BEFORE I GET INTO THE STATEMENT AND THE SWEARING IN OF THE WITNESSES, I WANT TO JUST LET THE BOARD KNOW IF YOU AREN'T AWARE THAT THIS WILL BE THE LAST MEETING THAT I WILL BE ATTENDING AS OUR FIRM WILL NO LONGER BE REPRESENTING THE CITY FOLLOWING THE CLOSE OF THIS PARTICULAR WEEK. SO THE DECISIONS THEY MAKE WILL BE BASED ON THE CURRENT CODE AS IT STATES TODAY.

DECISIONS FROM THE BOARD WILL REQUIRE APPROVAL OF THE MAJORITY OF THE QUORUM PRESENT HERE TODAY AND FOR TODAY.

THAT WILL BE A MINIMUM OF TWO VOTES FOR AN ITEM TO BE APPROVED.

FOR PURPOSES OF THE HEARINGS TODAY, THESE HEARINGS ARE CONSIDERED TO BE QUASI JUDICIAL.

SO THAT REQUIRES THAT PRIOR TO THE TESTIMONY BEING PRESENTED TO THE BOARD, WITNESSES MUST BE SWORN IN AND ADMINISTERED THE OATH WHICH FUNCTION I WILL PROVIDE AT THE CLOSE OF THESE REMARKS FOR THE STAFF AND FOR EACH WITNESS, EACH WITNESS SPEAKING HERE TODAY BEFORE YOU.

THE SUBJECT PROPERTY IS A LITTLE OVER HALF AN ACRE IN SIZE, IT IS LOCATED ON THE EAST SIDE OF NORTH UNIVERSITY DRIVE, NORTH OF NORTHWEST 78TH STREET AT 7830 NORTH UNIVERSITY DRIVE TO THE NORTH IS TWENTY FIRST CENTURY ONCOLOGY RADIATION THERAPY, WHICH IS ZONED MUN, MIXED USE NEIGHBORHOOD.

TO THE SOUTH IS THE WEST BROWARD EYECARE CARE ASSOCIATES AND DIGIORGIO INSURANCE INC, WHICH ARE BOTH ZONED MUN MIXED USE NEIGHBORHOOD TO THE EAST OF THE SUBJECT PROPERTY IS THE SINGLE FAMILY ZONE SUBDIVISION, WHICH IS ZONED R1 SINGLE FAMILY RESIDENTIAL.

AND THEN TO THE WEST ACROSS UNIVERSITY DRIVE IS THE AVALON ESTATES SINGLE FAMILY RESIDENTIAL SUBDIVISION, WHICH IS ZONED R1 SINGLE FAMILY RESIDENTIAL.

THE PROPERTY IS NOT IMMEDIATELY CONTIGUOUS TO BUSINESS THAT EMITS NOXIOUS OR OFFENSIVE ODORS OR FROM WHICH WOULD BE EMITTED FUMES THAT COULD BE DETRIMENTAL TO THE HEALTH, SAFETY OR WELFARE OF MINOR CHILDREN AND IS SERVICE BY AN ACCESS ROAD THAT RUNS PARALLEL TO UNIVERSITY DRIVE.

IT IS SUBJECT PROPERTY. THOSE ARE SHOWN IN THE GREEN ARROWS ON YOUR SCREEN AND THE SUBJECT PROPERTY THAT'S HIGHLIGHTED IN RED.

CHILD CARE FACILITY IS A PLACE OR CHILD CARE ARRANGEMENT OTHER THAN AN OCCUPIED RESIDENCE THAT IS LICENSED BY BROWARD COUNTY CHILD CARE LICENSING AND ENFORCEMENT SECTION PER THE BROWARD COUNTY CHILD CARE ORDINANCE AS AMENDED THAT PROVIDES CARE FOR MORE THAN FIVE CHILDREN UNRELATED TO THE OPERATOR AND THAT RECEIVES A PAYMENT FEE GRANT OR SOME OTHER FORM OF COMPENSATION FOR ANY OF THE CHILDREN IN CHILD CARE, WHETHER OR NOT OPERATED FOR PROFIT. THE PROPOSED TAMARAC DAYCARE DEVELOPMENT WILL FEATURE A NEW CHILD CARE FACILITY BUILDING AND THE ASSOCIATED PLAY AREA.

THE NEW CHILDCARE FACILITY BUILDING IS PROPOSED TO CONTAIN AN AREA OF SIX THOUSAND TWO HUNDRED FOUR SQUARE FEET, AND THE PLAYER IS PROPOSED TO CONTAIN AN AREA OF TWO THOUSAND SEVEN HUNDRED FIFTY SQUARE FEET.

