND LET YOU KNOW THAT YOU'RE IN TAMARA. SO YOU SEE THERE'S A LOT GOING ON IN OUR CITY FROM NEW LIFE FOR OUTDATED SHOPPING PLAZAS TO HOUSING OPTIONS FOR A BROAD SPECTRUM. TO PROGRAMS AND SERVICES FOR EVERY SEGMENT OF OUR COMMUNITY. IT IS HAPPENING HERE. FOR ANYONE BUILDING A FAMILY BUILDING A BUSINESS OR EVEN THINKING ABOUT BUILDING A LIFE IN TAMARA. THE TIME. IS NOW. HIGH.

THIS IS MY FIRST OPPORTUNITY TO DISCUSS THE STATE OF OUR CITY. AS YOUR MAYOR. AND I COULDN'T BE MORE EXCITED ABOUT WHERE WE ARE AND MORE IMPORTANTLY WHERE WE'RE HEADED. OVER 40 YEARS AGO MY GRANDPARENTS MOVED TO TAMARA. AND I HAD THE PLEASURE OF VISITING THEM OFTEN OVER THE YEARS. THEN IN JULY 1994 I DECIDED TO MOVE HERE AS WELL. ALL THOSE ONLY GOING TO BE FOR A YEAR NOW. TWENTY FIVE YEARS LATER I STILL HAPPILY CALL TAMARA HOME. I STAYED BECAUSE I SAW THE CHANGES STARTING IN OUR CITY.

IT'S NOT MY GRANDPARENTS TAMARA ANY LONGER. OUR CITY IS GROWING YOUNGER AS IT GROWS OLDER MORE DIVERSE AND INCLUSIVE. A MULTIGENERATIONAL CITY WHERE THE MEDIAN AGE IS 48 AND 19 PERCENT OF OUR RESIDENTS ARE CHILDREN. WE'RE EVOLVING AND THERE'S EXCITEMENT ABOUT OUR FUTURE AND WHY NOT JUST LOOK AT OUR STRENGTHS. FINANCIAL RESILIENCE A RICH CROSS-SECTION OF CULTURES A CENTRAL LOCATION AND UNTOLD POTENTIAL OUR POPULATION INCREASED OVER 8 PERCENT IN 2018 AND THE BUSINESS COMMUNITY IS ACTIVELY SEEKING OPPORTUNITIES IN TAMARA. THEY APPRECIATE THE REASONABLE COSTS OF REAL ESTATE THE GROWING POOL OF SKILLED WORKERS AND THE EASE OF DOING BUSINESS WE'RE CAPITALIZING ON OUR SUCCESSES IN ADDITION TO THE PUBLIC PRIVATE PARTNERSHIPS WHICH HAVE MADE TAMARA VILLAGE AND THE REDEVELOPMENT OF COLONY WEST A REALITY. WE'RE ALSO FOCUSING ON OUR ECONOMIC DEVELOPMENT EFFORTS ON THE AGING AND UNDERUTILIZED SHOPPING CENTERS WHICH DOT THE LANDSCAPE. AND SLOWLY NEW LIFE IS BEING BREATHED INTO THESE AREAS. A SITE PLAN HAS BEEN SUBMITTED FOR THE REDEVELOPMENT OF THE PLAZA ON THE NORTH EAST CORNER OF PINE ISLAND AND MCNABB.

WE'VE ALSO BEEN SELECTED BY THE URBAN LAND INSTITUTE FOR A PROGRAM WHICH ALLOWS US TO PARTNER WITH THE INDUSTRY EXPERTS TO FIND ADDITIONAL STRATEGIES TO MAKE THESE PROPERTIES VIABLE AGAIN. WE'RE FOCUSING GREATER ATTENTION ON THE ISSUES WHICH ARE VITAL NOT ONLY TO ECONOMIC DEVELOPMENT BUT TO THE SUSTAINED OVERALL HEALTH OF OUR CITY. A KEY COMPONENT IS THE QUALITY OF THE SCHOOLS THAT SERVE TAMARACK STUDENTS.

WHILE WE HAVE NO DIRECT CONTROL. WE'RE BUILDING RELATIONSHIPS WITH BOTH THE SCHOOL BOARD AND THE SCHOOLS TO FIND WAYS TO ENHANCE OUR EFFORTS. OUR CONNECTION WITH THE CHILDREN'S SERVICES COUNCIL HAS ALREADY LED TO MULTIPLE BEAUTIFICATION PROJECTS BY VOLUNTEERS TO ENHANCE THE OVERALL APPEARANCE OF TAMARACK ELEMENTARY TRANSPORTATION AND TRAFFIC CONGESTION CONTINUE TO WEIGH HEAVILY ON THE OVERALL QUALITY OF LIFE IN THE CITY AS WE PLAN FOR THE FUTURE. WE'RE WORKING HAND-IN-HAND WITH BROWARD COUNTY EFFORT AND THE BROWARD MPO TO CAPITALIZE ON THEIR EXISTING PROJECTS AND ENSURE THAT MONEYS FROM THE TRANSPORTATION SURTAX BRING BENEFITS TO TAMARA. AS OUR REPUTATION AS A WONDERFUL PLACE TO LIVE OR WORK CONTINUES TO GROW.

