GUNN AND I WORKED WITH JOHN HERIN, HE AND I HAVE GONE BACK AND FORTH TO MAKE SURE THAT WE DELIVER TO YOU A PROPOSED AGREEMENT THAT IS MODELED IN THE WAY THAT THE COMMISSION REQUESTED AND THAT IT'S MODELED AFTER THE CORAL SPRINGS AND SUNRISE AGREEMENT WITH CERTAIN PROVISIONS THEREIN THAT WERE SPECIFICALLY REQUESTED BY THE COMMISSIONERS.

SO YOU HAVE THE AGREEMENT BEFORE YOU AND WE'RE PREPARED TO ANSWER ANY QUESTIONS.

BECAUSE AS YOU ALL KNOW, THE PRIOR CITY ATTORNEY, SAM GOREN, DID NOT MAKE IT CLEAR TO THE COMMISSION THAT WE WERE RESPONSIBLE FOR CONDUCTING A WRITTEN ANNUAL PERFORMANCE EVALUATION OF THE PRIOR CITY MANAGER, MAGIC MIKE.

HE WAS NEVER HELD ACCOUNTABLE AND WENT ON TO COMMIT CRIMES AND PUT THE CITY'S REPUTATION AT RISK. SO WE NEED TO MAKE SURE THAT THE CITY ATTORNEY DOES THEIR JOB-- COMMISSIONER GELIN, THE CITY ATTORNEY, WISHES TO SPEAK.

THAT WE ARE. WE ARE GOING TO BE EXECUTING.

BUT I ALSO DO HAVE WRITINGS BACK AND FORTH FROM MR. HERIN THAT HE HAD FULL INPUT AND FULL PARTICIPATION.

IN FACT, AS I SAID, IT WAS HIS-- HE PROVIDED US THIS AGREEMENT/ SO AS TO FORM IT IS, ON BEHALF OF THE CITY OF TAMARAC.

RIGHT, SO WHEN YOU GOT THE AGREEMENT, YOU SAT DOWN WITH THE WITH YOUR CLIENT KATHLEEN GUNN AND WENT THROUGH THE CONTRACT PROVISIONS WITH HER CORRECT.

RESPECTFULLY, I KNOW THAT NONE OF US WANT TO GET INTO ATTORNEY CLIENT COMMUNICATIONS.

AND SO WHEN HE PROVIDED US THAT DRAFT, IT WAS BASED ON YOUR SPECIFIC DIRECTION IN TERMS OF WHAT YOU TOLD HIM TO GIVE TO US FROM THE-- AT THE PREVIOUS MEETING.

SO JUST IN TERMS OF THAT.

AGAIN, I'M NOT TRYING TO SPEAK FOR YOUR CITY ATTORNEY, NOR AM I TRYING TO TAKE ON THE ISSUES THAT YOU'RE POSING.

I'M JUST TRYING, IN GOOD FAITH, JUST TO ADD SOME CLARITY THAT THE NOTES WE ALL WALKED AWAY WITH AT THE LAST COMMISSION MEETING WE UNDERSTOOD WERE OUR MARCHING INSTRUCTIONS AND SPECIFICALLY HIS BECAUSE HE'S YOUR ATTORNEY IN TERMS OF WHAT YOU WANTED TO SEE.

SO THEN ANOTHER QUESTION I HAVE IS JUST ON SECTION THREE REGARDING THE SALARY AND PERFORMANCE REVIEW STANDARDS.

IT SAYS THAT'S GOING TO BE PREPARED BY THE HR DIRECTOR.

WHEN IS THAT GOING TO BE PREPARED, [INAUDIBLE] TO RECEIVE IT? AND SHOULDN'T WE GET THAT BEFORE WE VOTE ON THIS ITEM SO THAT BOTH THE CITY MANAGER AND THE COMMISSION UNDERSTANDS WHAT THE PERFORMANCE STANDARDS ARE AND THAT SHE'LL BE JUDGED BY? THAT'S FOR THE HR DIRECTOR, CITY ATTORNEY,

I BELIEVE THAT FROM THE CITY MANAGER'S OFFICE, LAURA [INAUDIBLE] WAS ASKED TO FACILITATE THAT RESEARCH AND DISCUSSION, SO WE NEED TO BRING THAT BACK TO YOU IN A WORKSHOP SETTING SO THAT YOU CAN DIRECT THOSE PARAMETERS AND PREPARE THE OBJECTIVES FOR THE MANAGER'S EVALUATION. YEAH, SO PERSONALLY, I DON'T CARE WHETHER OTHER CITIES CONDUCT A PERFORMANCE EVALUATION ON THEIR CITY MANAGER OR NOT.