A WASTE FACILITY THAT'S SHOWN IN BLUE ON YOUR SCREEN HIGHLIGHTED IN BLUE WILL BE PROVIDED WITHIN THE PARKING AREA AND WILL BE SCREENED BY A SIX FOOT HIGH MASONRY WALL, WHICH WILL BE PAINTED TO MATCH THE BUILDING IN COLOR.

THE PROPOSED CHILD CARE FACILITY BUILDING THE WASTE FACILITY AND THE [INAUDIBLE] MEETS OR EXCEEDS ALL MINIMUM SET BACKS REQUIRED.

ADDITIONALLY, NO SETBACK OR YARD AREA REQUIRED BY THE CODE OF ORDINANCES IS USED AS USABLE AREA OF OUTDOOR SPACE PER CHILD AS DEFINED IN THE COUNTY IS AS DEFINED IN THE COUNTY REGULATIONS. NOR IS THE YARD OR SETBACK AREA USED TO CALCULATE THE NECESSARY USABLE AREA OF THE OUTDOOR SPACE PER CHILD AS REQUIRED BY COUNTY REGULATIONS.

THE OUTDOOR PLAY AREA IS SAFELY SEPARATED FROM ACCESS WAYS AND THE PARKING AREA, AND THERE IS NO OPERATION OF OUTDOOR PLAY ACTIVITIES AFTER 8PM PURSUANT TO THE CODE REQUIREMENT AND A NOTE PLACED ON THE SITE PLAN IDENTIFYING SUCH.

THE REQUIRED TWENTY FIVE FOOT LANDSCAPED BUFFER IS PROVIDED BETWEEN THE PLAY AREA AND THE RESIDENTIAL ZONE DISTRICT IN THE REAR OF THE SUBJECT PROPERTY, NO PORTION OF THE AREA WAS USED FOR THE REQUIRED LANDSCAPE BUFFER, AND THE PLAY AREA IS SEPARATED FROM THE REQUIRED LANDSCAPE BUFFER BY ALUMINUM, SIX FOOT HIGH FENCE.

AND SO YOU CAN SEE THE PLAY AREA, WHICH IS HIGHLIGHTED IN GREEN ON YOUR SCREEN, ON THE RIGHT HAND SIDE. AND THEN I HIGHLIGHTED THE THE WALL WHERE THE WALL IS GOING TO BE IN RED. AND YOU CAN SEE THAT THE WALL IS PLACED 15 FEET FROM THE REAR PROPERTY LINE.

AND THEN I AND THEN I HIGHLIGHTED THE PLAY AREA IN YELLOW, THE FENCE THAT GOES AROUND THE PLAY AREA. SO YOU CAN SEE THERE'S A DEFINITE, DEFINITE SEPARATION FROM THE FENCE TO THE WALL AND TO THE REAR PROPERTY LINE THAT YOU HAVE THAT THAT 15 FEET THAT THAT'S REQUIRED.

FORTY ONE NEW TREES CONSISTING OF THREE PALM TREES, 19 SHADE TREES AND 18 SMALL TREES WILL BE PLANTED THROUGHOUT THE PROPERTY.

11 EXISTING TREES CONSISTING OF FOUR PALM TREES, SEVEN SHADE TREES ARE TO REMAIN ON THE SUBJECT PROPERTY. ADDITIONALLY, THREE HUNDRED AND SEVENTY COCOA PALM SHRUBS WILL BE PLANTED ALONG THE PROPERTY LINE, ACCESS ROAD BUFFER WALL AND DUMPSTER ENCLOSURE WHILE THE

SO AS YOU CAN SEE ON THE LANDSCAPE PLAN, YOU CAN SEE THE TREES THAT WILL BE PLANTED ON THE INSIDE AND OUTSIDE OF THE WALL THAT'S ADJACENT TO THE RESIDENTIAL IN THE REAR.

SO WE HAVE TREES BOTH ON INSIDE AND OUTSIDE OF THE WALL.

PLUS YOU HAVE THE HEDGE ON THE INSIDE AND OUTSIDE OF THE WALL.

THE PROPOSED NEW TREES INCLUDE SABLE PALMS, CRAPE MYRTLE TREES, LIVE OAK TREES, GUMBO LIMBO TREES, AND THE EXISTING TREES INCLUDE FOXTAIL PALMS, ROYAL POINCIANA TREES AND A LIVE OAK TREE. SHADE TREES WILL BE PLANTED WITHIN THE LANDSCAPE AREA ADJACENT TO THE SIDEWALK TO PROVIDE ADEQUATE SIDEWALK SHADING AS WELL.