WE NEED TO ENSURE THAT THE CITY GROWS INTELLIGENTLY THAT THE PROJECTS BROUGHT FORWARD ARE THE RIGHT FIT FOR TAMARACK. NOW AND WELL INTO THE FUTURE. ONE AREA THAT HOLDS TREMENDOUS POTENTIAL IS THE CONCEPT OF TAMARACK AS A PHARMACEUTICAL HUB. FIVE YEARS AGO WHEN THE INTERNATIONAL PHARMACEUTICAL MANUFACTURER A UNIT PHARMA WANTED TO EXPAND TO AMERICA. THEY LOOKED LONG AND HARD FOR A LOCATION AND THEY

[00:15:03]

CHOSE TAMARA AND WE ARE GLAD THEY DID BECAUSE YUNA PHARMA REPRESENTS ONE OF THE GREATEST BUSINESS SUCCESS STORIES IN OUR CITY. THEIR STATE OF THE ART MANUFACTURING PLANT NOW SERVES MAJOR CLIENTS INCLUDING CBS WALGREENS AND WAL-MART. THEIR SUCCESSES CAME BECAUSE THEY HAD A VISION. AND WHAT THEY'RE SEEING FOR TAMARACK IS EXCITING. OUR CITY AS AN INTERNATIONAL PHARMACEUTICAL HUB AND THEY'RE RIGHT WE HAVE AN IDEAL LOCATION SPACE FOR NEW FACILITIES AND PLENTY OF OPPORTUNITY. IT'S A CONCEPT WE CAN ALL SUPPORT AS THE CITY GOVERNMENT LEVEL. WE FIX PROBLEMS. WE FIND SOLUTIONS AND WE PLAN FOR THE FUTURE. WE'VE BEEN ABLE TO ACCOMPLISH SO MUCH FOR OUR RESIDENTS AND BUSINESSES DUE IN LARGE PART TO THE UNFLAGGING EFFORTS OF OUR CITY EMPLOYEES. FOR THEM. TAMARACK IS MORE THAN A JOB IT'S A CALLING TO SERVE DAY IN AND DAY OUT WHILE YOU REGULARLY SEE THE RESULTS OF THEIR HARD WORK. THEIR EFFORTS ARE ALSO RECOGNIZED ON THE LOCAL AND NATIONAL LEVEL. TAMARACK FIRE DEPARTMENT INCLUDES BROWARD COUNTIES 2018 FIRE INVESTIGATOR AND FIRE INSPECTOR OF THE YEAR AND BOTH FLORIDA'S FIRE MARSHAL AND FIRE INSPECTOR OF THE YEAR. OUR BUILDING DEPARTMENT IS HOME TO BROWARD CHIEF PLUMBING AND CHIEF ELECTRICAL INSPECTORS OF THE YEAR THE PARKS DEPARTMENT RECEIVED AN AWARD OF EXCELLENCE. THE NATIONAL ASSOCIATION OF YOUTH SPORTS AND THEY LED TAMARACK TO OUR EIGHTH YEAR AS PLAYFUL CITY USA. ALSO OUR SENIOR CENTER HAS BEEN RECOGNIZED AS BEST IN ST.. CAMERA I.T.