I KNOW WE WERE SUPPOSED TO FROM THE LAST CONTRACT AND WE DID NOT.

I THINK IT'S IMPORTANT TO TO HAVE SOME STANDARDS OF ACCOUNTABILITY, ESPECIALLY GIVEN THE HISTORY OF CORRUPTION THAT WE HAVE IN OUR CITY FROM CITY MANAGEMENT.

SO I THINK THAT'S SOMETHING THAT WE SHOULD HAVE IN FRONT OF US PRIOR TO US EXECUTING OR VOTING ON THIS AGREEMENT.

AND FROM WHAT I UNDERSTAND, THERE WERE SOME PROPOSED PERFORMANCE EVALUATIONS THAT WERE PRESENTED FROM THE PRIOR CITY MANAGER THAT WE NEVER TOOK ACTION ON.

SO THAT'S SOMETHING THAT WE SHOULD BE REVIEWED-- THAT SHOULD BE REVIEWED AND SHOULD BE INCORPORATED AS PART OF THIS AGREEMENT.

IT SHOULD NOT BE A SEPARATE ITEM.

IT IS RETROACTIVE TO AUGUST 31ST OF TWENTY TWENTY ONE.

SO THE EFFECTIVE DATE WILL BE AFTER RATIFICATION.

THE EFFECTIVE DATE WILL BE AUGUST 31ST.

OK, SO MY QUESTION OR CONCERNS WHEN IT COMES TO HOW WE'RE GOING TO EVALUATE.

I DON'T THINK THAT THIS CONTRACT NEEDS TO BE CONTINGENT ON FINALIZING THAT EVALUATION PLAN. AT THE RATE WE'VE BEEN GOING TO EVEN COME UP WITH SOMETHING THAT THE FIVE OF US COULD AGREE ON. HAS BEEN TAKING A LITTLE WHILE, AND OBVIOUSLY THAT NEEDS A WORKSHOP OF ITS OWN TO FINALIZE THAT.

I THINK TO HOLD MS. GUNN CONTRACT HOSTAGE, SO TO SPEAK UNTIL THAT IS RESOLVED IS INAPPROPRIATE. WE NEED TO MOVE OUR CITY ALONG BECAUSE WITHOUT MS. GUNN CONTRACT RATIFIED, OTHER THINGS IN OUR CITY CANNOT BE COMPLETED FOR WHAT WE NEED TO DO FOR OUR EXECUTIVE TEAM AND SO ON AND SO FORTH.

SO I SAY WE RATIFY WHAT WE NEED TO.

ANY QUESTIONS THAT WE HAVE WITH THE ACTUAL CONTRACT PERTAINING TO HER PERFORMANCE AND WHATNOT BE DONE AND VOTED ON.

THE WATER FACILITIES SUPPLY PLAN UPDATE IN RESPONSE TO THE LATEST LOWER EAST COAST WATER SUPPLY PLAN BY THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT.

IT WAS AN UPDATE TO THE 2013 WATER SUPPLY FACILITIES PLAN THAT WAS PREVIOUSLY PREPARED BY US FOR THE CITY OF TAMARAC WITH THE WATER SUPPLY FACILITIES PLAN DOES AS IT LOOKS AT CURRENT WATER USAGE, POPULATION PROJECTIONS AND FACILITIES NEEDED TO BE IMPLEMENTED AND CONSTRUCTED OR MAINS MAINTAINED.

WHATEVER NEEDS TO BE IN PLACE FOR THE CITY OF TAMARAC TO MOVE FORWARD WITH SUPPLYING POTABLE WATER TO THE RESIDENTS AND BUSINESSES OF THE CITY OF TAMARAC IN MY OFFICE.