ACCESS TO THE SUBJECT PROPERTY IS PROVIDED BY AN INGRESS EGRESS OPENING LOCATED ON THE TWO WAY ACCESS ROAD THAT RUNS PARALLEL TO NORTH UNIVERSITY DRIVE.

THOSE ARE SHOWN IN GREEN, GREEN YELLOW, AS YOU CAN SEE, WHERE YOU ACCESS THE PROPERTY AND THE RED SHOWING THE TWO WAY ACCESS DRIVE VEHICLE ACCESS IN CIRCULATION IS DESIGNED TO ENHANCE THE SAFETY OF CHILDREN WHEN ARRIVING AND LEAVING THE FACILITY AS A DESIGNATED PASSENGER PICKUP AND DELIVERY AREA OF SIX PARKING SPACES IS PROVIDED TO CHILDREN DO NOT HAVE TO CROSS ACCESS WAYS OR ENTER TO ENTER EXIT THE FACILITY.

SO THE REQUIRED 13 AND THEY HAVE 15.

SO THERE ARE TWO OVER THE REQUIREMENT.

AND PEDESTRIAN ACCESS TO THE PROPERTY WILL BE PROVIDED BY A SIDEWALK THAT CONNECTS DIRECTLY TO THE EXISTING SEVEN FOOT SIDEWALK ON NORTH UNIVERSITY DRIVE.

AND YOU CAN SEE I HIGHLIGHTED THAT IN YELLOW YOU CAN SEE WHERE THE THE PEDESTRIAN ACCESS, WHERE YOU CAN GET ACCESS TO THE SEVEN FOOT SIDEWALK ON UNIVERSITY AND THEN CROSS OVER ONTO THE PROPERTY. THE CHILD CARE FACILITY BUILDING WILL CONTAIN SIX CHILDCARE ROOMS WITH A MAXIMUM CHILD OCCUPANCY OF ONE HUNDRED AND TWENTY CHILDREN PERMITTED WITHIN SIX CHILD CARE ROOMS. THAT WORKS OUT TO 20 CHILDREN PER ROOM.

BUT DUE TO THE SIZE OF THE ROOM, IT DIFFERS DEPENDING ON THE SIZE OF THE ROOM.

A WARMING KITCHEN WITH PANTRY AND ADMINISTRATION ROOM, OFFICE AND A JANITORIAL CLOSET IS ALSO PROVIDED WITHIN THE BUILDING.

YOU CAN SEE THOSE ON THE FLOOR PLAN THE LOCATIONS OF ALL.

THE ONE STORY CHILD CARE FACILITY BUILDING FEATURES THE STACKS, STONE VENEER BANDING ALONG THE BOTTOM OF THE FRONT FACADE OF THE BUILDING AND ENTRY COLUMNS THAT SUPPORT THE FRONT BUILDING OVERHANG.

A SHAPE [INAUDIBLE] STUCCO BAND WILL HIGHLIGHT THE FRONT BUILDING ROOF OVERHEAD, AND THE ENTRY COLUMNS WILL PRESENT DECORATIVE LIGHTING ON BOTH SIDES OF THE FRONT BUILDING ROOF OVERHANG WINDOWS WILL BE PROVIDED ON ALL SIDES OF THE BUILDING WITH THE SAME SHAPE, SMOOTH STUCCO BANDING HIGHLIGHTING THE FRONT BUILDING ROOF OVERHANG ON THE TOP OF THE BUILDING. THE FRONT AND REAR BUILDING OVERHANGS ARE HIGHLIGHTED BY TERRACOTTA SPANISH TILE GABLE ROOFS PROVIDED AT 20 FEET IN HEIGHT TO THE MIDPOINT OF THE ANGLED ROOF, WHILE THE ANGLED ROOF SURROUNDING THE REMAINDER OF THE BUILDING IS PROVIDED WITH THE SAME TERRACOTTA SPANISH TILE AT A HEIGHT OF 16 FEET AND NINE INCHES TO THE TOP OF THE ROOF.

SO YOU COULD SEE THOSE HEIGHTS ON THE SCREEN.

THE BUILDING WALLS WOULD BE PAINTED IN A BEIGE COLOR WHILE THE BUILDING ROOF OVERHANG WOULD BE PAINTED LATTE IN COLOR, TEXTURE, STUCCO BANNING PAINTED SMOKY TOPAZ IN COLOR WILL BE PROVIDED ALONG THE BOTTOM OF THE SIDES AND REAR SIDES OF THE SIDES OF THE BUILDING. AND THE ROOF ACCENT TRIM WILL BE PAINTED MODEST WHITE IN COLOR.

AND YOU CAN SEE ALL THOSE COLORS ON THE BOTTOM RIGHT OF YOUR SCREEN.