DEPARTMENT CONSISTENTLY RANKS AMONG THE TOP CITIES IN THE NATIONAL DIGITAL CITY SURVEY. AND OUR FINANCE DEPARTMENT WAS AWARDED THE CERTIFICATE OF ACHIEVEMENT FOR EXCELLENCE IN FINANCIAL REPORTING FOR THE 30TH CONSECUTIVE YEAR. SO WHILE TAMARACK IS NOT EXACTLY THE SAME PLACE MY GRANDPARENTS FELL IN LOVE WITH IN THE 70S. I HAVE NO DOUBT THAT THEY'D STILL HAVE CHOSEN TAMARACK IF MOVING HERE TODAY. TAMARACK IS A WONDERFULLY VIBRANT CITY WITH UNLIMITED POTENTIAL FOR EVERYONE. THAT'S WHY WE'LL BE FOCUSING EVEN MORE ON ENGAGING YOU THE COMMUNITY TO ENSURE THAT WE'RE BUILDING TOWARDS A TIME RACK OF TOMORROW THAT YOU WANT TO SEE. WE HOPE THAT YOU'LL PARTICIPATE. WE'RE A WONDERFUL BLEND OF AGES AND CULTURES UNITED WITH A COMMON GOAL OF A BETTER TAMARA. I LOOK FORWARD TO WORKING WITH THE REST OF THE COMMISSION AND THE ENTIRE COMMUNITY TO MAKE THIS A REALITY. THERE'S A RENEWED SENSE OF OPTIMISM IN OUR CITY WITH GOOD REASON. BECAUSE TRULY POOR TAMARA. THE TIME IS NOW ABOUT. THESE EXOTIC OKAY. THANK YOU VERY MUCH. HOPE YOU ENJOYED THE VIDEO AS MUCH AS WE ENJOYED. CREATING IT AND NOW WE'RE GOING TO TAKE TIME TO RECOGNIZE THE INDIVIDUALS WHO HAVE BEEN SELECTED AS OUR HONOREES FOR THE 2019. BLACK HISTORY MONTH. SO WE'LL DO A PROCLAMATION WE'LL CALL YOU UP AND THEN I WILL. WE WILL HAND YOU YOUR GIFT BASKET. I SURVEYED WHAT THE CITY WAS DOING FOR FOR OUR PEOPLE AND THE CITY WAS DOING SUCH A TREMENDOUS JOB. BUT I THOUGHT ED THAT WE SHOULD DO A LITTLE BIT MORE. SO WE CAME UP WITH THIS IDEA. I CAME UP WITH THIS IDEA CHAMPIONED BY MY COLLEAGUES AS WELL TO OFFER THOSE PEOPLE WHO ARE IN OUR COMMUNITY THAT ARE SERVING AND DOING SUCH A GREAT JOB TO HAVE THEM IN SUCH A WONDERFUL AND WELL-DESERVED PROCLAMATION. SO I WANT TO GIVE THEM A SPECIAL THANK YOU FOR MAKING SURE THAT THIS IS POSSIBLE TONIGHT CAN GIVE THEM A ROUND OF APPLAUSE. THERE ARE THERE ARE SO MANY AFRICAN-AMERICANS WHO HAVE GONE BEFORE US AND HAVE DONE SO MUCH GOOD WORK IN OUR COMMUNITY. BUT I FELT THAT THERE ARE PEOPLE IN OUR COMMUNITY IN WHITE ABROAD THAT ARE ALSO DOING SUCH A GREAT JOB TO STRENGTHEN OUR COMMUNITY. [01:05:02]

COMMISSION REPORTS OR WEIGH THEM FOR THE EVENING. I WILL ONLY MAKE ONE COMMENT IF I CAN TO SAY THAT WE HAD AN EXCELLENT DOMINOES TOURNAMENT AND MAYOR EZELL ROGERS IS NOT HERE TO ENJOY THE WAY SHE BEAT ME. SHE BEAT ME VERY WELL. SO WE'LL TALK MORE ABOUT THAT AT ANOTHER TIME. BUT IT WAS A WONDERFUL EVENT. SO WE ARE GOING TO MOVE ON ONTO THE CITY ATTORNEY'S REPORT PLEASE OK. THANK YOU MADAM MAYOR. COMMISSIONERS GIVEN THE FACT THAT A LOT OF WAIVERS THIS EVENING AND CONCEDING OF TIME. WHAT I'M GOING TO SUGGEST IS WE JUST SENT OUT THE MOST RECENT REPORT ON THE PENDING LEGISLATION FOR 2019 WHICH I'VE DISCUSSED WITH YOU VERY BRIEFLY BUT WHEN WE GET TO A JUNCTURE WHERE THERE'S MORE TIME AND ATTENTION AVAILABLE TO TALK ABOUT IT I WANT YOU TO TAKE A LOOK AT SENATE BILL 5 18 AND HOUSE BILL 265 ON THE ISSUES OF SUNSHINE LAW. AND NOTICE ON PUBLIC MEETINGS HAVING SPENT ABOUT SIX PLUS HOURS OF MY TIME TODAY IN A DEPOSITION AS A DAY OPPONENT WHICH MEANS I WAS BEING DEPOSED ON A SUNSHINE LAW CASE IN GREAT PART THIS POTENTIAL BILL HAS SIGNIFICANCE WHICH IMPACTS THE CITY COMMISSION WITHOUT GETTING INTO GREAT DETAIL TONIGHT. IT'S A BILL WHICH APPARENTLY HAS SOME LEGS IT HAS IT BOTH HOUSE AND SENATE SPONSOR. IT'S A REBIRTH OF A DOCUMENT THAT WAS FILED LAST YEAR THAT THAT FAILED BECAUSE OF A LACK OF A CO-SPONSOR. JUST ONE LITTLE PIECE OF INTERESTING INFORMATION ABOUT THIS BILL.