THE WORK PLAN INCLUDES VARIOUS SECTIONS THAT REQUEST BACKGROUND ON THE CITY'S WATER FACILITIES, AS IS NOW WHAT'S PROJECTED TO BE DONE IN THE FUTURE.

AND WE ALSO DO SOME POPULATION PROJECTIONS AND WATER DEMAND PROJECTIONS TO MAKE SURE THAT THE CITY SUPPLY CAN PROVIDE THE WATER THAT'S NEEDED TO SUPPLY THE RESIDENTS IN THE BUSINESSES IN THE CITY.

SO FIRST THING IS THE WATER SUPPLY WE'RE [INAUDIBLE], THIS IS THE 2020 UPDATE.

IT WAS THE PURPOSE OF THE WORK PLAN IS TO IDENTIFY AND PLAN FOR THE WATER SUPPLY SOURCES THAT'S NEEDED TO MEET THEIR DEMAND AND PROJECTED DEMANDS FOR THE CITY AS A WHOLE.

WORK PLANS INCORPORATED INTO THE COMPREHENSIVE PLAN OF THE CITY IN REFERENCE-- EITHER INCORPORATED OR REFERENCED BY IN THE WORK PLANS, IS DIVIDED INTO FIVE SECTIONS AS LISTED ABOVE. THE MAIN ITEMS ARE FOR THE SECTIONS OF THE DATA ANALYSIS AND THE CAPITAL IMPROVEMENTS. THAT SHOWS WHAT THE PROJECTIONS ARE REQUIRING AND WHAT IS BEING DONE TO MAKE SURE THAT THE CITY MEETS THAT REQUIREMENT.

FIRST, THE WORK PLAN REQUIREMENTS.

THIS IS A REQUIREMENT OF BOTH THE STATE AND FEDERAL GOVERNMENT, AS WELL AS THE WATER MANAGEMENT DISTRICT, REQUIRES US TO BE DONE IN ALL UTILITIES IN CITIES THROUGHOUT THEIR DISTRICT AREA. AND AS WELL AS THIS IS A STIPULATION OF THE WATER PERMIT THAT THE CITY HAS TO PROVIDE AND SUPPLY THE WATER TO THE CITY.

AND THAT'S A STATEMENT DIRECTLY FROM THE WATER SUPPLY LEC UPDATE THAT'S REQUESTED AND DONE AS PART OF THIS.

SO WHAT THE WORK PLAN IS INSTRUCTED BY THE LEC, WHICH IS THE LOWER EAST COAST PLAN FROM THE SOUTH WATER MANAGEMENT DISTRICT TO DO THIS.

SO THE TWO THOUSAND EIGHTEEN LEC `UPDATE CAME OUT, THEN IT WAS RATIFIED IN 2019, I BELIEVE. AND INSTRUCTS ALL THE CITIES TO DO THIS.

THE STATE STATUTE REQUIRES THE WATER MANAGEMENT DISTRICT TO DO THEIR OWN UPDATE, AND THEN THAT REQUIREMENT IS PASSED ON TO EACH CITY AND UTILITY, AND THE PLAN FORECASTED EVERY 20 YEARS, AND IS DONE EVERY FIVE YEARS.

I'M SORRY. AND THAT'S A PICTURE OF THE WATER MANAGEMENT DISTRICT FOR THE SOUTH FLORIDA RANGES FOR THIS AREA.

OF THE 2018 LOWER EAST COAST PLAN WAS APPROVED BY THE SOUTH FLORIDA DISTRICT ON JAN.

11TH 2019, AND THE CITIES WERE REQUIRED AT THAT TIME TO COMPLETE THEIR OWN WATER SUPPLY PLAN WITHIN 18 MONTHS, WHICH MAKES IT-- THE WORK PLAN WAS DUE JULY 11TH.

2020. AND THAT'S A PICTURE OF THE LOWER EAST COAST AND IN A BROWARD COUNTY, WITH ALL THEIR UTILITIES BURIED WITHIN THE COUNTY.

SO THE NEXT THING IS THE TAMARAC WATER SUPPLY FACILITY WORK PLAN.

THE INITIAL PLAN WAS SUBMITTED FOR REVIEW TO THE SOUTH FLORIDA WATER MAJOR DISTRICT IN JUNE OF 2020.