AN ARCHITECTURAL REVIEW OF THE PROPOSED CHILDCARE FACILITY WAS CONDUCTED BY THE CITY'S ARCHITECTURAL CONSULTANTS, ARCHITECTS INC, IN AN EFFORT TO ENHANCE THE SUSTAINABILITY AND VISUAL APPEARANCE WITHIN THE CITY.

THE ARCHITECTURAL CONSULTANT REVIEW CONFIRMS THAT ALL SITE AND BUILDING DESIGN REQUIREMENTS ARE SATISFIED, INCLUDING GENERAL BUILDING DESIGN STANDARDS THAT FOSTER HIGH QUALITY, ATTRACTIVE AND SUSTAINABLE DEVELOPMENT.

THE GENERAL BUILDING DESIGN STANDARDS INCLUDE FORESIGHTED ARCHITECTURE, DESIGN, SHADED SIDEWALKS, SUSTAINABLE DESIGN, HORIZONTAL AND VERTICAL ARTICULATION, FACADE TRANSPARENCY AND PEDESTRIAN DESIGN, PRIMARY BUILDING ENTRANCE AND AMENITY REQUIREMENTS.

AND WHEN WE'RE TALKING AMENITIES, WE'RE NOT TALKING BENCHES.

WE'RE TALKING THE BUILDING OVERHANGS AND STUFF TO PROVIDE AMENITIES TO PEDESTRIANS

OK, SO THE TABLE OF ALLOWED USES WITHIN THE CODE OF ORDINANCES IDENTIFIES THAT A CHILD CARE FACILITY IS ALLOWED IS A SPECIAL EXCEPTION IN THE MUN MIXED USE NEIGHBORHOOD ZONING DISTRICT. SPECIAL EXCEPTIONS ARE USES ALLOWED IN THE RESPECTIVE ZONING DISTRICT ONLY IF REVIEWED AND APPROVED BY THE PLANNING BOARD.

THE PURPOSE OF THE SPECIAL EXCEPTION IS TO PROVIDE FOR INDIVIDUAL REVIEW OF CERTAIN USES THAT DUE TO THEIR NATURE RELATIONSHIP TO THE COMPREHENSIVE PLAN AND POTENTIAL ADVERSE IMPACTS ON SURROUNDING AREAS, REQUIRE SPECIAL CONSIDERATION OF THEIR LOCATION, DESIGN AND METHODS OF OPERATION, AS WELL AS THE IMPOSITION OF CONDITIONS TO MITIGATE CONCERNS BEFORE THEY CAN BE DEEMED APPROPRIATE IN A ZONING DISTRICT AND COMPATIBLE WITH THEIR SURROUNDINGS. THE LAND DEVELOPMENT CODE IDENTIFIES REVIEW STANDARDS TO BE EMPLOYED IN ORDER FOR THE PLANNING BOARD TO MAKE FINDINGS BASED ON SUBSTANTIAL EVIDENCE IN THE RECORD TO APPROVE THE SPECIAL EXCEPTION, THE 10 REVIEW STANDARDS REVIEW STANDARD CONCLUSIONS THAT MUST BE MET TO ENSURE APPROVAL.

THE THREE SITE PLAN APPROVAL STANDARDS THAT MUST BE DETERMINED TO ENSURE SITE PLANNING APPROVAL ARE SHOWN ON SCREEN IN FRONT OF YOU PROVIDED IN THE INTEROFFICE MEMORANDUM FOR TAMARAC DAYCARE. NEW DEVELOPMENTS SITE PLAN RESPONSES TO THE SITE PLAN APPROVAL STANDARDS AS THEY APPLY TO THE SUBJECT PETITION.

IT IS THE OPINION OF THE DIRECTOR OF COMMUNITY THAT STANDARDS FOR SITE PLAN APPROVAL HAVE BEEN SATISFIED. ITEM NUMBER ONE SUPPORTS GOAL NUMBER ONE OF THE CITY OF TAMARAC'S 2040 STRATEGIC PLAN TAMARAC IS HOME.

THE APPROVAL OF THE NEW DEVELOPMENT PLAN WILL ALLOW FOR THE DEVELOPMENT OF THE VACANT SUBJECT PROPERTY, THEREBY PROVIDING AN OPPORTUNITY TO REVITALIZE THE APPEARANCE, IMAGE AND ATTRACTIVENESS OF THE COMMUNITY.

PUBLIC WAS INVITED TO SUBMIT COMMENTS VIA EMAIL TO THE PLANNING BOARD IN ACCORDANCE WITH THE PROCEDURES FOR QUASI JUDICIAL PROCEEDINGS CONTAINED IN THE CITY, RECORD RESOURCES AND NO EMAILS HAVE BEEN RECEIVED.