IT NOT ONLY REQUIRES COMMISSIONERS TO RESPOND TO THE PUBLIC IN CONNECTION WITH REQUESTS MADE BY THE PUBLIC AT A PODIUM REQUIRES A RESPONSE THAT THE LAW DOES NOT REQUIRE THAT OF ANYTHING IN THE CONTEXT OF WHAT YOU SIGNED ON FOR. AND IF YOU CONDUCT A MEETING WITHOUT THE TRAPPINGS AS REQUIRED BY THIS BILL WITH REGARD TO POSTING A NOTICE AND DELIVERY OF AGENDAS IN MANY OF THE THINGS THAT ARE SET FORTH IN THE DOCUMENT. AGAIN SUBJECT PUBLIC OFFICIALS TO NOT JUST A CIVIL INFRACTION OF 500 HOURS PER INFRACTION WHICH IS A CIVIL INFRACTION VIOLATION OF SUNSHINE LAW OR IT CAN BE A CRIMINAL PENALTY TO ATTEND A MEETING AT WHICH THE TRAPPINGS AS SET FORTH IN THE PROPOSAL ARE NOT MET WHICH INCLUDES SUCH THINGS AS THREE DAYS ADVANCED NOTICE OF ALL SUCH MEETINGS AND SUCH NOTICE MUST INCLUDE PUBLICATION OF ALL AGENDA ITEMS IN ANY MATERIALS OR ATTACHMENTS THAT WILL BE DISTRIBUTED AT THE MEETING. THE BORDER COMMISSION MAY SCHEDULE AN EMERGENCY MEETING IF 24 HOURS ADVANCE NOTICE IS PROVIDED IF NECESSARY. THE BORDER COMMISSION MAY AMEND THE MEETING AGENDA AFTER THE INITIAL PUBLICATION AND IT TALKS ABOUT DELIVERY OF DOCUMENTS AND EXEMPTS CERTAIN KINDS OF THINGS FROM THE AGENDA GIVES THE PUBLIC SOME ADDITIONAL RIGHTS AND RESPONSIBILITIES. BUT THE INTERESTING FEATURE ABOUT THE BILL IS IT PROVIDES PENALTIES TO THE SITTING MEMBERS OF THE COMMISSION PUBLIC BODY FOR NOT COMPLYING WITH THE WITH THE PROPOSAL WHICH I THINK IS QUITE DRACONIAN QUITE FRANKLY. BUT I'LL SHARE THAT WITH YOU LATER WE'LL TALK MORE ABOUT THE PROPOSAL COMING IN. AS THEY EVOLVE AT THE NEXT MEETING WE'LL BE PREPARED TO GIVE YOU A MORE IN-DEPTH ANALYSIS OF SOME OF THE BILLS THAT HAVE NO LITIGATION REPORT TO WELCOME. WELCOME TO WEDNESDAY EVENING. THANK YOU FOR THE OPPORTUNITY AND A PLEASURE TO BE WITH YOU. THANK YOU VERY MUCH. THANK YOU VERY MUCH. WE WILL NOW MOVE TO THE CITY MANAGER'S REPORT. I HAVE ALL THE DOCUMENTS. OK. IT'S IT'S COMICAL IT'S

[01:15:03]

COMICAL. SO ANYHOW I JUST WANT TO FINISH UP IF I COULD. I WANT TO TALK ABOUT WHAT'S HAPPENED TO US. A LOT OF REALLY GOOD THINGS GOING ON. WOULD MIND CONTINUES TO BE AN IRRITANT FOR US IN THE COMMUNITY OF SHANGRI-LA. THERE'S MANY THINGS GOING ON AND I'M JUST GOING TO KIND OF CLOSE IT AT THIS. YOU KNOW YOU TALK ABOUT SAFETY WE TALK ABOUT AMNESTY AND WHY WE SHOULD MOVE. I HAD A CALL SHERIFF GLASSMAN ME PERSONALLY FOUR TIMES IN THE LAST THREE