WE REVISED IT FROM COMMENTS FROM BOTH THE CITY UTILITY DEPARTMENT AND FROM THE SOUTH WATER MANAGEMENT DISTRICT IN AUGUST 2020.

AND THEN WE FINALIZED AND SUBMITTED THAT REVISED REPORT PLAN TO THE CITY IN FEBRUARY 1ST OF THIS YEAR. AS WELL, WE COMPLETED THE LAST TWO WORK PLAN UPDATES THE 2018 AND 2013 LEC PLANS. AND THE CITY AS WELL, THE CITY RECEIVES WATER FROM THREE DIFFERENT UTILITIES.

THE CITY ITSELF, BROWARD COUNTY, AND ALSO THE CITY OF FORT LAUDERDALE.

SO AS PART OF THIS WORK PLAN, WE HAVE TO MAKE SURE INCORPORATE INFORMATION FROM THOSE UTILITIES AS WELL TO MAKE SURE THAT WE SHOW THAT THE CITY CAN PROVIDE WATER TO ALL OF ITS RESIDENTS, EVEN IF IT'S NOT SUPPLIED BY THE CITY UTILITY ITSELF.

AND THIS IS A SHOWS THE POPULATION PROJECTIONS THAT WAS DONE.

THIS IS FROM THE ACTUAL WORK PLAN ITSELF.

THE TAMARAC POPULATION CURRENTLY STANDS AT SIXTY SEVEN THOUSAND FOUR HUNDRED AND TEN.

THAT WAS FROM 2020'S DATE.

THE POPULATION SERVED BY TAMARAC PUBLIC SERVICES ALONE IS 62,991 AND THE PROJECTION THROUGH 2040 PROVIDES A POPULATION OF EIGHTY TWO THOUSAND OR SO PEOPLE.

THESE PRODUCTIONS INCLUDE ALL KNOWN DEVELOPMENT FROM THE 2018 DEVELOPMENT PLAN.

AND THERE'S THE ACTUAL PROJECTION TABLE FROM THE WORK PLAN FOR REFERENCE.

THE WATER PRODUCTIONS FOR TAMARAC PUBLIC SERVICES, SO WE TOOK THE POPULATION PROJECTIONS AND CONVERTED THAT INTO A DEMAND PROJECTION TO SHOW WHAT DEMAND IS NEEDED FOR WATER, AND WE CAN SHOW THAT THE WATER SUPPLY FACILITIES FOR RAW WATER CAN SUPPLY THAT DEMAND.

AND THIS IS A TABLE OF SHOWS, THOSE DIFFERENT NUMBERS WITH DIFFERENT RATIOS TO MAKE SURE WE CAN MEET THOSE DEMANDS.

THE NEXT THING WOULD BE THE TAMARAC CAPITAL IMPROVEMENTS PLAN, WHICH IS DONE TO SHOW WHAT THE TAMARAC HAS PLANNED TO DO TO THEIR UTILITY SERVICES THROUGHOUT THE NEXT TEN YEARS, ACTUALLY 20 YEARS, TO MAKE SURE THEY CAN MEET THOSE DEMANDS TO PROVIDE WATER SERVICE TO THEIR RESIDENTS BY DOING DIFFERENT PROJECTS TO BOTH THE UTILITY PIPELINE SYSTEM, THE RAW WATER, THE WATER LINES, AS WELL AS THE WATER TREATMENT PLAN ITSELF.

IN ADDITION TO WHAT THAT SHOWS, NEWER PROJECTS THAT TAMARAC IS CURRENTLY UNDERWAY WITH FOR DESIGN AS AN ADMINISTRATION AND CONTROL BUILDING PROJECT IN FILTRATION SYSTEM IMPROVEMENTS, BOTH OF WHICH ECKLER ENGINEERING IS PART OF THE DESIGN PROJECT FOR THAT.

THE LAST SECTION OF THE WORK PLAN IS THE GOAL OBJECTIVES AND POLICIES, AND THE THE MAIN GOAL WAS TO PROVIDE INFRASTRUCTURE NECESSARY TO PROVIDE FOR THE WEALTH, WELFARE AND SAFETY OF ITS RESIDENTS.