WEEKS. WHAT TRESPASSING ETC CETERA ET CETERA. OK. IT'S NOT A PARK. WE HAVE LOTS OF PARKS I WANT TO SAY ONE MORE THING TOO I KEEP ON SAYING THAT AT LEAST ONE OF THE COMMISSION MEETINGS WE SAID WE DO. WE DEDICATE BRIAN TEMPORARY PARK AND I'M UP FOR THAT. THE POLICE NEED TO BE RESPECTED TO SAY ONLINE THOSE PIGS SO ALL THEY WANT TO DO IS COLLECT INCOME IS REALLY INSULTING. MAYBE I SHOULD GO SPEAK WITH LAURYN HILL AND ASK THEM FOR SOME ASSISTANCE. AND THERE WAS A REPRESENTATIVE HERE FROM LORI HILL TODAY ON THE COMMISSION AND THEY ARE PLAYED A LITTLE DIFFERENT THAN WE DO. I WAS QUITE SURPRISED. THANK YOU FOR LETTING ME SPEAK BECAUSE I GOT TO A NUMBER OF YOU. AND THE REASON YOU HEAR ME IS BECAUSE I DO COME TO YOU. AND WE APPRECIATE THAT. I THINK YOU DO. AND AGAIN THIS IS THE CLOSE RESIDENTS OF TAMARACK AND EMPLOYEES UNLIKE BILL CLINTON RESIDENT EMPLOYEES OF. TAMARACK. YOU REALLY DON'T KNOW HOW SPECIAL. THIS COMMISSION IS IN COMPARISON TO WHERE I HAD TO SPEAK WHERE I WENT AS A CITIZEN TO SPEAK AND I WAS TOLD I GOT TO SPEAK TO SOME NICE PEOPLE THAT EVERYTHING WAS GOING REAL GOOD IN LAUDER HILL. OK SO WE'LL LEAVE IT AS THAT. OK. THANK YOU SO MUCH FOR LISTENING TO ME PLEASE. WHEN IT COMES TO ME DON'T TRY TO TREAT ME AND SOME OF MY FAMILY LIKE JUST LIKE IDIOTS AND THINK WE DON'T KNOW. THANK YOU SO MUCH. THANK YOU VERY MUCH. IS THERE ANYBODY ELSE WHO HAS NOT SIGNED UP WHO WISHES TO SPEAK. PETER MARES. COME ON NOW. THANK YOU MADAM. PETER MASON 1 1 6 2 0 NW SECOND DRIVE CORAL SPRINGS 3 3 0 7 1. GOOD EVENING MADAM MAYOR. COMMISSION COME HERE WITH HUGE THANKS FOR THE INCREASE IN SPONSORSHIP FOR THE BUSINESS TO BUSINESS ACTS BOTH THAT WE HAD ON FEBRUARY 1ST IT WAS A FANTASTIC EVENT WITH OVER 200 ATTENDEES THIRTY FIVE TABLE TOPS AND SPONSORS WE HAD THREE SPONSORS AND THREE TREMENDOUS PRESENTATIONS GIFT CLIENTS ON HOW TO DO BUSINESS WITH THE CITY OF TAMARACK WE GAVE SMALL BUSINESS AN OPPORTUNITY TO SIGN UP THERE AND THEN I THOUGHT THAT THE CITY OF TAMPA BOOTH WAS GREAT AND THE WHOLE EVENT WAS A GREAT SUCCESS IT WAS A THIRD ANNUAL. SO ON BEHALF OF THE BOARD OF DIRECTORS AND THE MEMBERSHIP. THANK YOU FOR THE SPONSORSHIP AND WE LOOK FORWARD TO PLANNING FOR NEXT YEAR. THANK YOU. THANK YOU VERY MUCH. IT WAS AN EXCELLENT EVENT. IS THERE ANYONE ELSE WHO WISHES TO SPEAK ALL RIGHT. SEEING THAT THERE IS NO ONE ELSE WHO WISHES TO SPEAK PUBLIC PARTICIPATION IS NOW CLOSED.

I'M GOING TO MOVE TO THE CONSENSUS AGENDA. ASSISTANT CITY MANAGER GUNN IS THERE ANY ARE THERE ANY CHANGES OR ADDITIONS. THERE'S NOT ATTORNEY SAM ONE.

NOT TO MY KNOWLEDGE MADAM MAYOR. DO YOU WANT TO PULL THIS ITEM YOU WANT TO PULL THE ITEM. YES. OKAY. COMMISSIONER YELLEN HAS ASKED TO PULL AN ITEM WHICH ITEM WOULD YOU LIKE TO CALL THE ONLY ITEM. WELL ACTUALLY WE HAVEN'T SENT TEAM. WELL WE HAVEN'T. NO I'M SORRY. ITEM C I DON'T SEE. OK COMMISSIONER HOGAN HAS REQUESTED TO PULL TR 1 3 2 2 9 CITYWIDE AGE BACK REPLACEMENT BID NUMBER 18 DASH TO R B.

[01:20:06]

SEEING THAT THIS ONE ITEM IS PULLED DO I HAVE A MOTION TO APPROVE THE CONSENT AGENDA AS AMENDED SO MOVE I CAN'T CALL THE ROLL. YES. YES. NICE NAME. YES. MARIO GOMEZ. YES. CONSENT AGENDA PASSED AS AMENDED. THANK YOU AND I WILL NOW. ITEM SIX SEE WHICH IS AND MADAM MAYOR THE RECORD TO GET 60 ON THE TABLE FOR CONVERSATION. I NEED YOU WRITTEN THE TITLE INTO THE RECORD WITH YOUR PERMISSION. YES PLEASE. MAYOR MARIN COMMISSION. ITEM NUMBER 60 AS POLLED BY COMMISSIONER BY THE COMMISSIONER BY COMMISSIONER YELLEN IS IN FACT TR PROPOSED TR 1 3 2 2 9. ITS RESOLUTION OF THE CITY COMMISSIONER OF THE CITY TAMARACK FLORIDA WORDING BID NUMBER 18 DASH TWENTY THREE RB TO AND APPROVING AGREEMENTS WITH H VAC INC. THAT'S HIGH BACK PART ME AND MASTER MECHANICAL SERVICES INC. FOR THE REPLACEMENT OF THE H FAX UNITS IN VARIOUS CITY FACILITIES FOR A COMBINED TOTAL CONTRACT AMOUNT OF FIFTY FIVE SEVENTY ONE TO THIRTY TWO EVEN IN A COMBINED CONTINGENCY AN AMOUNT OF FIFTY SEVEN THOUSAND ONE TWENTY THREE WHICH WILL BE ADDED TO THE PROJECT FOR A TOTAL BUDGET OF SIX TWENTY EIGHT 355 FLAP AUTHORIZING AN APPROPRIATION AN AMOUNT NOT TO EXCEED NINETY FOUR THOUSAND SEVEN NINETY EIGHT TO FUND SAID PROJECT PROVIDING FOR CONFLICT BETTER PRESENT VIABILITY AND PROVIDING HER EFFECTIVE DATE THANK YOU. AT THIS TIME THIS ITEM IS OPEN FOR DISCUSSION AS COMMISSIONER GALEN HAS PULLED IT INTO MOTION APPROVE MADAM MAYOR TO GET THE DISCUSSION GOING. ALL RIGHT I NEED A MOTION AND A SECOND PLEASE MOTION. SO. I THINK WE'RE NARROWING DOWN THE MICROPHONE TO BEING COMMISSIONER FISHMAN'S THAT IS FUZZING OUT. OK SO THIS ITEM I JUST HAVEN'T HAD A CHANCE TO TALK TO MIKE ABOUT IT AND WHEN I REVIEWED THE INFORMATION I SAW THERE WAS INITIAL RFP THAT WAS I GUESS THE VENDOR PULLED OUT OF IT OR IF SHE WAS THIS IS THE MIDDLE I KNEW OUR FEE WAS ISSUED AND I JUST DON'T HAVE ENOUGH DETAIL ON THIS SO I WOULD LIKE TO SEE THE SCORE SHEET FOR THE ORIGINAL RFP FOR THIS RFP I JUST HAVE ENOUGH DETAIL OR DATA SO IF I HAVE THAT INFORMATION THEN I'LL BE HAPPY TO VOTE ON IT AT THE NEXT COMMISSION MEETING ACTUALLY JACK HAS ANYTHING YOU WANTS TO HELP ANSWER FOR YOU HE CAN. YES THE INITIAL TARGET WHO YOU ARE. OH YEAH JACK STRAIN PUBLIC SERVICE DIRECTOR EXCUSE ME. THE INITIAL BID PROCESS WAS WAS EXECUTED IN THE LOW BIDDER. HAD A FAIRLY SUBSTANTIAL DIFFERENCE BETWEEN HIM AND THE NEXT. THE OTHER BIDDER WHEN THEY WENT IN THE PROCESS OF TRYING TO AWARD THE CONTRACT HE REALIZED THAT HE HAD MADE A MATHEMATICAL ERROR A MATHEMATICAL ERROR THAT HE COULD NOT ABSORB. AND SO WE BASICALLY AGREED TO PART WAYS. WE DID COLLECT HIS BID BOND FROM HIM IN THE PROCESS. KEITH YOU CAN EXPLAIN THAT KEITH GLAD SOME PURCHASING CONTRACT MANAGER. WE DID. WE DID GO AFTER A BID BOND BID. MAN OF COURSE IS A SURETY TO ASSURE US THAT HE'S GOING TO BE ABLE TO ENTER INTO THE CONTRACT FOR THOSE WHO AREN'T FAMILIAR WITH IT. AND IT WASN'T ABOUT A 5 PERCENT BID BOND. SO WE ACTUALLY ENDED UP COLLECTING FIFTEEN THOUSAND DOLLARS TO REIMBURSE US FOR ADMINISTRATIVE EXPENSES FOR GOING BACK OUT FOR A BIT IN TERMS OF LOST TIME AND SUCH. SO THEN WE DID REBID THE WHOLE PACKAGE AGAIN. WE HAD TWO BIDDERS THE WAY WE SET UP THE BID. WE'RE ALLOWED TO AWARD PORTIONS OF THE BID TO CERTAIN CONTRACTORS AND BY TAKING THE BIDS OF EACH FACILITY AND SPLITTING THEM BETWEEN THE TWO CONTRACTORS THAT WE'RE TRYING TO AWARD IT DO WE SAVE THE CITY A TOTAL OF TWENTY FOUR THOUSAND DOLLARS IF WE ADD WATER TO THE ACTUAL LOW TOTAL BIDDER. THIS ALSO FACILITATES US TO HAVE TWO CONTRACTORS OUT THERE. IT'S A LOT OF WORK. AND SO GIVING IT ALL TO ONE CONTRACTOR WOULD TAKE A WHILE TO GET DONE AND HOPEFULLY THIS WILL FACILITATE GETTING THE WORK DONE FASTER SINCE WE HAVE TWO INDIVIDUAL CONTRACTORS TO DO THE WORK. HOW MANY BIDDERS BEEN ON THE ORIGINAL RFP TO AND THE LOW BIDDER OBVIOUSLY WAS YOU KNOW WE WERE ALL IN THE PROCESS OF AWARDING AND HE FOUND HIS ERROR CAME TO US AND THE NEXT BID WAS MUCH HIGHER AS I DON'T REMEMBER THE EXACT SIGNIFICANTLY HIGHER. SO THAT'S WHY WE DECIDED. THAT'S WHY WE DECIDED TO GO TO BASICALLY COLLECT THE BID BONN AND RE PACKAGE THE BID AND GO BACK OUT AGAIN