CITY WILL CORRECT EXISTING DEFICIENCIES AND MAINTAIN NEEDED PUBLIC FACILITIES AND PROVIDE A REQUIRED PROVISION OF FACILITIES CONCURRENT WITH THE IMPACT OF DEVELOPMENT.

THE CITY INCORPORATES SIX OBJECTIVES TO MEET THESE GOALS AND PLANS INITIATIVES TO MEET THOSE AS WELL. AND THEN SOME OF THE HIGHLIGHTED OBJECTIVES ARE LISTED AS WELL AS THE CITY, THE WATER TREATMENT PLANTS, MISSION AND GOALS.

THE POLICIES ARE DEVELOPED AND ENACTED TO FOLLOW, TO MAINTAIN THE OBJECTIVES, TO ACHIEVE THE CITY OF TAMARAC GOALS.

THESE ARE SOME HIGHLIGHTED CITY POLICIES THAT ARE THERE WITHIN THE WORK PLAN, AS WELL AS THE COMP PLAN FOR THE CITY.

THE COMPREHENSIVE PLAN CHANGES, SO STATE STATUTE REQUIRES THE ADOPTION OF THE WORK PLAN AND THE AMENDMENT OF THE CITY'S COMMISSION.

COMPREHENSIVE PLAN TO BE CONSISTENT WITH THE WORK PLAN.

HOWEVER, IF YOU'RE SAYING WE'RE PULLING SOME WATER FROM FORT LAUDERDALE AND FORT LAUDERDALE IS PART OF THIS WHOLE PROCESS, AND WE ACTUALLY ARE ALL IN IT TOGETHER, AND IT WAS JUST QUITE FASCINATING.

JUST THIS IS A COMMENTARY.

SO MY ONLY QUESTION BASED ON NUMBERS, ACCORDING TO THE CENSUS, WE SUPPOSEDLY ARE GOING-- OR ARE AT APPROXIMATELY SEVENTY TWO THOUSAND PEOPLE NOW.

SO HOW DOES THAT AFFECT THE NUMBERS THAT YOU HAVE HERE AND OUR COMPREHENSIVE PLAN FOR THE FUTURE WITH OUR WATER? WHEN WE DID THE REPORT, THE CURRENT CENSUS SAID 70000, CORRECT, THAT IS WHAT WE HAVE BEEN ADVISED. IS THAT CORRECT? MS. GUNN YEAH.

IN 2018, AS AS YOU'RE AWARE, THE OLD CLUBHOUSE WAS WAS TORN DOWN.

AND ALSO DURING-- WITH THAT TEAR DOWN GOLF OPERATIONS AND PRO SHOP OPERATIONS WERE CONDUCTED OUT OF A TRAILER FROM THAT TIME UNTIL RECENTLY WHEN THE NEW CLUBHOUSE WAS DONE . SO IN-- ALSO IN 2019-20, WE HAD THE CHALLENGES OF COVID.

THEREFORE, THE REVENUES DO NOT MEET THE THE PROJECTED BUDGETS DUE TO THAT, AS THE BUDGET WAS WAS BASED ON MANY MORE MONTHS OF OPERATION.

REVENUES JUNE THROUGH SEPTEMBER IN 2021, TOTAL TWO HUNDRED AND FORTY NINE THOUSAND SIXTY SEVEN DOLLARS.

AS A GOLF SEASON HAS BEGUN, STARTING TO SEE AN INCREASE IN GOLFER RELATED REVENUE IN THE VIEW, AND IF THE [INAUDIBLE] BEEN ABLE TO ESTABLISH A RELATIONSHIP WITH SOME COMMUNITY GROUPS SUCH AS THE KINGS POINT AND THE LATINO WOMAN OF TAMARAC HAVE BEEN UTILIZING THE RESTAURANT AS WELL. SO THOSE NUMBERS HAVE BEEN VERY, VERY GOOD.

AND I'LL JUST I'LL JUST READ THROUGH A COUPLE OF THESE, BUT SOME OF THE REVIEWS ON YELP FOR THE VIEW RESTAURANT.

ONE, THEIR FOOD IS GREAT AND THE DINING ROOM IS BEAUTIFUL.