[01:25:02]

TO SEE IF WE CAN GET SOME BETTER COMPETITIVE BIDS WITH THE PART OF THE SECOND BID AS WELL. NOW THE HIGHER THE HIGHER BETTER NO HE DID NOT PARTICIPATE IN THE SECOND ROUND. SO THEN THERE WERE TWO NEW BIDDERS AND THE SECOND RFP YES. IS THERE A REASON WHY WE HAVE SUCH LIMITED COMPETITION ON THE ART PIECE. IT'S THE

[6. CONSENT AGENDA]

NATURE OF THE BEAST RIGHT NOW OR YOU KNOW EVERYBODY'S BUSY AND YOU KNOW WE WE ADVERTISE WE SEND IT OUT TO A LOT OF DIFFERENT THERE'S A LOT OF PEOPLE THAT SUBSCRIBE TO OUR PURCHASING PROCESS AND STUFF AND SO THEY ALL GET SENT. THEY ALL GET SENT TO THEM. BUT YOU KNOW SOME COMPANIES ARE JUST VERY BUSY AND AREN'T INTERESTED IN AND BIDDING. IT'S HAPPENED YOU KNOW IT'S BASICALLY REFLECTIVE OF THE ECONOMY THAT WE'RE IN RIGHT NOW. A LOT OF WORK GOING ON AS WELL THAT THEY'RE TRYING TO CATCH UP ON THAT THEY HADN'T PERFORMED AND WE ACTUALLY WHEN WE ADVERTISE ARE WE ARE SUBSCRIPTION SYSTEM ACTUALLY REACHES OUT TO THE STATE OF FLORIDA DEPARTMENT MANAGEMENT SERVICES IN THE SUPPLIER DIVERSITY SECTION THEY ACTUALLY RECEIVE OUR BIDS AND TENDERS SUBSCRIPTION FOR EVERYTHING AND THEY'RE ABLE TO SERVE WITH THEIR VENDORS SO WE HAVE A PRETTY FAR REACH ON THIS. CAN YOU CAN YOU TELL HOW MANY PEOPLE DOWNLOADED THE RFP. LIKE I WOULD HAVE TO LOOK THAT UP. I CAN WE CAN GET THAT INFORMATION BUT I HAVE TO GET THAT TO YOU LATER. REGARDING THE CONTINGENCIES. CAN YOU EXPLAIN HOW THAT WORKS. BECAUSE IF SO IF I UNDERSTAND CORRECTLY IF I'M BIDDING ON A PROJECT I'M BIDDING FOR THE SCOPE OF THE PROJECT I BUILD MY PROFIT IN I BUILD UP SOME MARGIN FOR ERROR. SO WHY IS THERE CONTINGENCY THERE. AND THEN WHAT HAPPENS IF THE CONTINGENCY IS NOT SPENT WELL AND WE VERY SELDOM DO WE SPEND THE CONTINGENCY UNLESS SOMETHING COMES OUT WHAT'S HAPPENS IS ALL THESE UNITS. YOU KNOW WE'RE REPLACING THE UNITS BUT WHEN WE PULL THE UNITS OUT SOMETHING ELSE THAT'S THAT'S OPERATING AND TANDEM WITH THIS BECAUSE THESE ARE JUST YOU KNOW SINGLE UNITS THERE'S ONE UNIT ON ON ON ONE BUILDING WHICH MIGHT HAVE THREE OTHER UNITS ON IT ET CETERA. IF WE DISCOVER A PROBLEM THE CONTINGENCY ALLOWS US TO HAVE THE CONTRACTOR GIVE US A CHANGE ORDER FOR THAT THAT AND ACTUALLY EXECUTE

[c. TR13229 - Citywide HVAC Replacement (Bid No. 18-23RB)]

IT IF WE DON'T HAVE THE CONTINGENCY IN THERE. WE WOULD ACTUALLY HAVE TO COME BACK TO YOU WITH ANOTHER RESOLUTION. SO WE'RE HALFWAY THROUGH A PROJECT. THE AIR CONDITIONER IS BEEN PULLED OFF OF THE YOU KNOW THE BUILDING AND WE RUN INTO A PROBLEM THAT WAS UNFORESEEN BECAUSE WE DIDN'T DISCOVER IT UNTIL THE UNIT WAS REMOVED. AND THIS ALLOWS US TO TO ACTUALLY BE ABLE TO HANDLE THAT PROBLEM IN A VERY TIMELY MANNER. AND I THINK IF YOU LOOK BACK HISTORICALLY AND OUR PROCESS CONTINUOUSLY WHEN IT'S USED IT'S USED STRICTLY FOR ITS INTENDED PURPOSE AND WE DON'T USE IT ALWAYS BUT IT'S IT'S THERE SO WE CAN BASICALLY ALLOW US TO DO THE WORK IN A TIMELY MANNER AND NOT HAVE TO COME BACK AND ASK FOR MORE FUNDS BECAUSE THERE WAS AN UNFORESEEN CONDITION WHICH IN CONSTRUCTION IS YOU KNOW IT HAPPENS ALL THE TIME. HOW MANY PEOPLE SERVED ON THE SELECTION COMMITTEE. THAT'S THAT'S.

KEITH'S BAILIWICK THERE. AND IF THIS IS APPROVED TONIGHT WHEN DOES THE PROJECT START. NORMALLY WE WOULD SET UP A MEETING WITH THE CONTRACTORS WILL HAVE TO FIND OUT IF SOME OF THESE ITEMS ARE YOU KNOW WHAT TYPE OF DELIVERY IS REQUIRED BECAUSE THESE AREN'T THESE AREN'T THE TYPE YOU'D PUT ON YOUR HOUSE. THEY'RE BIGGER UNITS SO THEY MAY NOT BE AVAILABLE JUST FOR YOU KNOW IN A WAREHOUSE OR SOMETHING. SO WE DON'T HAVE THE AUTUMN. SO DEPENDING ON THE AVAILABILITY OF THE EQUIPMENT AND EVERYTHING AS SOON AS THE EQUIPMENT IS ORDERED TO WHEN WE'D GIVE HIM A NOTICE TO PROCEED AND THEY HAVE BOTH CONTRACTS. SO THIS WON'T BE DELAYED IF IT'S MOVED TO THE NEXT COMMISSION MEETING. OBVIOUSLY WE'VE GONE THROUGH THIS BIDDING PROCESS. AND SO THIS HAS ALREADY BEEN DELAYED AND SOME OF THESE UNITS ARE YOU KNOW REALLY LIMPING ALONG AND SO I WOULD PREFER NOT TO. RIGHT. BUT THAT'S JUST MY PREFERENCE.

OBVIOUSLY WE DO THAT AT YOUR BECK AND CALL TIMEFRAME IS 90 DAYS ASSISTANCE SUBSTANTIAL COMPLETION FOR HIGH VAX PORTION WHICH IS THE BSL BUILDING THE REC

[01:30:01]

CENTER PUBLIC SERVICES NORTH BUILDING AND THE PARK ADMINISTRATION BUILDING AND THAT'S THE SAME SCHEDULE FOR MASTER MECHANICAL SERVICES WHO HAS THE AQUATIC CENTER CITY HALL AND PUBLIC SERVICES SOUTH. AND THESE ARE JUST YOU KNOW SINGLE UNITS ON EACH OF THESE BUILDINGS AND THESE THESE BUILDINGS HAVE MULTIPLE UNITS ON THEM AND KEITH WAS THIS. IN TERMS OF THE SCORE OR THE EVALUATION IS IT JUST ANOTHER RFP WAS ONLY BASED ON PRICE AND NOT LOOKING AT. QUALITY OF WORK OR PROFESSIONAL CERTIFICATIONS. HOW ARE THESE FIRMS EVALUATING THIS. THIS WAS A THIS WAS A PRICE PAID A LOW PRICE BID BECAUSE WE WERE ABLE TO SPECIFY RATHER IN GREAT DETAIL WHAT WE NEEDED FOR THIS PARTICULAR PROJECT WHEN WE HAD SITUATIONS WHERE WE CAN WELL EXPRESS OUR REQUIREMENTS WE USUALLY HANDLE IT AT A LOW PRICE. IS THERE ANY CONCERN THAT BY DOING BY GOING AFTER LOW PRICE ALL THE TIME THAT WE DON'T GET THE BEST QUALITY VENDORS. IS THAT WHY THERE'S SO FEW VENDORS BIDDING ON THIS. I DON'T THINK THAT THAT'S THE CASE BECAUSE IN MANY OF OUR DESIGN BUILD TRANSACTIONS WHICH WE DO LOOK AT OTHER THINGS OTHER THAN LOW PRICE WE. WE HAVE WE'RE HAVING EXPERIENCING THE SAME DIFFICULTIES AND GETTING VENDORS TO RESPOND IS VERY JUST NOT RESPONDING IN THIS PARTICULAR ECONOMY. THEY'RE JUST YOU KNOW OBVIOUSLY THESE PROJECTS HAVE TO BE DONE IN A TIMELY MANNER. AND SO A LOT OF THESE COMPANIES LOOK AT THEIR WORKLOAD AND IF THEY SEE THE TIME FRAME THAT WORD ADVERTISING THAT WE WANT THE WORK DONE AND THEY WON'T BE ABLE TO PERFORM THEN THERE'S GOING TO BE PROBLEMS. BUT YOU KNOW THE INDUSTRY IS VERY BUSY RIGHT NOW BECAUSE EVERYBODY'S BUILDING AND SO SOMETIMES WE'RE WE'RE SURPRISED AT THE NUMBER OF BIDS THAT WE ACTUALLY GET. BUT BOTH OF THESE COMPANIES ARE REPUTABLE COMPANIES IBAC HAS DONE WORK FOR US BEFORE.
